كشفت هيئة السوق المالية أنها بدأت في إيداع مبالغ التعويضات في حسابات المتضررين من مخالفات تداول سهم «دار الأركان» التي أُعلن عنها في شهر يوليو 2023.
وأشارت الهيئة إلى أنها أدانت حينها 17 مستثمراً بمخالفة نظام السوق المالية ولوائحه التنفيذية وغرمتهم 6 ملايين ريال، وألزمتهم وخمسة مستثمرين آخرين بدفع 1.196 مليار ريال، بسبب المكاسب غير المشروعة التي تحققت لهم بسبب مخالفاتهم التي ارتكبوها خلال تداولهم على سهم شركة «دار الأركان»، وفقا لـ«الشرق بلومبيرغ».
وأوضحت الهيئة أن إيداع المبالغ يتم خلال صندوق التعويض الذي أنشئ لهذه القضية، بموجب صلاحيتها بإجراءات تعويض الأشخاص المتضررين نتيجة المخالفات المرتكبة، ومدى ملاءمة إنشاء صناديق متخصصة للتعويض يكون موردها من المكاسب غير المشروعة المحصّلة، إذ اعتمدت الهيئة على السجلات التقنية لتحديد المستفيدين من الصندوق ممن ثبت تعرضهم للضرر جراء تلك المخالفات، وهو ما اعتمدت عليه في خطة التوزيع التي اقترحها مجلس الهيئة واعتمدتها لجنة الفصل في منازعات الأوراق المالية.
ودعت الهيئة المتضررين الذين يرون وقوع الضرر عليهم ولم تشملهم خطة التوزيع التقدم بدعوى فردية إلى لجنة الفصل في منازعات الأوراق المالية للمطالبة بالتعويض، على أن يسبق ذلك تقديم شكوى إلى الهيئة من خلال موقع الهيئة الإلكتروني.

The Capital Market Authority revealed that it has begun depositing compensation amounts into the accounts of those affected by the violations related to the trading of "Dar Al Arkan" shares, which were announced in July 2023.
The authority indicated that it had previously convicted 17 investors for violating the Capital Market Law and its executive regulations, imposing fines totaling 6 million riyals, and obligated them along with five other investors to pay 1.196 billion riyals due to the illegal gains they achieved as a result of the violations committed during their trading of "Dar Al Arkan" shares, according to "Asharq Bloomberg".
The authority clarified that the deposit of amounts is being carried out through the compensation fund established for this case, under its authority to implement compensation procedures for individuals harmed due to the committed violations, and the appropriateness of establishing specialized compensation funds sourced from the illegal gains obtained. The authority relied on technical records to identify the beneficiaries of the fund who were proven to have suffered damage due to those violations, which was the basis for the distribution plan proposed by the authority's board and approved by the committee for settling securities disputes.
The authority urged affected individuals who believe they have suffered damage and were not included in the distribution plan to file an individual claim with the committee for settling securities disputes to seek compensation, provided that this is preceded by submitting a complaint to the authority through its official website.
