يسري نظام التنفيذ الجديد اعتباراً من اليوم، بعد مرور 180 يوماً على نشره في صحيفة «أم القرى». وأقر النظام الجديد جملة من التعديلات الجوهرية الهادفة إلى تسريع إيصال الحقوق وتعزيز كفاءة قضاء التنفيذ، بما يواكب التحول الرقمي ويحسّن بيئة الأعمال. وركّز النظام على الفصل بين ذمة المدين وشخصه، ليقتصر التنفيذ على الأموال دون المساس بالبدن، في خطوة تعزز العدالة وتحفظ الحقوق الأساسية.
وشملت التعديلات، تنظيم السندات التنفيذية باشتراط تسجيلها إلكترونياً، إلى جانب تحديد مدة تقادم بـ10 سنوات للسند التنفيذي، ما يسهم في استقرار المعاملات ومنع تراكم المطالبات كما استحدث النظام مفهوم «التنفيذ العكسي» الذي يتيح للمدين إلزام الطرف الآخر بتنفيذ التزاماته.
وفي جانب الإجراءات، وضع النظام ضوابط محددة للمنع من السفر، وألزم بالإفصاح عن الأموال، مع تجريم إخفائها أو تقديم معلومات مضللة، إضافة إلى إتاحة مهلة للمدين لبيع أصوله بشكل منظم. كما راعى الجوانب الأسرية، خصوصاً ما يتعلق بمصلحة الطفل في تنفيذ أحكام الزيارة. ويهدف النظام إلى رفع كفاءة التنفيذ القضائي، ودعم إنفاذ العقود، وتعزيز العدالة الوقائية، وتمكين إسناد بعض أعمال التنفيذ للقطاع الخاص وغير الربحي ضمن أطر نظامية واضحة، فضلاً عن ضوابط تحفظ حقوق طالب التنفيذ.
5 حالات تمنع الحبس
منح النظام المحاكم، أن تأمر بحبس المدين المنفذ ضده 180 يوماً بناء على طلب يقدمه طالب التنفيذ في حال مضى ثلاثون يوم عمل من اتخاذ أي من إجراءات التنفيذ الجبري الواردة في النظام ولم ينفذ المنفذ ضده التزامه، ويجوز للمحكمة تمديدها مدة أخرى بناء على طلب طالب التنفيذ. وأكد النظام، عدم جواز حبس المنفذ ضده في خمس حالات، أولها إذا لم يتجاوز الثامنة عشرة من عمره، أو ثبت بموجب تقرير طبي معتمد إصابته بمرض لا يتحمل معه الحبس، أو إذا كان امرأة حاملاً أو لها طفل لم يتجاوز الثانية من عمره، أو اذا كان المنفذ ضده أحد أصول أو فروع طالب التنفيذ. وشدد النظام على أن إجراءات حبس المدين تكون في حال استنفاذ خطوات التنفيذ الجبري، وأوضح النظام في المادة 36 من نظام التنفيذ إذا كان محل التنفيذ فعلاً أو امتناعاً عن فعل، ولم يُنفذ المنفذ ضده التزامه خلال خمسة أيام عمل من تاريخ إبلاغه بأمر التنفيذ أو من تاريخ الإعلان وفق ما قضى به النظام؛ فتتخذ إجراءات التنفيذ الجبري المتمثلة في أن تأمر المحكمة فورًا باستعمال القوة المختصة للقيام بما يلزم من إجراءات التنفيذ، وذلك ما لم يتطلب التنفيذ أن يقوم به المنفذ ضده بنفسه. وتخاطب المحكمة فورًا الجهة المختصة - عند الاقتضاء - لتنفيذ الحق محل السند التنفيذي، وإذا تعذر التنفيذ باستعمال القوة المختصة، أو عن طريق الجهة المختصة، أو اقتضى التنفيذ قيام المنفذ ضده به بنفسه ولم يقم بذلك؛ فتتخذ إجراءات التنفيذ الجبري، ومنها أن تأمر المحكمة بمنع المنفذ ضده من السفر إلى خارج المملكة - بناء على طلب يقدم من طالب التنفيذ - وتفرض المحكمة غرامة لا تزيد على (عشرة آلاف ريال) يوميًّا على المنفذ ضده عن كل يوم يمضي دون إتمام التنفيذ على ألا تتجاوز حدًّا تحدده اللائحة مقداره. وللمحكمة إلغاء الغرامة أو جزء منها إذا نفذ المنفذ ضده ما عليه من التزام. وتؤول حصيلة الغرامة الإجمالية إلى خزينة الدولة. وتحدد اللائحة الضوابط والإجراءات اللازمة لما ورد في هذه المادة، بما في ذلك ضوابط وإجراءات إخلاء العقار والتصرف بالمنقولات الموجودة فيه إذا لم يتسلمها مالكها. وشدد النظام على أن حبس المنفذ ضده يكون بمعزل عن المسجونين في القضايا الجزائية، ولا ينقضي الحق محل السند التنفيذي بانتهاء مدة الحبس ويظل حقاً قائماً للدائن.
