The Hungarian parliament voted today (Monday) to lift the parliamentary immunity of Prime Minister Peter Magyar, in a move that allows authorities to resume a criminal investigation related to an incident that occurred at a nightclub in the capital, Budapest, in 2024, involving allegations of seizing a mobile phone and throwing it into the Danube River.
The parliament approved the decision during an extraordinary session with a majority of 139 votes, with no opposing votes or abstentions recorded, while the Fidesz party and the Christian Democratic People's Party (KDNP) did not participate in the session, according to Hungarian media reports.
Lifting the immunity does not mean that Magyar has been convicted of a crime, but it removes the legal protection that prevented direct criminal investigation actions against him, allowing authorities to continue examining the case.
What happened in the phone incident?
The case dates back to June 21, 2024, shortly after the European Parliament elections. According to the prosecution's account, Magyar got into an argument with a man who was filming him inside the "Outkert" nightclub in Budapest, before being accused of taking the man's phone and later throwing it into the Danube River.
Search teams, with the help of divers, managed to retrieve the phone from the river, and the prosecution stated at the time that the circumstances of the incident could constitute a theft under the law, but the investigation faced a legal obstacle due to Magyar's immunity as a member of the European Parliament at that time.
In September 2024, the Hungarian prosecution requested the European Parliament to lift Magyar's immunity, but the request was not approved, leading to the closure of the investigation at that time.
Magyar's transition to the Hungarian parliament reopened the case
Magyar moved from the European Parliament to the Hungarian National Assembly in May 2026, which allowed the prosecution to re-request the lifting of his immunity, but this time from the Hungarian parliament.
After Monday's vote, authorities can now take investigative actions that immunity had previously prevented.
The question of whether to bring additional charges or refer the case to other judicial stages will depend on what evidence and findings authorities gather from the investigation.
Magyar himself called for the lifting of immunity
Magyar himself urged members of his party in parliament to vote in favor of lifting his immunity, asserting that everyone should be held accountable under the law and that he has nothing to hide. He also denied committing a crime, stating that he would act the same way again under the same circumstances.
At the same time, Magyar criticized the prosecution, claiming that it is trying to place his case in the context of corruption cases that he said are much more serious, accusing authorities of attempting to divert attention from corruption allegations related to the previous government under former Prime Minister Viktor Orbán.
The prosecution rejected these criticisms, affirming that the role of authorities is to conduct investigations in accordance with the law and in a fair manner.
Lifting immunity from other politicians
The parliament's decision was not limited to Magyar, as lawmakers also voted by a majority of 139 votes to zero, with no abstentions, to lift the immunity of former Fidesz Minister Balázs Hankó and KDNP parliament member Miklós Csetneki.
The two cases relate to separate investigations regarding alleged misconduct related, respectively, to the "National Cultural Fund" and the Volánbusz transport company.
The decisions to lift immunity came despite the parliamentary immunity committee's inability to reach a majority supporting the lifting of legal protection for the three politicians, but the parliament's general session ultimately approved all three decisions.
For Magyar, the decision removes the parliamentary obstacle to resuming investigative procedures in the phone case dating back to 2024, while authorities will determine, based on evidence and legal findings, whether the case will proceed to other stages of criminal proceedings.
