رصدت الهيئة العامة للعقار عددًا من المخالفات المرتبطة بممارسة نشاط البيع على الخارطة دون ترخيص، وذلك في كلٍ من مدينة الرياض وجدة ومكة المكرمة، في إطار جهودها الرقابية المكثفة لحوكمة السوق العقارية وحماية حقوق المتعاملين فيه.
وأوضحت الهيئة أن فرقها الرقابية رصدت قيام 25 مطورًا عقاريًا بمزاولة نشاط بيع وحدات عقارية على الخارطة واستلام مبالغ مالية من المشترين دون الحصول على التراخيص النظامية المعتمدة، في مخالفة صريحة لأحكام نظام بيع وتأجير مشروعات عقارية على الخارطة ولائحته التنفيذية.
وبيّنت «هيئة العقار» أنه جارٍ استكمال الإجراءات النظامية بحق المخالفين، التي تشمل تطبيق العقوبات المنصوص عليها نظامًا، بما فيها الإحالة إلى النيابة العامة، مؤكدةً أنها لن تتهاون مع أي ممارسات غير نظامية تمس موثوقية السوق العقارية أو تؤثر في سلامة التعاملات العقارية وحقوق المستفيدين والمتعاملين.
وأكدت الهيئة استمرارها في تنفيذ أعمال الرقابة الميدانية والإلكترونية، ورصد جميع الإعلانات والممارسات العقارية المخالفة، بالتكامل مع الجهات ذات العلاقة، لضمان الامتثال الكامل للأنظمة والتشريعات، وتعزيز مبادئ الشفافية والحوكمة في القطاع العقاري.
ودعت الهيئة العامة للعقار المطورين العقاريين إلى الالتزام التام بالأنظمة واللوائح المنظمة لنشاط بيع وتأجير مشروعات عقارية على الخارطة، والحصول على التراخيص النظامية قبل الإعلان أو التسويق أو البيع واستلام الأموال، حاثة المتعاملين والمستثمرين على التحقق من نظامية تراخيص المشروعات العقارية عبر القنوات الرسمية المعتمدة قبل الشروع في أي عملية شراء أو تحويل الأموال، والإبلاغ عن أي مخالفات، تؤثر في السوق العقارية وموثوقيتها.
The General Authority for Real Estate has detected a number of violations related to the practice of selling off-plan properties without a license, in both Riyadh and Jeddah and Mecca, as part of its intensive regulatory efforts to govern the real estate market and protect the rights of its participants.
The authority clarified that its monitoring teams observed 25 real estate developers engaging in the sale of off-plan property units and receiving financial amounts from buyers without obtaining the approved legal licenses, in clear violation of the provisions of the Off-Plan Real Estate Sale and Lease System and its executive regulations.
The "Real Estate Authority" indicated that legal procedures against the violators are underway, which include applying the penalties stipulated by law, including referral to the Public Prosecution, emphasizing that it will not tolerate any illegal practices that affect the reliability of the real estate market or impact the integrity of real estate transactions and the rights of beneficiaries and participants.
The authority confirmed its continued implementation of field and electronic monitoring activities, tracking all advertisements and violating real estate practices, in collaboration with relevant authorities, to ensure full compliance with regulations and legislation, and to enhance the principles of transparency and governance in the real estate sector.
The General Authority for Real Estate urged real estate developers to fully comply with the regulations and laws governing the sale and lease of off-plan real estate projects, and to obtain the necessary legal licenses before advertising, marketing, selling, or receiving funds, encouraging participants and investors to verify the legality of real estate project licenses through the approved official channels before proceeding with any purchase or money transfer, and to report any violations that affect the real estate market and its reliability.
