فيما أعلن ديوان المظالم، ممثلاً في إدارة تصنيف الأحكام بمكتب الشؤون الفنية، إصدار مجموعة الأحكام الإدارية لعام 1444هـ، عبر بوابته الرقمية، اطلعت «عكاظ»، على نماذج من الأحكام الصادرة في الموسوعة، التي جاءت في مجلدين اثنين تضمنت أحكاما إدارية شملت عدداً من الوزارات والهيئات والجهات الحكومية بينها أحكام في التعويضات والتراخيص والغرامات ونزع الملكيات والعقود والتأديب والمنازعات الإدارية والطلبات القضائية وأتعاب المحاماة.وتضمّنت الأحكام قضايا خدمة مدنية وعسكرية وتقاعد وجامعات وتعليم وصحة وأحوال مدنية وقرارات إدارية وتخطيط عمراني وقضايا حج وعمرة.وكشف ديوان المظالم، أن إصدار مجموعة الأحكام الإدارية للعام 1444هـ، يأتي ضمن جهوده لإثراء المكتبة القضائية والقانونية، إذ ضمّت المجموعة ما تم اعتماده وتصنيفه من الأحكام الصادرة عن دوائر الاستئناف في محاكم القضاء الإداري بمختلف المناطق باختلاف تصنيفاتها ووقائعها وما صدر بشأنها من أحكام.وأوضح ديوان المظالم، أنه يتيح من خلال بوابته الرقمية ومدوناته القضائية، لكافة كوادره القضائية والمهتمين بالشأن القانوني، الاطلاع على مبادئه وأحكامه القضائية بلغات عدة (العربية، والإنجليزية، والفرنسية، والصينية)، في إطار هدفه نشر الوعي بطبيعة القضاء الإداري، وتعزيز المعرفة بأنظمته وأحكامه، وإثراء المكتبة القضائية والقانونية في المملكة، بوصفه أحد الأهداف الإستراتيجية للديوان في خدمة القضاء الإداري ومجتمعه المعرفي محلياً ودولياً. وأكد ديوان المظالم، أنه ينشر عبر بوابته الرقمية عدداً من المدونات القضائية التي توثق نتاج العمل القضائي في محاكمه الإدارية والمحكمة الإدارية العليا، وتشمل ما يُصنّف من الأحكام كمبادئ قضائية إدارية، ويخصص لهذا العمل إدارة تُعنى بتصنيف الأحكام وتدوينها؛ لتكون مرجعاً قانونياً ثرياً، ومصدراً موثوقاً لدعم المعرفة القضائية وتطوير نُظم التقاضي وإجراءاته. وبحسب رصد «عكاظ» للأحكام، اطلعت على مجموعة من الأحكام الإدارية المنشورة على البوابة الإلكترونية ضمن المدونات القضائية لديوان المظالم.سيارة لوكيل الجامعةفي دعاوى الحقوق الوظيفية لأعضاء هيئة التدريس، أيدت محكمة الاستئناف الإداري حكماً صدر بإلزام جامعة سعودية بأن تصرف سيارة لوكيل الجامعة عقب تقديمه دعوى أمام المحكمة الإدارية للمطالبة بتأمين سيارة له جراء تكليفه وكيلاً للجامعة على المرتبة الخامسة عشرة، وفقاً للمادة 44 من لائحة الحقوق والمزايا المالية.393 ألفاً لطبيب مبتعثفي موضوع البدلات والمستحقات الوظيفية صادقت محكمة الاستئناف الإداري على حكم صدر بإلزام الشؤون الصحية في إحدى المناطق بصرف فروقات الراتب أثناء ابتعاث طبيب سعودي للتدريب مدة سنة في كوريا وقيمة تذاكر السفر ذهاباً وإياباً وبدل الانتداب لمدة 30 يوماً، بعد أن تقدّم الطبيب بدعواه للمطالبة بصرف 393 ألف ريال، أفاد فيها أنه جرى ابتعاثه لمدة عام، ولم يصرف له راتبه مع البدلات خلال مدة الابتعاث كما هو منصوص في لائحة الابتعاث للتدريب، واستندت المحكمة في حكمها إلى مواد من اللائحة التنفيذية للموارد البشرية في الخدمة المدنية.10 آلاف