كشفت عضو هيئة التدريس المتخصصة في القانون الرياضي الدكتورة آلاء الخزامي، لـ«عكاظ» أن نادي القادسية يملك موقفاً قانونياً متيناً في نزاعه حول كأس السوبر السعودي 2025، مشيرة إلى أن القضية أبرزت تضارباً واضحاً بين نصوص اللوائح وقرارات اللجان.
وقالت الخزامي: إن انسحاب الهلال من نصف النهائي في يوليو 2025، ثم إشراك الأهلي بدلاً عنه بقرار من لجنة المسابقات، مثّل لحظة فارقة خلقت جدلاً واسعاً. مضيفة أن لوائح الاتحاد تمنح في مثل هذه الحالة الفوز 3-0 للفريق المستفيد، أي القادسية، وتأهله المباشر إلى النهائي.
تضارب اللوائح
وأوضحت الخزامي أن القضية تقوم على تعارض جوهري بين نصين: المادة 6 الفقرة 4 من لائحة المسابقات: منحت لجنة المسابقات صلاحية تقديرية في معالجة الحالات الطارئة، واستندت إليها في إشراك الأهلي.
القاعدة العامة في حالات الانسحاب – المادة 59 الفقرة 3: تنص على خسارة الفريق المنسحب 0-3 وتأهل الطرف المقابل، وهو ما كان يمنح القادسية حقاً صريحاً في النهائي.
وأضافت: «هذا التعارض خلق تناقضاً في التطبيق؛ فالقرار الإداري أخذ بالمرونة، بينما النص القانوني القطعي كان يمنح القادسية بطاقة العبور دون اجتهاد».
قرار الاستئناف
وتابعت الخزامي أن لجنة الانضباط عاقبت الهلال بالغرامة وحرمانه من بطولات مقبلة، قبل أن تؤكد لجنة الاستئناف يوم 23 أغسطس خسارته 0-3 أمام القادسية. وقالت: «القرار أنصف القادسية نظرياً، لكنه لم يُترجم عملياً، إذ أقيم النهائي بين الأهلي والنصر وتُوِّج الأهلي باللقب، في حين بقي القادسية خارج المشهد».
خيارات القادسية
وأكدت الخزامي أن القادسية استنفد عملياً مساراته الداخلية، إذ إن قرار لجنة المسابقات نهائي داخلياً، مما يمنحه الحق في التوجه مباشرة إلى مركز التحكيم الرياضي السعودي.
ورأت أن حجج القادسية أمام هيئة التحكيم تتمثل في: مخالفة قرار لجنة المسابقات لنصوص اللائحة الملزمة.
استناد النادي إلى قرار لجنة الاستئناف الذي اعتبره فائزاً 3-0، الأضرار المالية والمعنوية التي لحقت به جراء حرمانه من النهائي (خسارة مكافأة لا تقل عن مليوني ريال بجانب العوائد الاعتبارية).
وقالت: «من الصعب إعادة النهائي بعد تتويج الأهلي، لكن المركز قد يقر بحق القادسية مبدئياً ويمنحه تعويضاً مالياً أو اعتبارياً، وهو السيناريو الأقرب».
مواءمة اللوائح
وختمت الخزامي حديثها لـ«عكاظ» بالقول: «قضية السوبر السعودي كشفت حاجة ملحة إلى مواءمة النصوص المرنة مع النصوص القطعية؛ لضمان عدالة المنافسة وحماية حقوق الأندية، فالقادسية قد لا يستعيد النهائي، لكنه قد يخرج بقرار يعيد الاعتبار لمبدأ احترام اللوائح».

Dr. Alaa Al-Khazami, a faculty member specializing in sports law, revealed to "Okaz" that Al-Qadisiyah Club has a strong legal position in its dispute over the Saudi Super Cup 2025, noting that the case highlighted a clear conflict between the provisions of the regulations and the decisions of the committees.
Al-Khazami stated that Al-Hilal's withdrawal from the semi-finals in July 2025, followed by the decision of the Competitions Committee to include Al-Ahli instead, represented a pivotal moment that sparked widespread debate. She added that the federation's regulations grant a 3-0 victory to the benefiting team, which is Al-Qadisiyah, and direct qualification to the final.
Conflict of Regulations
Al-Khazami explained that the case is based on a fundamental contradiction between two texts: Article 6, Paragraph 4 of the Competitions Regulations, which granted the Competitions Committee discretionary power to handle emergency cases, and which it relied on to include Al-Ahli.
The general rule in cases of withdrawal – Article 59, Paragraph 3: states that the withdrawing team loses 0-3 and the opposing party qualifies, which would have granted Al-Qadisiyah a clear right to the final.
She added: "This contradiction created inconsistency in application; the administrative decision adopted flexibility, while the definitive legal text granted Al-Qadisiyah a ticket to the final without interpretation."
Appeal Decision
Al-Khazami continued that the Disciplinary Committee penalized Al-Hilal with a fine and deprived it of future championships, before the Appeals Committee confirmed on August 23 that Al-Hilal lost 0-3 to Al-Qadisiyah. She said: "The decision theoretically vindicated Al-Qadisiyah, but it was not translated into practice, as the final was held between Al-Ahli and Al-Nassr, with Al-Ahli being crowned the champion, while Al-Qadisiyah remained outside the scene."
Options for Al-Qadisiyah
Al-Khazami confirmed that Al-Qadisiyah has practically exhausted its internal avenues, as the Competitions Committee's decision is final internally, which gives it the right to go directly to the Saudi Sports Arbitration Center.
She viewed that Al-Qadisiyah's arguments before the arbitration body include: the violation of the Competitions Committee's decision of the binding regulations.
The club's reliance on the Appeals Committee's decision, which considered it the winner 3-0, the financial and moral damages incurred due to its exclusion from the final (loss of a reward of no less than two million riyals in addition to the reputational returns).
She said: "It is difficult to replay the final after Al-Ahli's crowning, but the center may recognize Al-Qadisiyah's right in principle and grant it financial or reputational compensation, which is the most likely scenario."
