أعلنت رابطة الدوري الإنجليزي الممتاز «بريميرليغ»، اليوم (الثلاثاء)، إدانة مانشستر سيتي في جميع التهم الموجهة إليه بشأن خرق قواعد الدوري الإنجليزي.
وقالت رابطة «البريميرليغ» في بيان: «خلصت لجنة مستقلة إلى أن نادي مانشستر سيتي لكرة القدم مذنب بجميع التهم المتعلقة بالانتهاكات الخطيرة للقواعد المالية للدوري الإنجليزي الممتاز على مدى تسعة مواسم، ومعظم التهم المتعلقة بعدم تعاونه مع تحقيق الدوري».
عقود صورية وتضخيم الإيرادات
وأضاف البيان: «خلصت اللجنة المستقلة إلى أنه بين موسمي 2009-2010 و2017-2018، أبرم النادي عقوداً صورية (تضلل الأطراف بشأن الاتفاق الحقيقي) مع عدد من شركائه التجاريين، بالإضافة إلى اعتماده على اتفاقيات صورية مع آخرين، لتضخيم إيرادات النادي بشكل مصطنع وخفض تكاليفه».
وتابع: «قدم مانشستر سيتي حسابات مضللة وأخفى الوضع المالي الحقيقي عن مدققي حساباته وهيئات تنظيم كرة القدم، كما انتهك بشكل كبير حدود الإنفاق التي وضعها كل من الدوري الإنجليزي الممتاز والاتحاد الأوروبي لكرة القدم».
انتهاكات خلال التحقيق
وواصل البيان: «خلال تحقيق الدوري الإنجليزي الممتاز، ارتكب مانشستر سيتي انتهاكات متعددة لواجباته في التعاون وحسن النية المطلقة تجاه الدوري، إذ ثبتت صحة ثلاثة من الانتهاكات الأربعة المزعومة».
وأشار إلى أن اللجنة المستقلة خلصت إلى أن نادي مانشستر سيتي أبرم صفقات تجارية صورية مع عدد من رعاته خلال تلك الفترة، ضمن مخطط تمويل مُقنّع، حيث لم يُطلب من تلك الشركات سوى دفع جزء من رسوم الرعاية، فيما تم تمويل الباقي من قبل المجموعة المالكة للنادي.
وكجزء من هذا المخطط، تم إبرام ترتيبات صورية أخرى، بتمويل من «ADUG»، لتمكين النادي من تسجيل نفقات تشغيلية أقل من النفقات الفعلية، بالإضافة إلى اتفاقية وهمية مع جامعة فوردهام، وهي الجهة التي اشترت حقوق صور لاعبي النادي، بتمويل من «ADUG».
تضخيم إيرادات بشكل مصطنع
وأوضح البيان: «تبين أن الغرض من هذه المخططات كان تضخيم إيرادات النادي بشكل مصطنع، وخفض تكاليفه بأكثر من 900 مليون جنيه إسترليني خلال الفترة المعنية، وذلك لإظهار امتثاله للقواعد المالية».
وأضاف: «نتيجة لذلك، كما وجدت اللجنة، قدم النادي حسابات مضللة وأخفى الوضع المالي الحقيقي عن مدققي حساباته وهيئات تنظيم كرة القدم. وخلصت اللجنة إلى أن سلوك النادي أظهر بوضوح نيته التحايل على قواعد الدوري الإنجليزي الممتاز».
خرق حدود الإنفاق
ولفت البيان إلى أن مانشستر سيتي لم يقدم تقارير دقيقة عن إيراداته ونفقاته لأغراض قواعد الربحية والاستدامة الخاصة بالدوري الإنجليزي الممتاز، وقواعد ترخيص الأندية واللعب المالي النظيف الخاصة بالاتحاد الأوروبي لكرة القدم.
وخلصت اللجنة إلى أنه لو تم الإبلاغ بدقة عن جميع الاتفاقيات ذات الصلة في حسابات النادي، لكان النادي قد خالف حدود الإنفاق التي وضعها كل من الدوري الإنجليزي الممتاز والاتحاد الأوروبي لكرة القدم بمقدار كبير جداً.
جهود لإحباط التحقيق
بالإضافة إلى ذلك، وخلال التحقيق الذي أجرته رابطة الدوري الإنجليزي الممتاز على مدى أربع سنوات، ارتكب النادي انتهاكات متعددة لواجباته في التعاون وحسن النية تجاه الرابطة، وخلصت اللجنة إلى أن النادي «بذل جهوداً حثيثة لوقف وإحباط تحقيق رابطة الدوري الإنجليزي الممتاز».
The Premier League announced today (Tuesday) the conviction of Manchester City on all charges related to breaching the English league's rules.
The Premier League stated in a statement: "An independent panel has concluded that Manchester City Football Club is guilty of all charges related to serious violations of the Premier League's financial rules over nine seasons, with most charges related to its lack of cooperation with the league's investigation."
Fictitious Contracts and Inflated Revenues
The statement added: "The independent panel found that between the 2009-2010 and 2017-2018 seasons, the club entered into fictitious contracts (misleading parties about the true agreement) with several of its commercial partners, in addition to relying on fictitious agreements with others, to artificially inflate the club's revenues and reduce its costs."
It continued: "Manchester City submitted misleading accounts and concealed its true financial position from its auditors and football regulatory bodies, and significantly breached the spending limits set by both the Premier League and UEFA."
Violations During the Investigation
The statement went on: "During the Premier League investigation, Manchester City committed multiple violations of its obligations to cooperate and act in good faith towards the league, as three of the four alleged violations were found to be valid."
It noted that the independent panel concluded that Manchester City entered into fictitious business deals with several of its sponsors during that period, as part of a disguised financing scheme, where those companies were only required to pay a portion of the sponsorship fees, while the remainder was funded by the club's ownership group.
As part of this scheme, other fictitious arrangements were made, funded by "ADUG", to enable the club to record operational expenses lower than the actual expenses, in addition to a fictitious agreement with Fordham University, which purchased the image rights of the club's players, funded by "ADUG".
Artificially Inflated Revenues
The statement clarified: "The purpose of these schemes was to artificially inflate the club's revenues and reduce its costs by more than £900 million during the relevant period, in order to demonstrate compliance with financial rules."
It added: "As a result, the panel found that the club submitted misleading accounts and concealed its true financial position from its auditors and football regulatory bodies. The panel concluded that the club's behavior clearly demonstrated its intent to circumvent the Premier League's rules."
Breaching Spending Limits
The statement pointed out that Manchester City did not provide accurate reports of its revenues and expenses for the purposes of the Premier League's profitability and sustainability rules, as well as UEFA's club licensing and financial fair play regulations.
The panel concluded that if all relevant agreements had been accurately reported in the club's accounts, the club would have significantly breached the spending limits set by both the Premier League and UEFA.
Efforts to Thwart the Investigation
Additionally, during the investigation conducted by the Premier League over four years, the club committed multiple violations of its obligations to cooperate and act in good faith towards the league, and the panel concluded that the club "made concerted efforts to stop and thwart the Premier League's investigation."
