أعلن مركز التحكيم الرياضي السعودي نشر التعديلات الجديدة على نظامه الأساسي عبر موقعه الإلكتروني الرسمي، وذلك بعد اعتمادها من الجمعية العمومية للجنة الأولمبية والبارالمبية السعودية، خلال اجتماعها التاسع والعشرين المنعقد في السادس من مايو 2026م، بناءً على مقترح مقدم من مجلس إدارة المركز.
وشملت التعديلات تحديث الفقرة الأولى من المادة الثامنة المتعلقة باختصاصات المركز، حيث جرى تعديل البند (أ)، إلى جانب إضافة بند جديد (ب) يمنح المركز اختصاص النظر في المنازعات المالية الناشئة عن عقود الرعاية والاستثمار الرياضي وحقوق البث التلفزيوني والإذاعي وتنظيم الفعاليات الرياضية وغيرها، شريطة أن يكون أحد أطراف النزاع من أعضاء المنظومة الرياضية، وأن يتضمن العقد أو أي اتفاق لاحق مكتوب نصاً صريحاً يقضي باللجوء إلى التحكيم عبر المركز.
كما تضمنت التعديلات المادة التاسعة عشرة الخاصة بغرفة التحكيم العادي، بإضافة شرط يقضي بضرورة وجود اتفاق مكتوب بين أطراف النزاع يتضمن اللجوء إلى التحكيم من خلال المركز، سواء كان ذلك ضمن العقد الأصلي أو بموجب اتفاق لاحق.
وأكد رئيس مجلس إدارة مركز التحكيم الرياضي السعودي الدكتور محمد باصّم، أن هذه التعديلات تأتي ضمن جهود المركز المستمرة لتطوير الإطار النظامي والإجرائي المنظم للفصل في المنازعات الرياضية والمنازعات المرتبطة بالقطاع الرياضي، بما ينسجم مع النمو المتسارع الذي يشهده مجال الرعاية والاستثمار الرياضي في المملكة.
وأوضح أن التعديلات تسهم في تعزيز وضوح اختصاص المركز في المنازعات المالية ذات الصلة بالرياضة، من خلال التأكيد على أهمية وجود اتفاق تحكيم مكتوب، الأمر الذي يدعم سلامة الأساس النظامي لاختصاص المركز ويعزز قابلية تنفيذ أحكامه، بما ينعكس إيجاباً على استقرار البيئة الاستثمارية والعدلية في القطاع الرياضي.
وأشار المركز إلى أن نشر هذه التعديلات يأتي استناداً إلى المادة السابعة والأربعين من نظامه الأساسي، التي تنص على نشر أي تعديل على الموقع الإلكتروني للمركز خلال مدة لا تتجاوز سبعة أيام من تاريخ إبلاغه بالموافقة عليه، على أن يبدأ العمل بالتعديلات اعتباراً من اليوم التالي لتاريخ النشر.
The Saudi Sports Arbitration Center announced the publication of the new amendments to its bylaws on its official website, following their approval by the General Assembly of the Saudi Olympic and Paralympic Committee during its twenty-ninth meeting held on May 6, 2026, based on a proposal submitted by the Center's Board of Directors.
The amendments included an update to the first paragraph of Article Eight regarding the Center's competencies, where item (A) was modified, along with the addition of a new item (B) granting the Center the authority to consider financial disputes arising from sponsorship and sports investment contracts, broadcasting rights, and the organization of sports events, provided that one of the parties to the dispute is a member of the sports system, and that the contract or any subsequent written agreement explicitly states the referral to arbitration through the Center.
The amendments also included Article Nineteen concerning the ordinary arbitration chamber, by adding a condition that requires a written agreement between the parties to the dispute that includes referral to arbitration through the Center, whether within the original contract or by virtue of a subsequent agreement.
Dr. Mohammed Bassam, Chairman of the Board of Directors of the Saudi Sports Arbitration Center, confirmed that these amendments are part of the Center's ongoing efforts to develop the regulatory and procedural framework governing the resolution of sports disputes and disputes related to the sports sector, in line with the rapid growth witnessed in the field of sports sponsorship and investment in the Kingdom.
He explained that the amendments contribute to enhancing the clarity of the Center's jurisdiction in financial disputes related to sports, by emphasizing the importance of having a written arbitration agreement, which supports the integrity of the regulatory basis for the Center's jurisdiction and enhances the enforceability of its rulings, positively reflecting on the stability of the investment and judicial environment in the sports sector.
The Center indicated that the publication of these amendments is based on Article Forty-Seven of its bylaws, which stipulates the publication of any amendment on the Center's website within a period not exceeding seven days from the date of notification of its approval, with the amendments taking effect from the day following the date of publication.