السند التنفيذي المتعلق بالأحوال الشخصية
في ما يتعلق بالتنفيذ في الأحوال الشخصية بين النظام، أن السند التنفيذي المتعلق بمسائل الأحوال الشخصية ينفذ بالطرق المقررة في النظام واللائحة. وتبين اللائحة إجراءات التنفيذ في مسائل الأحوال الشخصية المتضمنة دفع أموال بشكل دوري. وبحسب النظام الجديد - ينفذ - جبراً - السند التنفيذي الصادر بالحضانة، والزيارة، حتى لو أدى ذلك إلى الاستعانة بالقوة المختصة وإلى دخول المنازل بحسب ما يقتضيه الحال، ويعاد تنفيذ السند التنفيذي كلما اقتضى الأمر ذلك. وتسري أحكام التنفيذ المباشر على الممتنع عن التنفيذ في مسائل الأحوال الشخصية وفق ضوابط تحددها اللائحة وتراعى فيها طبيعة مسائل الأحوال الشخصية وظروف التنفيذ. وشدد النظام على أن تراعي المحكمة في تنفيذ السند التنفيذي الصادر بزيارة المحضون ما يحقق مصلحته، وتحدد اللائحة الأحكام اللازمة لإنفاذ ذلك.
تحول نوعي في بنية القضاء التنفيذي
المحامية بشائر العظمة، قالت لـ«عكاظ»: إن نظام التنفيذ الجديد يمثل تحولًا نوعياً في بنية القضاء التنفيذي، حيث لا يقتصر على تعديل الإجراءات، بل يعيد صياغة إجراءات التنفيذ القضائي من نموذج تقليدي إلى نموذج مؤسسي رقمي عالي الكفاءة. وذلك من خلال توسيع الصلاحيات وتعزيز مركزية التنفيذ، وقالت، إن محاكم التنفيذ هي الجهة المركزية الحاسمة في تنفيذ مختلف السندات، التي تشمل الأحكام القضائية، والأوامر والقرارات، والسندات التنفيذية ذات الطبيعة المالية والتجارية، وذكرت، أن النظام الجديد يزيد من الكفاءة ويحاصر المماطلين ويحمي حقوق الأطراف، وقالت، إن وزارة العدل عملت على تعزيز ورفع كفاءة المنظومة العدلية، وذكرت، أن نظام التنفيذ الجديد يجيء وفق حوكمة دقيقة على عمليات التنفيذ، من خلال توحيد الإجراءات، رفع مستوى الإشراف وتقليل أو منع الاجتهادات، ورفع الثقة في عدالة التطبيق. وجاءت رقمنة السندات التنفيذية كواحدة من أبرز نقاط التحول نحو السندات الإلكترونية، حيث يتم تنظيم حجية السندات الرقمية وتُمنح مهلة لتصحيح أوضاع السندات التقليدية (مثل الكمبيالات غير المسجلة)، وهذا التحول يعكس توجهًا واضحًا لربط التنفيذ بمنظومة الاقتصاد الرقمي، وتقليل النزاعات المرتبطة بإثبات الديون.
The new enforcement system comes into effect today, following a 180-day period since its publication in the "Um Al-Qura" newspaper. The new system has approved a series of substantial amendments aimed at accelerating the delivery of rights and enhancing the efficiency of enforcement judiciary, in line with digital transformation and improving the business environment. The system focused on separating the debtor's assets from their person, limiting enforcement to financial assets without affecting the individual, in a step that enhances justice and preserves fundamental rights.
The amendments included organizing enforcement documents by requiring their electronic registration, as well as setting a 10-year statute of limitations for the enforcement document, which contributes to the stability of transactions and prevents the accumulation of claims. The system also introduced the concept of "reverse enforcement," which allows the debtor to compel the other party to fulfill their obligations.