لعضو تضرّر من «هيئة الأمر»ألزمت محكمة الاستئناف الإداري فرع هيئة الأمر بالمعروف والنهي عن المنكر بإحدى المناطق، بأن يصرف 10 آلاف ريال لأحد منسوبيه على سبيل التعويض عما أصابه من أضرار مادية ومعنوية؛ وحسماً للنزاع في جميع ما يطلبه، وذكرت المحكمة أن المدعي تضرّر وتحمّل في سبيل الحصول على التعويض عن إصابة العمل العناء النفسي، وأن الضرر متحقق، وأن البحث عن أدلة إثبات الأمور التي تحتاج إلى إثبات سيؤدي إلى مزيد من النظر القضائي وليس ثمة أدلة مادية ظاهرة يمكن الركون إليها في ذلك، ومحكمة الاستئناف وفي نطاق دورها الإيجابي وبصفتها الخبير الأول في الدعوى، ومنعاً لاستطالة التقاضي لوجود دعاوى للمدعي نظرتها المحاكم الإدارية رأت أن تقدير التعويض متروك للمحكمة المناط بها الحكم في الدعوى بحسب سلطة القاضي التقديرية وبما استقر عليه الفقه وأحكام القضاء ما دام تقديرها عادلاً.علاج مريض بالخارج على نفقة الدولةأيدت محكمة الاستئناف الإداري، الحكم الصادر بإلغاء قرار الهيئة الطبية العليا القاضي بالاعتذار عن علاج مواطن مريض خارج المملكة واستمرار علاجه في مستشفى حكومي، ما يعني إلزام تسفيره وعلاجه بالخارج استناداً إلى المادة 31 من النظام الأساسي، وكان المواطن تقدم بطلب علاج ابنه من مرض التصلب الحدبي وهو اضطراب جيني نادر يصيب الجسم بأورام متعددة في المخ وتشنجات مستمرة وإعاقة عقلية دائمة، ولا يوجد علاج في المملكة، وصدرت توصيات طبية لعلاجه في أمريكا على نفقة الدولة.مغادرة طبيب يكلف «الصحة» 1,140,000 ريالأيدت محكمة الاستئناف حكماً بإلزام وزارة الصحة – المديرية العامة للشؤون الصحية في إحدى المناطق بدفع 1,140,000 ريال لصالح مدعين تعويضاً لدية المنافع المفقودة لمورثهم والمقدرة من الهيئة الصحية الشرعية لسماح المستشفى بسفر الطبيب المعالج خارج المملكة قبل انتهاء الدعوى المقامة ضده وبالمخالفة لقرار الهيئة بمنع الطبيب من السفر وثبوت تضرر المدعين من خطأ المدعى عليها بفوات دية المنافع المفقودة لمورثهم والمقدرة من الهيئة الصحية الشرعية، وقررت المحكمة عدم قبول دفع المدعى أو غير مباشر وسواءً كانت دعاوى مطالبات حقوق أو إلغاء قرارات إدارية وغيرها، وهو قضاء إداري مستقل، يرتبط بالملك مباشرة وله مجلس قضاء إداري ومحكمة إدارية عليا لها مبادئها القضائية، وقراراتها وأحكامها ملزمة على كافة الكيانات والأشخاص. ودشن أخيراً محكمة التنفيذ الإدارية، وهي باكورة مقار نظام التنفيذ أمام ديوان المظالم، إذ يُعنى وتُعنى محكمته وكافة دوائرها بضمانات التنفيذ في القضاء الإداري ضد الجهات الحكومية ولصالحها والفصل في نزاعات تنفيذ الأحكام والقرارات والسندات الإدارية.من جانبها، قالت المحامية بشائر العظمة لـ«عكاظ»: إن نظام التنفيذ الإداري شدد في مواده على معاقبة الموظف العام إذا استغل سلطته الوظيفية في منع تنفيذ السند المطلوب تنفيذه جزئياً أو كلياً بقصد تعطيل تنفيذه بحيث يعاقب بالسجن مدة لا تزيد على سبع سنوات وبغرامة لا تزيد على 700 ألف ريال أو بإحدى هاتين العقوبتين.