A moment of folly under the influence of alcohol can turn into an expensive criminal case, as a Canadian tourist faces up to 4 years in prison after being convicted of stealing a flamingo from a Las Vegas hotel and injuring it, in an incident that garnered widespread attention in the United States.
The incident dates back to March 3, when Mitchell Fairbarn, a resident of Ontario, sneaked into the bird enclosure at the resort while under the influence of alcohol, grabbed a bird named "Peachy," who is 27 years old, and carried it through the elevator and hallways to his room.
Hotel security and police intervened to retrieve the bird, which was injured in its wing and lost between 7 and 8 blood-stained feathers, while surveillance cameras documented the scattered feathers throughout the area, according to the Independent newspaper.
The prosecution considered the incident to be a deliberate act of animal cruelty, based on recordings that showed the bird suffering as it was dragged by its feet. In contrast, defense attorney Josh Tomchik argued that what happened was a reckless act resulting from intoxication, not a deliberate attempt to harm.
Dr. Tiffany Moore, the medical director at the "Lone Mountain" animal hospital, confirmed that "Peachy" has physically recovered, noting that it still shows signs of anxiety and stress during medical examinations.
For her part, prosecutor Hailey Wilming noted that the defendant later faced death threats and was unable to leave the country to attend his father's funeral, emphasizing that his actions were behind the situation's outcome. Animal rights activist John Waddell welcomed the conviction, considering it a deterrent message against animal abuse.
