شهرت وزارة التجارة بشركة تزاول نشاط بيع الأجهزة الكهربائية والإلكترونية ومدير المنشأة بعد صدور حكم قضائي يدينهما بمخالفة نظام مكافحة الغش التجاري؛ نتيجة إجراء تخفيضات تجارية والإعلان عنها دون الحصول على ترخيص.
ورصدت الوزارة مخالفة فرع المنشأة بمدينة بريدة وإعلانه تخفيضات غير مرخصة وهو ما يعد مخالفًا لأحكام نظام مكافحة الغش التجاري ولائحته التنفيذية.
وتضمن الحكم المؤيد من محكمة الاستئناف بمنطقة القصيم فرض غرامة مالية قدرها ثلاثة آلاف ريال مناصفة بينهما، ونشر الحكم على نفقة المخالفين.
رصد المخالفات
وتراقب «التجارة» امتثال المنشآت التجارية لاشتراطات تنظيم المسابقات والتخفيضات، وترصد المخالفات وتضبط أي ممارسات تجارية وهمية أو مضللة للمستهلك.
ووفقًا لنظام مكافحة الغش التجاري يعاقب من يخالف النظام بعقوبات تصل إلى السجن ثلاثة أعوام، وغرامات مالية تصل إلى مليون ريال، أو بالعقوبتين معًا، والتشهير بالمخالفين بعد صدور أحكام قضائية نافذة من المحاكم المختصة.
The Ministry of Commerce has publicly named a company engaged in the sale of electrical and electronic devices and its manager after a court ruling convicted them of violating the Anti-Commercial Fraud Law; as a result of conducting commercial discounts and advertising them without obtaining a license.
The ministry detected a violation by the branch of the establishment in the city of Buraidah, which announced unauthorized discounts, which is considered a violation of the provisions of the Anti-Commercial Fraud Law and its executive regulations.
The ruling, upheld by the Court of Appeal in the Al-Qassim region, imposed a financial penalty of three thousand riyals, to be shared equally between them, and ordered the publication of the ruling at the expense of the violators.
Monitoring Violations
The Ministry of Commerce monitors the compliance of commercial establishments with the requirements for organizing competitions and discounts, and it detects violations and addresses any fraudulent or misleading commercial practices towards consumers.
According to the Anti-Commercial Fraud Law, those who violate the law are subject to penalties of up to three years in prison, financial fines of up to one million riyals, or both penalties together, along with the public naming of the violators after the issuance of enforceable court rulings from the competent courts.