، كما يعاقب الموظف إذا امتنع عمداً عن تنفيذ السند المطلوب تنفيذه جزئياً أو كلياً بقصد تعطيل تنفيذه، وذلك بعد مضي 8 أيام من تبليغه بالإنذار المنصوص عليه نظاماً أو وصول إجراءات التنفيذ التالية للإنذار إليه وكان التنفيذ من اختصاصه بحيث يعاقب بالسجن 5 سنوات وبغرامة لا تزيد على 500 ألف ريال أو بإحدى هاتين العقوبتين. وقرر النظام معاقبة كل من اشترك في الامتناع عن تنفيذ السند أو تعطيله بالعقوبة ذاتها، وللمحكمة تضمين الحكم الصادر النص على نشر ملخصه على نفقة المحكوم عليه في صحيفة محلية عقب اكتساب الحكم القطعية. وعد النظام الامتناع أو تعطيل أو تنفيذ الأحكام الإدارية من جرائم الفساد والجرائم الكبيرة الموجبة للتوقيف.إلزام تعليم الجوف بنقل معلمةقررت محكمة الاستئناف الإداري، إلغاء قرار إدارة تعليم الجوف بعدم قبول طلب نقل معلمة من محافظة طبرجل إلى سكاكا بسبب ظروفها الصحية التي تستوجب وجود مركز صحي متخصص لمتابعة وعلاج حالتها، إذ تعاني من حالة مرضية مزمنة وتورم سريع للجلد بموجب تقارير طبية ما يعني إلزام إدارة التعليم باستكمال إجراءات نقلها.تعويض نحال 55 ألفاًأيدت محكمة الاستئناف، حكماً قضى بإلزام وزارة البيئة بأن تدفع لمواطن يعمل نحالاً مبلغاً وقدره 55 ألف ريال تعويضاً له عقب ثبوت تضرر المنحل جراء رش مبيدات حشرية بالقرب منه، وتضمن النظام وجوب الإعلان عن عملية رش المبيدات قبل أسبوع من العملية والتزام النحالين بمراجعة الإدارات المختصة لمعرفة فترات رش المبيدات وأخذ الاحتياطات اللازمة لحماية المنحل، وخلصت المحكمة إلى استحقاق النحال المدعي للتعويض عن نصف قيمة الخلايا المتضررة وفق تقدير الخبير وعدم أحقيته عن التعويض عن تكاثر النحل لثبوت تقصيره وعدم وجود ترخيص لديه، وكان النحال طالب في دعواه تعويضه بمبلغ 750 ألف ريال بسبب فرقة مكافحة الجراد التابعة لوزارة البيئة التي قامت بالرش دون سابق إعلان أو إنذار ما تسبب في الضرر لمنحل والنحل، وتضرر 110 مناحل، والقضاء على النحل والعسل الصافي وإفساد 770 كيلو من العسل بحسب دعواه.إلغاء حسم 5 أيام وإعادة طالبصدر حكم نهائي بإلغاء قرار بمعاقبة موظف بالحسم 5 أيام من راتبه لثبوت سلامة موقفه من فقد معاملة عقب انتقاله من قسم إلى آخر في مقر عمله.كما أيدت محكمة الاستئناف، حكماً بوقف تنفيذ قرار إيقاف طالب هندسة عن الدراسة بإحدى الجامعات لمدة عام قراراً مشمولاً بالنفاذ المعجل.رد مؤخر أتعاب محاماةأيدت محكمة الاستئناف الإدارية حكماً برد مؤخر أتعاب مكتب محاماة بمبلغ 3 ملايين ريال لصدور قرار المحكمة بعدم جواز نظر الدعوى لسبق الفصل فيها ما يعني عدم استحقاق مكتب المحاماة لمؤخر الأتعاب المسلمة له، وطالبت الشركة المدعية في دعواها برد أتعاب محاماة سبق سدادها مؤخر أتعاب دون وجه حق عن دعوى نظرتها المحكمة الإدارية، في حين رد مكتب المحاماة أنه أبرم عقداً بمسمى (اتفاقية خدمات قانونية) عام 1430هـ، لتقديم خدمات واستشارات، وترافع وبموجبها، وتم تكلف المحامي للقيام بالاعتراض على رسوم حكومية ضد وزارة الاتصالات وتقنية المعلومات، وخلصت المحكمة إلى الفصل في الدعوى استناداً إلى مواد من نظام المحاماة وألزمت مكتب المحاماة بـ 3 ملايين ريال حكماً نهائياً.

