فاز الغواص البريطاني المخضرم آلان بيكوك، البالغ من العمر 55 عاماً، بتعويض قدره 915 ألف جنيه إسترليني بعد إصابة كارثية أدت إلى بتر ساقه اليمنى أثناء عمله في عمليات مد أنابيب قبالة سواحل الهند عام 2011.
تعرض بيكوك، وهو من عشاق رياضة ركوب الدراجات الجبلية، لحادث مروع عندما تحركت معدة ثقيلة بشكل غير متوقع، مما تسبب في سحب قدمه بين قطعتين من المعدات وسحقها.
وقع الحادث أثناء عمله من بارجة شحن تابعة لشركة هندية، حيث كان يعمل على فصل سلاسل تربط أكواماً رأسية تعمل كمطرقة لتثبيت أكوام أخرى في قاع البحر.
وبسبب ظروف العمل الصعبة، التي شملت رؤية محدودة لا تتجاوز المتر الواحد وتيارات بحرية قوية، تحركت الأكوام بشكل مفاجئ نتيجة عدم تثبيتها بشكل كافٍ، مما أدى إلى سحق قدم بيكوك.
تمكن «بيكوك» من الزحف والعودة إلى سلة الغوص بعد الحادث، حيث تلقى العلاج الأولي في الهند قبل نقله إلى مستشفى رويال فيكتوريا في نيوكاسل ببريطانيا، حيث اضطر الأطباء لبتر ساقه تحت الركبة بسبب توقف تدفق الدم إلى القدم.
وعلى الرغم من صدمته النفسية، أظهر بيكوك إرادة قوية، حيث عاد إلى العمل كغواص بعد 18 شهرًاً فقط بمساعدة طرف اصطناعي مصمم خصيصاً.
رفع «بيكوك» دعوى قضائية ضد شركته السابقة وشركة هيونداي للصناعات الثقيلة الكورية الجنوبية، التي كانت تدير البارجة، مدعياً أن ظروف العمل كانت خطرة بسبب التيارات القوية وسوء الرؤية وعدم تثبيت الأكوام بشكل آمن.
نجح في الحصول على تعويض قدره 765,866 جنيه إسترليني من الشركة الهندية «ديل سياتك»، إضافة إلى 169,000 جنيه إسترليني سبق أن دفعته «هيونداي» كتسوية.
خلال المحاكمة في المحكمة العليا، أشاد محاميه مارك تشابمان بصمود بيكوك، مشيراً إلى أنه رجل ملهم تمكن من العودة إلى مهنة الغوص رغم التحديات، مستخدماً أحزمة تسلق لتثبيت الطرف الاصطناعي أثناء العمل.
ومع ذلك، عبر بيكوك عن قلقه من احتمال اعتماده على كرسي متحرك في المستقبل، مؤكداً أنه يحرص على الحفاظ على لياقته من خلال ممارسة رياضة الكاياك وركوب الدراجات الجبلية.
شمل التعويض مبالغ لتغطية خسارة الأرباح، تكاليف الأطراف الاصطناعية، ومصاريف السفر بالدرجة الأولى لتسهيل تنقلاته، إلى جانب تعويض عن الرعاية التي قدمتها زوجته سامانثا فينسنت.
وأشاد محاميه سيمون أولوغلين بشجاعة بيكوك، مؤكداً أن التعويض سيوفر له الدعم اللازم للعلاج المستقبلي، بينما قال «بيكوك»: لم أتخيل يوماً أنني سأعود للغوص بعد هذه الإصابة، لكنني اخترت استعادة حياتي، وأنا فخور بما حققته.
The veteran British diver Alan Peacock, aged 55, won a compensation of £915,000 after a catastrophic injury led to the amputation of his right leg while working on pipeline laying operations off the coast of India in 2011.
Peacock, an avid mountain biking enthusiast, suffered a horrific accident when a heavy piece of equipment moved unexpectedly, causing his foot to be pulled between two pieces of machinery and crushed.
The accident occurred while he was working from a barge owned by an Indian company, where he was engaged in separating chains that connect vertical piles acting as hammers to drive other piles into the seabed.
Due to the difficult working conditions, which included limited visibility of less than one meter and strong sea currents, the piles moved suddenly due to insufficient securing, resulting in Peacock's foot being crushed.
Peacock managed to crawl back to the diving basket after the accident, where he received initial treatment in India before being transferred to the Royal Victoria Hospital in Newcastle, UK, where doctors had to amputate his leg below the knee due to the cessation of blood flow to his foot.
Despite his psychological shock, Peacock showed strong willpower, returning to work as a diver just 18 months later with the help of a specially designed prosthetic limb.
Peacock filed a lawsuit against his former company and South Korea's Hyundai Heavy Industries, which operated the barge, claiming that the working conditions were hazardous due to strong currents, poor visibility, and the unsafe securing of the piles.
He successfully obtained compensation of £765,866 from the Indian company "Dill Seatech," in addition to £169,000 that Hyundai had previously paid as a settlement.
During the trial in the High Court, his lawyer Mark Chapman praised Peacock's resilience, noting that he is an inspiring man who managed to return to the diving profession despite the challenges, using climbing straps to secure the prosthetic limb while working.
However, Peacock expressed concern about the possibility of relying on a wheelchair in the future, emphasizing that he is keen to maintain his fitness through kayaking and mountain biking.
The compensation included amounts to cover lost earnings, costs of prosthetics, and first-class travel expenses to facilitate his mobility, along with compensation for the care provided by his wife, Samantha Vincent.
His lawyer Simon O'Loughlin praised Peacock's bravery, confirming that the compensation will provide him with the necessary support for future treatment, while Peacock stated: "I never imagined I would return to diving after this injury, but I chose to reclaim my life, and I am proud of what I have achieved."
