فيما تتصاعد أزمة تجنيد المتشددين الحريديم، استدعت الحكومة الإسرائيلية اليوم (الإثنين) 450 ألف جندي احتياط في قرار يُعد الأكبر من نوعه منذ اندلاع الحرب في 7 أكتوبر 2023.
وعزا الرأي القانوني أسباب الاستدعاء إلى صعوبة قانونية كبيرة في تمديد أوامر التجنيد الطارئة (أمر 8) نظراً لتقاعس الحكومة عن اتخاذ خطوات كافية لزيادة تجنيد الشبان من المجتمع الحريديم، ويلزم الأمر جنود الاحتياط بالحضور الفوري للخدمة دون تأجيل أو اعتراض.
وذكرت هيئة البث الإسرائيلية أن هذا الأمر من أعلى درجات التعبئة العسكرية، ويُستخدم لرفع الجاهزية، مع أن التكلفة اليومية لكل جندي احتياط تبلغ نحو 1000 شيكل يدفعها دافعو الضرائب.
وشددت المستشارة القضائية للحكومة، غالي بهراف ميارا على أن «النقاش حول الحرب يستوجب أيضاً نقاشاً حول المساواة في تحمّل العبء، في الواقع، لا يسود شعور بالمساواة، وهذا يمس بشكل خطير بالإحساس العام بالعدالة»، مبينة ان جيش الاحتلال أوضح احتياجاته، والجهات المهنية شددت على أن كل جندي نظامي يعادل عدة جنود احتياط من حيث العبء.
وأشارت إلى أن قانون الخدمة العسكرية يلزم بالتجنيد الموحد والمتساوي، وهذا هو الوضع القانوني. في المقابل، فإن قانون التجنيد الجديد لم يصدر بعد، وهو لا يُعتبر خطة عمل ولا يعفي أحداً من واجب الخدمة، مبينة أن التحديات القانونية تتطلب اتخاذ ثلاث خطوات وهي زيادة أوامر التجنيد، وتفعيل أدوات إنفاذ القانون ضد المتخلفين، وتوسيع نطاق العقوبات عليهم.
ولفتت إلى أن هذه الإجراءات يمكن أن تتم بقرار حكومي دون الحاجة لتشريع جديد، مشيرة إلى أن الأمر بيد الوزراء، لكنها انتقدت فشل الحكومة في دفع هذا الملف إلى الأمام، وقالت «هذا الفشل لا يتماشى مع احتياجات الجيش ولا مع الحق الدستوري في المساواة، نحن مستعدون للتعاون الكامل مع الحكومة بهذا الشأن».
من جهتها، طالبت رئيسة مؤسسة ورئيسة حركة «أمهات في الخط الأمامي» المحامية أيلت هشاحر سيدوف بقرار يوقف حرب نتنياهو، التي تخدم حكومة سياسية مشبعة بالمتهربين من الخدمة، وتكافئ المتهربين وتخون الجنود، موضحة أن حكومة نتيناهو ليست جديرة بالشعب ولا بالجيش.
بدوره، اتهم رئيس «الحزب الديمقراطي» الإسرائيلي يائير غولان رئيس الوزراء الإسرائيلي بنيامين نتنياهو بأنه يشتري السلطة بالمال بينما يدفع الجنود والرهائن الثمن بدمائهم، مؤكداً أن حرب غزة سياسية هدفها توفير مزيد من الوقت لنتنياهو.
وأشار إلى أن أموال الدولة الإسرائيلية تعطى للمتهربين من القتال بينما يموت الجنود.

As the crisis of recruiting ultra-Orthodox extremists escalates, the Israeli government today (Monday) called up 450,000 reservists in a decision considered the largest of its kind since the outbreak of the war on October 7, 2023.
The legal opinion attributed the reasons for the call-up to significant legal difficulties in extending emergency recruitment orders (Order 8) due to the government's failure to take sufficient steps to increase the enlistment of young people from the Haredi community, requiring reservists to report for service immediately without delay or objection.
The Israeli Broadcasting Authority reported that this order represents one of the highest levels of military mobilization, used to enhance readiness, although the daily cost for each reservist is about 1,000 shekels paid by taxpayers.
The government’s legal advisor, Gali Baharav-Miara, emphasized that "the discussion about the war also necessitates a discussion about equality in bearing the burden; in reality, there is no sense of equality, and this severely affects the general sense of justice," indicating that the occupation army clarified its needs, and professional entities stressed that each regular soldier is equivalent to several reservists in terms of burden.
She pointed out that the military service law mandates uniform and equal conscription, which is the legal situation. In contrast, the new recruitment law has not yet been issued, and it is not considered a plan of action nor does it exempt anyone from the duty of service, noting that the legal challenges require taking three steps: increasing recruitment orders, activating law enforcement tools against defaulters, and expanding the scope of penalties against them.
She noted that these measures can be taken by a government decision without the need for new legislation, pointing out that the matter is in the hands of the ministers, but she criticized the government's failure to advance this file, stating, "This failure does not align with the needs of the army nor with the constitutional right to equality; we are ready for full cooperation with the government in this regard."
For her part, the head of the organization and leader of the "Mothers on the Frontline" movement, lawyer Eilat Heshachar Sidof, called for a decision to stop Netanyahu's war, which serves a political government saturated with service evaders, rewarding the evaders and betraying the soldiers, clarifying that Netanyahu's government is unworthy of the people or the army.
In turn, the head of the Israeli "Democratic Party," Yair Golan, accused Israeli Prime Minister Benjamin Netanyahu of buying power with money while soldiers and hostages pay the price with their blood, asserting that the Gaza war is political, aimed at buying more time for Netanyahu.
He pointed out that Israeli state funds are given to those evading combat while soldiers are dying.