"Okaz" reviewed samples of the judgments issued in the encyclopedia, which came in two volumes and included administrative rulings covering several ministries, authorities, and government entities, including rulings on compensations, licenses, fines, expropriations, contracts, disciplinary actions, administrative disputes, judicial requests, and attorney fees.
The rulings included cases related to civil and military service, retirement, universities, education, health, civil status, administrative decisions, urban planning, and cases of Hajj and Umrah.
The Board of Grievances revealed that the issuance of the Administrative Judgments Collection for the year 1444 AH is part of its efforts to enrich the judicial and legal library, as the collection included what has been approved and classified from the judgments issued by the appellate circuits in the administrative courts across various regions, differing in classifications and facts, along with the rulings issued regarding them.
The Board of Grievances clarified that it provides, through its digital portal and judicial blogs, all its judicial staff and those interested in legal matters, access to its principles and judicial rulings in several languages (Arabic, English, French, and Chinese), as part of its goal to raise awareness of the nature of administrative justice, enhance knowledge of its systems and rulings, and enrich the judicial and legal library in the Kingdom, as one of the strategic objectives of the Board in serving administrative justice and its knowledge community both locally and internationally. The Board of Grievances confirmed that it publishes through its digital portal a number of judicial blogs that document the outcomes of judicial work in its administrative courts and the Supreme Administrative Court, including what is classified as administrative judicial principles. A dedicated administration is responsible for classifying and documenting the rulings to serve as a rich legal reference and a reliable source to support judicial knowledge and develop litigation systems and procedures. According to "Okaz's" monitoring of the rulings, it reviewed a collection of administrative rulings published on the electronic portal within the judicial blogs of the Board of Grievances.

In cases concerning the employment rights of faculty members, the Administrative Appellate Court upheld a ruling obligating a Saudi university to provide a car for the university vice president after he filed a lawsuit before the administrative court demanding a vehicle due to his appointment as vice president at the fifteenth rank, in accordance with Article 44 of the Financial Rights and Benefits Regulation.

Regarding allowances and employment entitlements, the Administrative Appellate Court ratified a ruling obligating the health affairs in one of the regions to pay the salary differences during the training of a Saudi doctor for one year in Korea, along with the cost of round-trip travel tickets and a travel allowance for 30 days, after the doctor filed a lawsuit demanding 393,000 riyals, stating that he was sent abroad for a year without receiving his salary and allowances during the training period as stipulated in the expatriation regulation. The court based its ruling on articles from the executive regulation of human resources in the civil service.
10 Thousand for a Member Harmed by the "Commission"
The Administrative Appellate Court obligated a branch of the Commission for the Promotion of Virtue and Prevention of Vice in one of the regions to pay 10,000 riyals to one of its members as compensation for the material and moral damages he suffered; and to settle the dispute regarding all his claims. The court noted that the plaintiff suffered and endured psychological distress in seeking compensation for a work injury, and that the damage was established, and that searching for evidence to prove matters requiring proof would lead to further judicial consideration, and there were no apparent material evidences to rely on in this regard. The appellate court, in its positive role and as the primary expert in the case, and to prevent the prolongation of litigation due to the plaintiff having other cases pending before the administrative courts, saw that the assessment of compensation is left to the court responsible for ruling in the case according to the judge's discretionary authority and what has been established in jurisprudence and judicial rulings as long as its assessment is fair.
