شدّد نظام المرافعات أمام ديوان المظالم على أن الالتزام بالمهل النظامية شرط أساس لسماع الدعاوى الإدارية وضمان حفظ الحقوق، إذ نصت الفقرات ذات الصلة على أن عدم استيفاء صحيفة الدعوى خلال المدة المحددة يعد الطلب كأن لم يكن، وأن التظلّم أمام وزارة الموارد أو الجهة المختصة يُعد وجوبياً قبل رفع الدعوى، على أن يكون القرار الصادر برفض التظلّم مسبباً، أو تُعتبر المهلة منقضية بعد مرور 90 يوماً دون البت فيه.
تنفيذ القرار خلال 90 يوماً
وأكد النظام أن الجهة الإدارية ملزمة بتنفيذ القرارات الصادرة خلال 90 يوماً من تاريخ العلم بها، وإلا جاز للمدعي رفع الدعوى إلى المحكمة المختصة ضمن المهلة المحددة. وأشار النظام إلى أن سقوط الحق في سماع الدعاوى يتحقق بانقضاء المدد المنصوص عليها في المادة الـ13، باستثناء ما ورد به نص خاص أو في حال إقرار المدعى عليه بالحق أو وجود عذر شرعي تقبله المحكمة.
احتساب المهل
وتبدأ احتساب المهل من اليوم التالي للتبليغ الرسمي، وتمتد تلقائياً إذا صادف آخرها عطلة رسمية حتى أول يوم عمل يليها، بما يضمن وضوح الإجراءات وحماية المراكز القانونية للأطراف.

The relevant paragraphs stipulated that failure to submit the statement of claim within the specified period renders the request as if it never existed, and that appealing to the Ministry of Resources or the competent authority is mandatory before filing the lawsuit, provided that the decision issued to reject the appeal is substantiated, or the deadline is considered expired after 90 days without a decision being made.
Implementation of the decision within 90 days
The system confirmed that the administrative authority is obliged to implement the decisions issued within 90 days from the date of being informed of them; otherwise, the plaintiff may file a lawsuit with the competent court within the specified timeframe. The system indicated that the right to hear lawsuits is forfeited upon the expiration of the periods stipulated in Article 13, except in cases where there is a specific provision or if the defendant acknowledges the right or if there is a legitimate excuse accepted by the court.
