أيدت الدائرة الأولى بمحكمة استئناف شمال دمنهور بجمهورية مصر العربية، اليوم، أحكام محكمة جنايات دمنهور الصادرة بحق 9 متهمين في قضية مقتل شاب من أبناء مركز حوش عيسى، خلال محاولة للصلح بين المتهمين وأفراد من عائلته.
وأيدت هيئة المحكمة حكم الإعدام شنقًا بحق متهمين اثنين، والسجن المؤبد بحق 4 متهمين، والسجن المشدد لمدة 5 سنوات بحق متهمين اثنين، كما أيدت حكم البراءة للمتهم التاسع.
ترأس هيئة المحكمة المستشار نبيل محمد عبد السلام، وعضوية المستشارين مسعد فتحي رفاعي، وكارم محمود رزق، ومحمد سامي بهي الدين، وسكرتارية عبد الجليل علي خليفة.
إحالة أوراق متهمين للمفتي
وكانت هيئة المحكمة قد أحالت في جلستها الماضية أوراق متهمين اثنين إلى مفتي الجمهورية لاستطلاع الرأي الشرعي في إعدامهما، وأجلت النطق بالحكم على 7 متهمين آخرين إلى جلسة اليوم.

وتعود أحداث الواقعة إلى ترصد المتهمين للمجني عليه، وتتبع خطواته أثناء سيره مترجلًا بالطريق الواقع خلف محكمة حوش عيسى، حيث انهالوا عليه بالطعنات، ما أدى إلى مقتله.
وكشفت التحقيقات واعترافات المتهمين، بحسب أوراق القضية، أن المجني عليه ظل يردد الشهادتين أثناء الاعتداء عليه، قبل أن يفارق الحياة متأثرًا بالإصابات التي لحقت به.
أحكام أول درجة
وكانت محكمة جنايات دمنهور قد أصدرت أحكامها في القضية، وجاءت بالإعدام شنقًا بحق متهمين اثنين، والسجن المؤبد بحق 4 متهمين، والسجن المشدد لمدة 5 سنوات بحق متهمين اثنين، والبراءة لمتهم واحد. واستأنفت النيابة العامة على الحكم، واستمعت هيئة المحكمة خلال جلسات نظر الاستئناف إلى مرافعات دفاع المتهمين والنيابة العامة ودفاع المجني عليه، كما ناقشت شهود الواقعة، قبل أن تقرر حجز القضية للنطق بالحكم في جلسة اليوم 7 سبتمبر الجاري.
The First Circuit of the North Damanhour Court of Appeal in the Arab Republic of Egypt today upheld the rulings of the Damanhour Criminal Court against 9 defendants in the case of the murder of a young man from the Hosh Eissa Center, during an attempt to reconcile between the defendants and members of his family.
The court upheld the death sentences by hanging for two defendants, life imprisonment for four defendants, and a 5-year rigorous imprisonment for two defendants, as well as the acquittal of the ninth defendant.
The court was presided over by Counselor Nabil Mohamed Abdel Salam, with the membership of counselors Massad Fathy Rifai, Karim Mahmoud Rizk, and Mohamed Sami Bahy El-Din, and the secretariat of Abdel Jalil Ali Khalifa.
Referral of Defendants' Papers to the Mufti
The court had referred the papers of two defendants to the Grand Mufti in its last session to seek a legal opinion on their execution, and postponed the pronouncement of the judgment on 7 other defendants to today’s session.
Details of the Incident
The events of the incident date back to the defendants stalking the victim and following his steps while he was walking on foot along the road behind the Hosh Eissa Court, where they attacked him with stabs, leading to his death.
Investigations and the confessions of the defendants revealed, according to the case documents, that the victim kept repeating the two testimonies during the assault on him, before he succumbed to the injuries he sustained.
First Degree Rulings
The Damanhour Criminal Court had issued its rulings in the case, which included the death penalty by hanging for two defendants, life imprisonment for four defendants, and a 5-year rigorous imprisonment for two defendants, with acquittal for one defendant. The Public Prosecution appealed the ruling, and the court heard during the appeal sessions the defenses of the defendants, the Public Prosecution, and the defense of the victim, as well as discussed the witnesses of the incident, before deciding to reserve the case for judgment pronouncement in today’s session on September 7.