Treatment of a Patient Abroad at State Expense
The Administrative Appellate Court upheld the ruling to annul the decision of the Supreme Medical Authority that declined to treat a sick citizen abroad and to continue his treatment in a government hospital, which means obligating his transfer and treatment abroad based on Article 31 of the Basic Law. The citizen had submitted a request for the treatment of his son from Tuberous Sclerosis, a rare genetic disorder that causes multiple tumors in the brain, continuous seizures, and permanent intellectual disability, with no treatment available in the Kingdom, and medical recommendations were issued for his treatment in America at the state's expense.
Doctor's Departure Costs "Health" 1,140,000 Riyals
The appellate court upheld a ruling obligating the Ministry of Health – the General Directorate of Health Affairs in one of the regions to pay 1,140,000 riyals to the plaintiffs as compensation for the lost benefits of their deceased relative, as estimated by the Health Authority, due to the hospital allowing the treating doctor to travel abroad before the lawsuit filed against him was concluded and contrary to the authority's decision prohibiting the doctor from traveling, and it was established that the plaintiffs were harmed by the defendant's error due to the loss of the benefits of their deceased relative as estimated by the Health Authority. The court decided not to accept the defendant's argument of contacting the insurance company to pay compensation for the medical error since the error was outside the insurance coverage, and confirmed the responsibility of the medical facility on the grounds that the doctor is affiliated with it and bears the negligence.
Two Lawyers to "Okaz": "The Administrative" Specializes in Government Entities... "Execution" is on Guard
Lawyer Hakem Al-Hakami told "Okaz": The administrative courts in the Board of Grievances specialize in examining lawsuits and disputes in which government entities are a party, whether directly or indirectly, and whether they are claims for rights or annulment of administrative decisions, among others. It is an independent administrative judiciary, directly linked to the king, with an Administrative Judiciary Council and a Supreme Administrative Court that has its judicial principles, and its decisions and rulings are binding on all entities and individuals. Recently, the Administrative Execution Court was launched, which is the first of its kind in the execution system before the Board of Grievances, as its court and all its circuits are concerned with ensuring the execution guarantees in administrative justice against and for government entities and resolving disputes over the execution of judgments, decisions, and administrative documents.
For her part, lawyer Bashayer Al-Azmah told "Okaz": The administrative execution system emphasized in its articles the punishment of public employees if they exploit their official authority to prevent the execution of the required document partially or completely with the intent to obstruct its execution, as they are punished with imprisonment for a period not exceeding seven years and a fine not exceeding 700,000 riyals or one of these penalties. The employee is also punished if he deliberately refrains from executing the required document partially or completely with the intent to obstruct its execution, after eight days from being notified of the legally stipulated warning or upon receiving the subsequent execution procedures, and if the execution is within his jurisdiction, he is punished with imprisonment for five years and a fine not exceeding 500,000 riyals or one of these penalties. The system decided to punish anyone who participated in refraining from executing or obstructing the document with the same penalty, and the court may include in the issued ruling a provision for publishing a summary of it at the expense of the convicted party in a local newspaper after the ruling becomes final. The system considered the refusal or obstruction of executing administrative judgments as crimes of corruption and major crimes warranting detention.
Obligation of Al-Jouf Education to Transfer a Teacher
The Administrative Appellate Court decided to annul the decision of the Al-Jouf Education Administration not to accept the request to transfer a teacher from the Tabarjal Governorate to Sakaka due to her health conditions that require the presence of a specialized health center to monitor and treat her condition, as she suffers from a chronic medical condition and rapid skin swelling according to medical reports, which means obligating the Education Administration to complete the procedures for her transfer.
