أصدرت محكمة أردنية حكماً بالحبس شهراً بحق شخص من الصم والبكم، إثر توقيفه متلبساً بمحاولة الاستيلاء على كيسي قهوة من داخل مجمع تجاري في مدينة الزرقاء وإعادة المواد المضبوطة قبل مغادرته الموقع.
وتعود التفاصيل إلى دخول المشتكى عليه أحد المحلات التجارية واستغلاله انشغال الطاقم ليخفي كيسي قهوة (بوزن أوقية لكل منهما) بين ملابسه. وعند توجهه نحو بوابة الخروج، اعترضه رجال الأمن وحفظ النظام داخل المول، فيما أظهرت تسجيلات كاميرات المراقبة تفاصيل الواقعة بالكامل.
وأقر المتهم بنية السرقة خلال التحقيقات الرسمية التي جرت بحضور مترجم معتمد لغة الإشارة. وبناءً عليه، عدلت الهيئة القضائية الوصف الجرمي من «سرقة مكتملة» إلى «شروع بالسرقة» لكون إيقافه داخل حرم المبنى حال دون إتمام الفعل، وقضت ابتدائياً بحبسه أربعة أشهر.
واستناداً إلى المادة 427/1 من قانون العقوبات المتصلة بضآلة قيمة المواد واستردادها فوراً، خفّضت المحكمة العقوبة إلى الحبس لمدة شهر واحد فقط مع تحميله الرسوم والمصاريف الإجرائية.
A Jordanian court issued a one-month prison sentence against a person who is deaf and mute, following his arrest while attempting to steal two bags of coffee from inside a shopping mall in the city of Zarqa and returning the seized items before leaving the location.
The details date back to the defendant entering one of the retail stores and taking advantage of the staff's distraction to hide two bags of coffee (weighing one ounce each) among his clothes. As he headed towards the exit, he was intercepted by security personnel maintaining order inside the mall, while surveillance camera recordings showed the entire incident in detail.
The accused admitted to the intent to steal during the official investigations conducted in the presence of a certified sign language interpreter. Consequently, the judicial authority changed the criminal description from "completed theft" to "attempted theft" since his arrest within the premises prevented the act from being completed, and initially sentenced him to four months in prison.
Based on Article 427/1 of the Penal Code related to the trivial value of the items and their immediate recovery, the court reduced the sentence to one month of imprisonment only, while imposing the fees and procedural expenses on him.