On the procedural side, the system established specific controls for travel bans and mandated the disclosure of assets, criminalizing the concealment of assets or providing misleading information, in addition to allowing the debtor a grace period to sell their assets in an orderly manner. It also took into account family aspects, particularly concerning the child's interest in enforcing visitation rulings. The system aims to enhance the efficiency of judicial enforcement, support contract enforcement, promote preventive justice, and enable the delegation of some enforcement tasks to the private and non-profit sectors within clear regulatory frameworks, in addition to controls that protect the rights of the enforcement applicant.
5 Cases Preventing Imprisonment
The system grants courts the authority to order the imprisonment of the debtor against whom enforcement is sought for 180 days based on a request submitted by the enforcement applicant if thirty working days have passed since any of the enforcement procedures stated in the system were taken and the debtor has not fulfilled their obligation. The court may extend this period upon the request of the enforcement applicant. The system emphasized that the debtor cannot be imprisoned in five cases: first, if they are under eighteen years of age; second, if a certified medical report proves that they suffer from a disease that does not allow for imprisonment; third, if the debtor is a pregnant woman or has a child under the age of two; fourth, if the debtor is one of the ancestors or descendants of the enforcement applicant. The system stressed that the procedures for imprisoning the debtor should occur only after exhausting the steps of compulsory enforcement. Article 36 of the enforcement system clarifies that if the subject of enforcement is an act or abstention from an act, and the debtor has not fulfilled their obligation within five working days from the date they were notified of the enforcement order or from the date of announcement as stipulated by the system, then compulsory enforcement measures will be taken, which include the court immediately ordering the use of the competent authority to carry out the necessary enforcement procedures, unless the enforcement requires the debtor to perform it themselves. The court will immediately communicate with the relevant authority - when necessary - to enforce the right subject to the enforcement document. If enforcement cannot be carried out using the competent authority, or through the relevant authority, or if the enforcement requires the debtor to perform it themselves and they fail to do so, then compulsory enforcement measures will be taken, including the court ordering the debtor to be prohibited from traveling outside the Kingdom - based on a request submitted by the enforcement applicant - and the court imposing a fine not exceeding (ten thousand riyals) daily on the debtor for each day that passes without completing the enforcement, provided it does not exceed a limit determined by the regulations. The court may cancel the fine or part of it if the debtor fulfills their obligations. The total fine proceeds will go to the state treasury. The regulations will specify the necessary controls and procedures for what is stated in this article, including controls and procedures for vacating property and disposing of movable assets within it if the owner does not take possession. The system emphasized that the debtor's imprisonment should be separate from those imprisoned for criminal cases, and the right subject to the enforcement document does not expire upon the completion of the imprisonment period and remains a valid right for the creditor.
The Enforcement Document Related to Personal Status
Regarding enforcement in personal status matters, the system stated that the enforcement document related to personal status issues is executed by the methods prescribed in the system and regulations. The regulations outline the enforcement procedures in personal status matters that involve periodic payments. According to the new system - the enforcement document issued for custody and visitation will be enforced - forcibly - even if this requires the use of the competent authority and entering homes as necessary, and the enforcement document will be re-executed whenever necessary. The direct enforcement provisions apply to those who refuse to comply in personal status matters according to controls specified by the regulations, taking into account the nature of personal status issues and the circumstances of enforcement. The system emphasized that the court should consider what achieves the best interest of the child when enforcing the enforcement document issued for the visitation of the ward, and the regulations will specify the necessary provisions to enforce that.
A Qualitative Shift in the Structure of Judicial Enforcement
Attorney Bashayer Al-Azmah stated to "Okaz": The new enforcement system represents a qualitative shift in the structure of judicial enforcement, as it does not only modify procedures but also redefines judicial enforcement procedures from a traditional model to a highly efficient institutional digital model. This is achieved by expanding powers and enhancing the centralization of enforcement. She noted that enforcement courts are the central authority decisive in executing various documents, which include judicial rulings, orders, decisions, and enforcement documents of a financial and commercial nature. She mentioned that the new system increases efficiency, curtails procrastination, and protects the rights of the parties involved. She stated that the Ministry of Justice has worked to enhance and raise the efficiency of the judicial system, and noted that the new enforcement system comes with precise governance over enforcement operations, through the unification of procedures, raising the level of supervision, reducing or preventing interpretations, and increasing confidence in the fairness of application. The digitization of enforcement documents has emerged as one of the most prominent points of transition towards electronic documents, where the validity of digital documents is organized, and a grace period is granted to rectify the status of traditional documents (such as unregistered promissory notes). This shift reflects a clear trend towards linking enforcement with the digital economy system and reducing disputes related to debt verification.