Compensation for a Beekeeper of 55 Thousand
The appellate court upheld a ruling obligating the Ministry of Environment to pay a citizen who works as a beekeeper an amount of 55,000 riyals as compensation after it was proven that the apiary was harmed due to the spraying of insecticides nearby. The system stipulated the necessity of announcing the spraying operation a week prior to the operation and the obligation of beekeepers to review the relevant departments to know the spraying periods and take the necessary precautions to protect the apiary. The court concluded that the plaintiff beekeeper was entitled to compensation for half the value of the damaged hives according to the expert's estimate and was not entitled to compensation for the reproduction of bees due to his proven negligence and lack of a license. The beekeeper claimed in his lawsuit compensation of 750,000 riyals due to the locust control team from the Ministry of Environment that sprayed without prior announcement or warning, causing damage to the apiary and the bees, affecting 110 beehives, destroying the bees and pure honey, and spoiling 770 kilograms of honey according to his claim.
Cancellation of 5-Day Deduction and Reinstatement of Student
A final ruling was issued to annul the decision to punish an employee with a 5-day salary deduction for proving the validity of his position regarding the loss of a transaction after his transfer from one department to another at his workplace.
The appellate court also upheld a ruling suspending the execution of the decision to suspend an engineering student from studying at one of the universities for a year, a decision that is subject to immediate enforcement.
Return of Delayed Attorney Fees
The Administrative Appellate Court upheld a ruling to return delayed attorney fees from a law office amounting to 3 million riyals due to the court's decision that the lawsuit was not permissible for having been previously adjudicated, which means that the law office is not entitled to the delayed fees paid to it. The plaintiff company in its lawsuit demanded the return of attorney fees previously paid as delayed fees without justification for a lawsuit that was adjudicated by the administrative court, while the law office responded that it had entered into a contract titled (Legal Services Agreement) in the year 1430 AH, to provide services and consultations, and representation, and based on it, the attorney was tasked with objecting to government fees against the Ministry of Communications and Information Technology. The court concluded to adjudicate the lawsuit based on articles from the Law of Advocacy and obligated the law office to pay 3 million riyals in a final ruling.

The appellate court, in its positive role and as the primary expert in the case, and to prevent the prolongation of litigation due to the plaintiff having other cases pending before the administrative courts, saw that the assessment of compensation is left to the court responsible for ruling in the case according to the judge's discretionary authority and what has been established in jurisprudence and judicial rulings as long as its assessment is fair.
Treatment of a Patient Abroad at State Expense
The Administrative Appellate Court upheld the ruling to annul the decision of the Supreme Medical Authority that declined to treat a sick citizen abroad and to continue his treatment in a government hospital, which means obligating his transfer and treatment abroad based on Article 31 of the Basic Law. The citizen had submitted a request for the treatment of his son from Tuberous Sclerosis, a rare genetic disorder that causes multiple tumors in the brain, continuous seizures, and permanent intellectual disability, with no treatment available in the Kingdom, and medical recommendations were issued for his treatment in America at the state's expense.
Doctor's Departure Costs "Health" 1,140,000 Riyals
The appellate court upheld a ruling obligating the Ministry of Health – the General Directorate of Health Affairs in one of the regions to pay 1,140,000 riyals to the plaintiffs as compensation for the lost benefits of their deceased relative, as estimated by the Health Authority, due to the hospital allowing the treating doctor to travel abroad before the lawsuit filed against him was concluded and contrary to the authority's decision prohibiting the doctor from traveling, and it was established that the plaintiffs were harmed by the defendant's error due to the loss of the benefits of their deceased relative as estimated by the Health Authority. The court decided not to accept the defendant's argument of contacting the insurance company to pay compensation for the medical error since the error was outside the insurance coverage, and confirmed the responsibility of the medical facility on the grounds that the doctor is affiliated with it and bears the negligence.
