طرحت الهيئة العامة للنقل، مشروع لائحة فحص وصيانة وإصلاح وإعادة اعتماد المعدات وأجهزة الإنقاذ البحرية للاستطلاع تمهيداً لاعتمادها. وتهدف اللائحة الجديدة إلى تنظيم آلية الترخيص ومراقبة أداء المنشآت المتخصصة في أعمال الصيانة والفحص البحري، بما ينسجم مع المعايير الدولية التي حددتها المنظمة البحرية الدولية «IMO» واتفاقية السلامة الدولية للحياة في البحار «SOLAS»، لضمان جاهزية جميع معدات الإنقاذ على السفن التي ترفع علم المملكة، ووضع ضوابط واضحة لإصدار وتجديد وإلغاء التراخيص، وتحديد المتطلبات الفنية والإدارية الواجب توافرها لضمان جودة العمل وسلامة الأداء.
وتسري أحكام اللائحة على السفن السعودية الخاضعة لأحكام الفصل الثالث من الاتفاقيات البحرية الدولية، وعلى المنشآت التي تزاول النشاط داخل المملكة، سواء كانت وطنية أو أجنبية معتمدة من جهات تصنيف دولية.
وحدّدت اللائحة مجموعة من الشروط الأساسية للحصول على الترخيص، أبرزها توظيف فنيين معتمدين من الشركات المصنّعة للمعدات أو من منشآت مرخصة لممارسة النشاط، وتوفير المعدات الفنية المتخصصة وفقاً لتعليمات المصنّعين وبما يتناسب مع متطلبات العمل على ظهر السفن.
وتلزم اللائحة المنشآت بتوفير مركز رئيسي في المدينة محل الترخيص، وتقديم تأمين ساري المفعول يغطي مخاطر النشاط، مع الالتزام بتوثيق جميع عمليات الفحص والإصلاح وفق النماذج المعتمدة من الهيئة.
وتمنح الهيئة الترخيص لمدة ثلاث سنوات قابلة للتجديد، بعد سداد الرسوم والغرامات المستحقة.
وتحتفظ الهيئة بحق إلغاء الترخيص في حالات محددة، منها تقديم بيانات غير صحيحة أو تزوير مستندات الترخيص، أو إفلاس المنشأة، أو التنازل عن الترخيص دون موافقة مسبقة، أو الإخلال بالشروط الفنية والإدارية لمدة تتجاوز 15 يوماً دون تصحيح.
وسمحت اللائحة للسفن السعودية، بالاستعانة بالمنشآت الأجنبية خارج المملكة في أعمال الصيانة والفحص بشرط أن تكون معتمدة من هيئات تصنيف دولية ومن الشركات المصنعة لمعدات وأجهزة الإنقاذ البحرية.
وتحظر اللائحة استخدام قطع غيار غير أصلية، وتلزم المنشآت بالمحافظة على معايرة أدوات القياس والفحص بشكل دوري، وتوثيق كافة العمليات التشغيلية بدقة، وعدم تغيير مقر النشاط دون الحصول على موافقة مسبقة.
ونصّت اللائحة على فرض غرامة قدرها خمسة آلاف ريال على المنشآت التي تمارس النشاط دون الحصول على ترخيص أو من خلال فرع غير مرخص له، كما تُفرض الغرامة نفسها على من يزاول النشاط بعد انتهاء الترخيص دون تجديده، وعلى من يغيّر مقر النشاط دون موافقة مسبقة من الهيئة.
وألزمت اللائحة المنشآت بالحصول على موافقة رسمية قبل تعديل الكيان القانوني أو التنازل عن الترخيص، وفي حال مخالفة ذلك تُفرض غرامة مقدارها خمسة آلاف ريال، إضافة إلى غرامة مماثلة على من يمارس النشاط قبل نقل الترخيص رسمياً إلى المتنازل إليه.
المخالفات الجسيمة
دّدت الهيئة العامة للنقل، على ضرورة تشغيل فنيين حاصلين على بطاقات اعتماد من الهيئة، إذ يعاقب المخالف بغرامة خمسة آلاف ريال عن كل عامل غير معتمد، كما تُفرض الغرامة نفسها على من لا يلتزم بمتطلبات ومعايير نظام الجودة أو لا ينفذ الالتزامات النظامية المنصوص عليها في المادة «13» من اللائحة.
وفي جانب المخالفات الجسيمة، مثل تعطيل أو إعاقة عمل مراقبي الخدمة أو خبراء هيئات التصنيف المفوضة، تصل عقوبتها إلى عشرة آلاف ريال، كما تُفرض غرامة مماثلة على السفن السعودية التي تستعين بمنشآت أجنبية مخالفة لمتطلبات اللائحة.
The General Transport Authority has proposed a draft regulation for the inspection, maintenance, repair, and re-approval of marine rescue equipment and devices for consultation in preparation for its adoption. The new regulation aims to organize the licensing mechanism and monitor the performance of establishments specialized in marine maintenance and inspection, in line with the international standards set by the International Maritime Organization (IMO) and the International Convention for the Safety of Life at Sea (SOLAS), to ensure the readiness of all rescue equipment on ships flying the flag of the Kingdom, establish clear controls for issuing, renewing, and canceling licenses, and define the technical and administrative requirements necessary to ensure quality work and safety performance.
The provisions of the regulation apply to Saudi ships subject to the provisions of Chapter Three of international maritime agreements, and to establishments operating within the Kingdom, whether they are national or foreign and accredited by international classification bodies.
The regulation specifies a set of basic conditions for obtaining a license, the most prominent of which is employing technicians certified by the manufacturers of the equipment or by licensed establishments authorized to conduct the activity, and providing specialized technical equipment in accordance with the manufacturers' instructions and in line with the operational requirements on board ships.
The regulation requires establishments to provide a main office in the city of licensing, and to present valid insurance covering the risks of the activity, while committing to document all inspection and repair operations according to the models approved by the authority.
The authority grants the license for a period of three years, renewable after the payment of due fees and fines.
The authority reserves the right to revoke the license in specific cases, including providing incorrect data or forging licensing documents, bankruptcy of the establishment, transferring the license without prior approval, or violating technical and administrative conditions for more than 15 days without correction.
The regulation allows Saudi ships to utilize foreign establishments outside the Kingdom for maintenance and inspection work, provided they are accredited by international classification bodies and by manufacturers of marine rescue equipment and devices.
The regulation prohibits the use of non-original spare parts and requires establishments to maintain the calibration of measuring and inspection tools periodically, accurately document all operational processes, and not change the location of the activity without obtaining prior approval.
The regulation stipulates a fine of five thousand riyals for establishments that conduct activities without obtaining a license or through an unlicensed branch, as the same fine is imposed on those who continue the activity after the license has expired without renewal, and on those who change the location of the activity without prior approval from the authority.
The regulation obliges establishments to obtain official approval before modifying the legal entity or transferring the license, and in case of violation, a fine of five thousand riyals is imposed, in addition to a similar fine on anyone who conducts the activity before the license is officially transferred to the transferee.
Serious Violations
The General Transport Authority emphasized the necessity of employing technicians who hold accreditation cards from the authority, as violators are penalized with a fine of five thousand riyals for each unaccredited worker, and the same fine is imposed on those who do not comply with the requirements and standards of the quality system or do not fulfill the regulatory obligations stipulated in Article "13" of the regulation.
Regarding serious violations, such as obstructing or hindering the work of service inspectors or experts from the authorized classification bodies, the penalty can reach ten thousand riyals, and a similar fine is imposed on Saudi ships that utilize foreign establishments that violate the requirements of the regulation.
