في جلسة شهدت إجراءات أمنية مشددة وتوتراً شعبياً عالياً، أصدرت محكمة جنايات مستأنف دمنهور، اليوم (الثلاثاء)، حكماً بتخفيض العقوبة على المتهم «ص.ك.ج.ا»، البالغ 79 عاماً، الموظف السابق في مدرسة «الكرمة للغات» بدمنهور، من السجن المؤبد إلى 10 سنوات سجن نافذة، في القضية رقم 33773 لسنة 2024 جنايات مركز دمنهور.
الحكم جاء بعد استكمال مرافعات الدفاع في الجلسة السابعة، وسط هتافات «حق ياسين لازم يرجع» من أمام المحكمة، وغضب أسرة الطفل الذي لم يتجاوز عمره 5 سنوات وقت الواقعة، معتبرين الحكم «ظلماً لا يُقبل».
مأساة طفل داخل جدران المدرسة
تعود جذور القضية إلى عام 2023، عندما تعرض الطفل ياسين لاعتداء جنسي داخل دورات المياه بمدرسة «الكرمة» الخاصة، حيث كان المتهم يعمل مراقباً مالياً ومسؤولاً إدارياً، ولاحظت الأسرة تغييرات نفسية وصحية مفاجئة لدى الطفل، مما دفعها إلى تقديم بلاغ للنيابة العامة في يناير 2024.
وأجرت التحقيقات الطب الشرعي الذي أكد الإصابات، واستجوب الشهود بما في ذلك مديرة المدرسة والعاملين، مما أدى إلى إحالة المتهم إلى محكمة جنايات دمنهور بتهمة «هتك عرض طفل بالقوة والتهديد» وفق المادة 268 من قانون العقوبات.
وفي 30 أبريل 2024، حكمت المحكمة الابتدائية بالمؤبد، معتبرة الفعل «انتهاكاً صارخاً لحرمة الجسد البريء»، مع الاستناد إلى تقارير الطب الشرعي التي وصفت الإصابات بالدامغة، وأقوال الشهود التي أكدت استغلال المتهم لموقعه السلطوي.

وبعد ساعات من المداولات، أصدرت المحكمة الحكم بالتخفيض إلى 10 سنوات، مع الاستناد إلى «الاعتبارات الإنسانية لعمر الجاني» و«إعادة تصنيف الفعل جزئياً تحت المادة 269»، مع تأكيد ثبوت الجناية.
حضر الطفل ياسين الجلسة مرتدياً قناع «سبايدر مان» رمزاً للقوة، وسط عناق أسرته، لكنه لم يُسمح له بالكلام للحفاظ على سلامته النفسية. أودعت حيثيات الحكم للنشر لاحقاً، مع إمكانية نقض من النيابة أو الأسرة أمام محكمة النقض.
In a session that witnessed strict security measures and high public tension, the Damanhour Court of Appeal today (Tuesday) issued a ruling to reduce the sentence of the accused "S.K.J.A," a 79-year-old former employee at the "Karma Language School" in Damanhour, from life imprisonment to 10 years in prison, in case number 33773 for the year 2024, Damanhour Criminal Court.
The ruling came after the completion of the defense's arguments in the seventh session, amidst chants of "Yasin's right must return" from outside the court, and the anger of the child's family, who was only 5 years old at the time of the incident, considering the ruling "an unacceptable injustice."
The Tragedy of a Child Within School Walls
The roots of the case date back to 2023, when the child Yasin was sexually assaulted inside the bathrooms of the private "Karma" school, where the accused worked as a financial supervisor and administrative official. The family noticed sudden psychological and health changes in the child, prompting them to file a report with the public prosecution in January 2024.
The forensic investigations confirmed the injuries, and witnesses were interrogated, including the school principal and staff, which led to the referral of the accused to the Damanhour Criminal Court on charges of "assaulting a child by force and threat" under Article 268 of the Penal Code.
On April 30, 2024, the primary court sentenced him to life imprisonment, considering the act "a flagrant violation of the sanctity of the innocent body," relying on forensic reports that described the injuries as conclusive, and witness testimonies that confirmed the accused's exploitation of his authoritative position.
The accused denied the charges, claiming "false accusations," but the panel viewed his denial as "a desperate means" in light of the evidence. The defense filed an appeal, requesting a reduction of the sentence to a maximum of 7 years under Article 269 (assault without force), along with a request to summon the chief forensic doctor to discuss the report and include the accused's treatment records and investigations from the Supreme State Security Prosecution.

The session was held today inside the Itay al-Baroud Primary Court, amid a heavy presence of security forces that intensified to secure the surroundings, with hundreds of supporters and journalists in attendance.