Two Lawyers to "Okaz": "The Administrative" Specializes in Government Entities... "Execution" is on Guard
Lawyer Hakem Al-Hakami told "Okaz": The administrative courts in the Board of Grievances specialize in examining lawsuits and disputes in which government entities are a party, whether directly or indirectly, and whether they are claims for rights or annulment of administrative decisions, among others. It is an independent administrative judiciary, directly linked to the king, with an Administrative Judiciary Council and a Supreme Administrative Court that has its judicial principles, and its decisions and rulings are binding on all entities and individuals. Recently, the Administrative Execution Court was launched, which is the first of its kind in the execution system before the Board of Grievances, as its court and all its circuits are concerned with ensuring the execution guarantees in administrative justice against and for government entities and resolving disputes over the execution of judgments, decisions, and administrative documents.
For her part, lawyer Bashayer Al-Azmah told "Okaz": The administrative execution system emphasized in its articles the punishment of public employees if they exploit their official authority to prevent the execution of the required document partially or completely with the intent to obstruct its execution, as they are punished with imprisonment for a period not exceeding seven years and a fine not exceeding 700,000 riyals or one of these penalties. The employee is also punished if he deliberately refrains from executing the required document partially or completely with the intent to obstruct its execution, after eight days from being notified of the legally stipulated warning or upon receiving the subsequent execution procedures, and if the execution is within his jurisdiction, he is punished with imprisonment for five years and a fine not exceeding 500,000 riyals or one of these penalties. The system decided to punish anyone who participated in refraining from executing or obstructing the document with the same penalty, and the court may include in the issued ruling a provision for publishing a summary of it at the expense of the convicted party in a local newspaper after the ruling becomes final. The system considered the refusal or obstruction of executing administrative judgments as crimes of corruption and major crimes warranting detention.
Obligation of Al-Jouf Education to Transfer a Teacher
The Administrative Appellate Court decided to annul the decision of the Al-Jouf Education Administration not to accept the request to transfer a teacher from the Tabarjal Governorate to Sakaka due to her health conditions that require the presence of a specialized health center to monitor and treat her condition, as she suffers from a chronic medical condition and rapid skin swelling according to medical reports, which means obligating the Education Administration to complete the procedures for her transfer.
Compensation for a Beekeeper of 55 Thousand
The appellate court upheld a ruling obligating the Ministry of Environment to pay a citizen who works as a beekeeper an amount of 55,000 riyals as compensation after it was proven that the apiary was harmed due to the spraying of insecticides nearby. The system stipulated the necessity of announcing the spraying operation a week prior to the operation and the obligation of beekeepers to review the relevant departments to know the spraying periods and take the necessary precautions to protect the apiary. The court concluded that the plaintiff beekeeper was entitled to compensation for half the value of the damaged hives according to the expert's estimate and was not entitled to compensation for the reproduction of bees due to his proven negligence and lack of a license. The beekeeper claimed in his lawsuit compensation of 750,000 riyals due to the locust control team from the Ministry of Environment that sprayed without prior announcement or warning, causing damage to the apiary and the bees, affecting 110 beehives, destroying the bees and pure honey, and spoiling 770 kilograms of honey according to his claim.
Cancellation of 5-Day Deduction and Reinstatement of Student
A final ruling was issued to annul the decision to punish an employee with a 5-day salary deduction for proving the validity of his position regarding the loss of a transaction after his transfer from one department to another at his workplace.
The appellate court also upheld a ruling suspending the execution of the decision to suspend an engineering student from studying at one of the universities for a year, a decision that is subject to immediate enforcement.
Return of Delayed Attorney Fees
The Administrative Appellate Court upheld a ruling to return delayed attorney fees from a law office amounting to 3 million riyals due to the court's decision that the lawsuit was not permissible for having been previously adjudicated, which means that the law office is not entitled to the delayed fees paid to it. The plaintiff company in its lawsuit demanded the return of attorney fees previously paid as delayed fees without justification for a lawsuit that was adjudicated by the administrative court, while the law office responded that it had entered into a contract titled (Legal Services Agreement) in the year 1430 AH, to provide services and consultations, and representation, and based on it, the attorney was tasked with objecting to government fees against the Ministry of Communications and Information Technology. The court concluded to adjudicate the lawsuit based on articles from the Law of Advocacy and obligated the law office to pay 3 million riyals in a final ruling.
