تشهد قضية الإعلامية المصرية مها الصغير تطورًا قضائيًا جديدًا، عقب تقدم فريق دفاعها بطعن رسمي على الحكم الصادر بسجنها شهرًا واحدًا وتغريمها عشرة آلاف جنيه، في القضية المرتبطة بانتهاك حقوق الملكية الفكرية ونَسب أعمال فنية عالمية إلى نفسها.
وبحسب المعطيات القانونية المتداولة، يفتح الطعن ثلاثة سيناريوهات محتملة أمام المحكمة المختصة، يتمثل أولها في تأييد الحكم الصادر، في حال اقتناع الدائرة القضائية بصحة الأدلة وتكامل أركان الجريمة من حيث الفعل والقصد. أما السيناريو الثاني، فيتجه نحو تخفيف العقوبة، سواء عبر تقليص مدة الحبس أو الاكتفاء بالغرامة المالية، استنادًا إلى تقدير المحكمة لملابسات القضية وحدود الضرر. بينما يتيح السيناريو الثالث إلغاء الحكم والبراءة، إذا رأت المحكمة انتفاء القصد الجنائي أو وجود مبررات قانونية تُسقط المسؤولية.
وكانت المحكمة الاقتصادية في القاهرة، أصدرت حكمها السابق بعد ثبوت قيام الإعلامية بعرض لوحات فنية عالمية على أنها من إبداعها الشخصي، خلال ظهور تلفزيوني في يوليو الماضي، وهو ما اعتُبر تعديًا مباشرًا على حقوق الملكية الفكرية.
وأثارت القضية تفاعلًا واسعًا على منصات التواصل الاجتماعي، عقب خروج عدد من الفنانين الأصليين لنفي ملكية الأعمال المنسوبة للإعلامية، من بينهم فنانة دنماركية، وفنان فرنسي، وفنانة ألمانية، ما منح القضية بعدًا دوليًا وأعاد تسليط الضوء على أهمية حماية الحقوق الإبداعية.
وتبقى القضية محل متابعة قانونية وإعلامية، في انتظار ما ستؤول إليه نتائج الطعن، بين تثبيت الحكم أو تعديله أو إلغائه بالكامل.
