The luxury and speed journey of prominent banker Robert Ebert at Deutsche Bank ended with a harsh court ruling in London, closing the curtain on his desperate attempts to hold the Italian automotive giant Ferrari accountable. The British Supreme Court rejected the banker’s lawsuit, in which he sought to force the company to disclose confidential documents to file a multi-million dollar compensation claim, attempting to prove that a hidden defect in his sports car's brakes was the real cause of a fatal car accident that claimed the life of a security guard in Hong Kong in 2015, for which he spent 14 months behind bars, destroying his career that had earned him a salary of $11 million.
The roots of the tragedy date back to June 2015 when the banker was involved in a horrific incident with his Ferrari 458 Spider, which ended with his conviction for reckless driving and causing death, before he enlisted a legal team led by attorney Andrew Butler to reopen the case. The defense relied on the massive recalls announced by Ferrari later for tens of thousands of its cars globally due to defects in the brake fluid reservoir cover (including models that covered the year of his car's manufacture), accusing the company’s expert of giving misleading testimony during the trial that claimed it was impossible for the brakes to fail, which led to his deportation after serving his sentence.
In contrast, Ferrari maintained its stance rejecting the accusations, asserting through its lawyer Tim Otty that there was no link between the recalls and the Hong Kong incident, considering the legal move an attempt to circumvent jurisdiction. This was supported by the British judge who dismissed the lawsuit on the grounds that London was the inappropriate venue due to the lack of evidence, indicating that the more appropriate judicial arena remains in Hong Kong where the inspection and trial took place, or in Italy where the documents are located, leaving the wealthy banker unable to break through the shield of Italian immunity.
