The phone screen may seem like a safe and closed space for venting and asking sensitive questions away from prying eyes, but a serious journalistic warning issued by the Washington Post revealed a different reality. These secret conversations can quickly lose their privacy, ending up as official incriminating evidence and documents prepared for court files.
The investigative report tracked the use of chat records with artificial intelligence models as legal evidence in more than 12 cases over the past two years, ranging from criminal cases to lawsuits regarding social media addiction.
How does venting become a "damning record"?
Legal experts believe that the danger of conversations with AI robots lies in the fact that they go far beyond traditional search engines:
- Open-ended thinking: The user explains to the robot the background of their thoughts and feelings, leaving behind a record that shows how they think and what they were trying to understand or conceal.
- Automatic reporting to authorities: Companies like OpenAI use systems to monitor risk indicators and have already reported a user in Florida who spoke to the program about an intent to kill, leading to their immediate arrest by the police.
- Lack of legal confidentiality: Courts do not treat AI like "your doctor or lawyer," as a federal judge in New York refused to grant any confidentiality to conversations with the "Claude" model because the robot is simply not a lawyer.
Government requests from law enforcement agencies for user account data are increasing at a record pace, with OpenAI revealing data from dozens of accounts upon official requests.
Experts confirm that what is happening today is just "the tip of the iceberg." As artificial intelligence becomes more integrated into our lives, our personal conversations are becoming more susceptible to scrutiny and examination under the hammer of the law.
