في خطوة تنظيمية جديدة، أصدرت وزارة الداخلية الكويتية قراراً يعدّل بعض أحكام اللائحة التنفيذية لقانون إقامة الأجانب، متضمناً منح فئة ممن صدر بحقهم مرسوم بسحب الجنسية الكويتية، ومن اكتسبها معهم بالتبعية، إمكانية الحصول على إقامة عادية لمدة تصل إلى 10 سنوات، وفق شروط وضوابط تحددها الإدارة العامة لشؤون الإقامة.
ونص القرار، الذي أصدره النائب الأول لرئيس مجلس الوزراء ووزير الداخلية الشيخ فهد اليوسف ونشر في الجريدة الرسمية «الكويت اليوم»، على أن تشمل الإقامة من عادوا إلى جنسيتهم الأجنبية الأصلية أو حصلوا على جنسية أخرى.
وبحسب القرار، تُمنح الإقامة لهذه الفئة من دون رسوم، كما يُسمح لهم بالعمل في الكويت وفق الضوابط التي تحددها الإدارة العامة لشؤون الإقامة.
كما استثنى القرار الحاصلين على هذه الإقامة من القاعدة التي تمنع الأجنبي من البقاء خارج الكويت لأكثر من ستة أشهر، بما يتيح لهم البقاء خارج البلاد لمدة أطول طالما كانت إقامتهم سارية، ووفق الضوابط المعتمدة.
رسوم مخفضة للالتحاق بعائل
حدد القرار رسماً سنوياً قدره 10 دنانير للفرد لإقامة الالتحاق بعائل للزوج والزوجة والأبناء والأم والأب، بالنسبة إلى المشمولين بأحكام الإقامة الجديدة.
أما صلات القرابة الأخرى، فقد حدد لها القرار رسماً قدره 300 دينار للفرد سنوياً.
كما نص على معاملة العمالة المنزلية المسجلة على كفالة المشمولين بهذه الإقامة، وكذلك الخليجيين الذين سُحبت جنسيتهم الكويتية وعادوا إلى جنسيتهم الأصلية، بالرسوم ذاتها المطبقة على العمالة المنزلية المكفولة من الأسرة الكويتية.
استثناءات من مدة البقاء خارج الكويت
وشملت التعديلات الجديدة المادة 37 من اللائحة التنفيذية، التي تنص في الأصل على عدم جواز بقاء الأجنبي المرخص له بالإقامة خارج الكويت لأكثر من ستة أشهر.
واستثنى القرار من ذلك عدة فئات، بينها:
- أبناء المواطنة الكويتية غير الحاصلة على الجنسية الكويتية بالتبعية من زواجها بكويتي.
- ملّاك العقارات.
- المستثمرون الذين تنطبق عليهم الضوابط المحددة من مجلس الوزراء.
- الحاصلون على الإقامة وفق المادة الجديدة «7 مكرر».
كما أجاز القرار للإدارة العامة لشؤون الإقامة منح إذن بالغياب لمدة تتجاوز ستة أشهر، وفق الشروط والضوابط المعتمدة، بشرط سريان الإقامة.
وفي المقابل، أبقى القرار على مدة أربعة أشهر كحد أقصى لبقاء العمالة المنزلية خارج الكويت، ما لم تحصل على إذن مسبق بالغياب من الإدارة العامة لشؤون الإقامة، وإلا سقط حقها في الإقامة.
صلاحيات «شؤون الإقامة»
ووفق القرار، يتولى المدير العام للإدارة العامة لشؤون الإقامة تحديد الشروط والضوابط اللازمة لمنح وتجديد الإقامة الجديدة، إلى جانب تحديد ضوابط السماح للمشمولين بها بالعمل في الكويت.
ونص القرار في مادته الأخيرة على أن يتولى وكيل وزارة الداخلية تنفيذه، على أن يبدأ العمل به اعتباراً من تاريخ نشره في الجريدة الرسمية.
In a new organizational step, the Kuwaiti Ministry of Interior issued a decision amending some provisions of the executive regulations of the Foreigners Residency Law, including granting a category of individuals against whom a decree to revoke Kuwaiti nationality has been issued, and those who acquired it by extension, the possibility of obtaining a regular residency for a period of up to 10 years, according to conditions and regulations set by the General Department of Residency Affairs.
The decision, issued by the First Deputy Prime Minister and Minister of Interior Sheikh Fahad Al-Yusuf and published in the official newspaper "Kuwait Today," stated that the residency would include those who have returned to their original foreign nationality or obtained another nationality.
According to the decision, residency for this category is granted without fees, and they are allowed to work in Kuwait according to the regulations set by the General Department of Residency Affairs.
The decision also exempted those granted this residency from the rule that prevents foreigners from staying outside Kuwait for more than six months, allowing them to remain outside the country for a longer period as long as their residency is valid, and according to the approved regulations.
Reduced Fees for Family Joining
The decision set an annual fee of 10 Kuwaiti Dinars per individual for family joining residency for the husband, wife, children, mother, and father, for those covered by the new residency provisions.
As for other relatives, the decision set a fee of 300 Kuwaiti Dinars per individual annually.
It also stipulated that domestic workers registered under the sponsorship of those covered by this residency, as well as Gulf nationals whose Kuwaiti nationality was revoked and returned to their original nationality, would be treated with the same fees applicable to domestic workers sponsored by Kuwaiti families.
Exceptions to the Duration of Stay Outside Kuwait
The new amendments included Article 37 of the executive regulations, which originally states that a foreigner authorized to reside in Kuwait may not remain outside the country for more than six months.
The decision exempted several categories from this, including:
- Children of Kuwaiti women who do not obtain Kuwaiti nationality by extension from their marriage to a Kuwaiti.
- Property owners.
- Investors who meet the specific regulations set by the Cabinet.
- Those granted residency under the new Article "7 bis".
The decision also allowed the General Department of Residency Affairs to grant permission for absence for more than six months, according to the approved conditions and regulations, provided that the residency is valid.
In contrast, the decision maintained a maximum duration of four months for domestic workers to stay outside Kuwait unless they obtain prior permission for absence from the General Department of Residency Affairs; otherwise, they lose their right to residency.
Powers of the "Residency Affairs"
According to the decision, the Director General of the General Department of Residency Affairs is responsible for determining the necessary conditions and regulations for granting and renewing the new residency, in addition to setting the regulations allowing those covered by it to work in Kuwait.
The final article of the decision stated that the Undersecretary of the Ministry of Interior shall implement it, and it shall take effect from the date of its publication in the official newspaper.
