أكد القانوني تركي الشمري، أن مجرد عدم التحاق البرتغالي جواو كانسيلو بمعسكر نادي الهلال لا يمنح النادي تلقائياً الحق في اللجوء إلى الاتحاد الدولي لكرة القدم (فيفا)، موضحًا أن الغياب بحد ذاته يُعد واقعة، بينما اعتباره إخلالاً جوهرياً بالعقد يتطلب استكمال إجراءات قانونية وإثباتات محددة.
وأوضح الشمري لـ«عكاظ»، أن على النادي أولاً التحقق من التزام اللاعب بموعد الالتحاق، وإثبات إبلاغه رسمياً، والتأكد من أن غيابه كان دون إذن أو عذر مشروع، إضافة إلى مطالبته بالعودة عبر إنذارات رسمية قبل الانتقال إلى أي خطوة قانونية.
وأضاف، أن اللوائح تمنح النادي في البداية حق تطبيق الجزاءات التأديبية المنصوص عليها في العقد، مثل الإنذار والغرامة والحسم، مع منح اللاعب فرصة لتقديم مبرراته والدفاع عن موقفه. أما إذا استمر الغياب وتجاهل اللاعب الإنذارات، وظهر من سلوكه عدم الرغبة في تنفيذ التزاماته، فقد يرتقي الأمر إلى إخلال جوهري بالعقد يجيز للنادي إنهاءه بسبب مشروع.
وأشار الشمري إلى أنه بعد استكمال جميع الإجراءات النظامية، يحق للهلال اللجوء إلى غرفة فض المنازعات في «فيفا» للمطالبة بإثبات مشروعية إنهاء العقد، والمطالبة بتعويض عن الأضرار التي لحقت بالنادي، وقد تمتد الآثار إلى فرض عقوبات رياضية على اللاعب، إذا وقع الإخلال خلال الفترة المحمية.
واختتم الشمري حديثه بالتأكيد على أن قوة موقف الهلال القانوني لا تُبنى على الأخبار المتداولة أو صور غياب اللاعب عن التدريبات، وإنما على وجود عقد واضح، واستدعاء رسمي، وإنذارات صحيحة، وإجراءات مكتملة، وأدلة تثبت أن الغياب تحول من تأخر عارض إلى امتناع متعمد عن تنفيذ الالتزامات، مشدداً على أن «فيفا» يفصل في الوقائع المثبتة بالعقود والإجراءات، لا في الانطباعات أو التغطيات الإعلامية.
وكان البرتغالي جواو كانسيلو، قد تغيب عن تدريبات نادي الهلال الجماعية أثناء معسكر الفريق في النمسا، تمهيداً لتحقيق رغبته بالانتقال بصورة نهائية إلى صفوف نادي برشلونة خلال الموسم القادم، بعد فترة إعارته في النادي الإسباني الموسم الماضي. ووضعت إدارة الهلال شرطاً لبيع كانسيلو مقابل 15 مليون يورو إلى برشلونة. في وقت يواصل فيه الناديان التفاوض لحسم الصفقة.
The legal expert Turki Al-Shammari confirmed that the mere absence of Portuguese player João Cancelo from Al-Hilal's training camp does not automatically grant the club the right to resort to the International Football Federation (FIFA). He explained that the absence itself is considered an incident, while deeming it a fundamental breach of contract requires completing specific legal procedures and evidence.
Al-Shammari clarified to "Okaz" that the club must first verify the player's commitment to the joining date, prove that he was officially notified, and ensure that his absence was without permission or legitimate excuse. Additionally, the club must request his return through official warnings before taking any legal steps.
He added that the regulations initially grant the club the right to impose disciplinary penalties stipulated in the contract, such as warnings, fines, and deductions, while giving the player a chance to provide justifications and defend his position. However, if the absence continues and the player ignores the warnings, and his behavior indicates a lack of willingness to fulfill his obligations, the matter may escalate to a fundamental breach of contract that allows the club to terminate it for legitimate reasons.
Al-Shammari pointed out that after completing all legal procedures, Al-Hilal has the right to appeal to the Dispute Resolution Chamber at FIFA to demand proof of the legitimacy of terminating the contract and to seek compensation for the damages incurred by the club. The repercussions may extend to imposing sports penalties on the player if the breach occurred during the protected period.
He concluded his remarks by emphasizing that the strength of Al-Hilal's legal position is not based on circulating news or images of the player's absence from training, but rather on the existence of a clear contract, an official summons, valid warnings, completed procedures, and evidence proving that the absence shifted from a temporary delay to a deliberate refusal to fulfill obligations. He stressed that "FIFA" adjudicates based on the facts established in contracts and procedures, not on impressions or media coverage.
Portuguese player João Cancelo had missed Al-Hilal's collective training sessions during the team's camp in Austria, in preparation for his desire to move permanently to FC Barcelona for the upcoming season, following his loan period at the Spanish club last season. Al-Hilal's management has set a condition to sell Cancelo for 15 million euros to Barcelona, while both clubs continue to negotiate to finalize the deal.
