خالفت شركات الأنظمة الخاصة بنظام الإعلام المرئي والمسموع، وعملت على استدعاء معلنين من خارج المملكة للترويج لأنشطتها دول تراخيص، منها ممثلو خمس منشآت تجارية، بعد رصد مخالفات تضمنت الاستعانة بمعلنين من الخارج للترويج لأنشطتها.
وأكدت هيئة تنظيم الإعلام، إحالة المخالفات إلى اللجان المختصة لاستكمال الإجراءات النظامية، وأكدت حرصها على تطبيق الأنظمة بكل دقة وحزم، وعدم التهاون مع أي ممارسات مخالفة للضوابط الإعلامية أو لأحكام نظام الإعلام المرئي والمسموع.
وشددت الهيئة العامة لتنظيم الإعلام، على استمرارها في عمليات الرصد والمتابعة لضمان بيئة إعلامية منظمة وجاذبة، تسهم في تعزيز جودة المحتوى في المملكة، وتحفظ حقوق المرخص لهم، بما يعزز ثقة المستثمرين والجمهور. وأكدت الهيئة أنه يشترط للحصول على رخصة «موثوق» الالتزام بالضوابط الخاصة بتقديم الأفراد للمحتوى الإعلاني عبر منصات التواصل الاجتماعي، وضوابط المحتوى والإعلانات والتصنيفات (بما فيها التصنيف العمري) والتعليمات الصادرة من الهيئة، كما يشترط التعهد بتقديم أي بيانات أو معلومات أو تقارير تطلبها، والتوقف عن الإعلان عن أي محتوى إعلامي فوراً دون اعتراض عند طلبها، وعدم عرض أي إعلان إلا من خلال حساب مسجل لدى الهيئة ومرتبط بالترخيص الممنوح للمرخص له، ويتعهد غير السعودي بعدم ممارسة النشاط إلا بعد الحصول على التراخيص والموافقات اللازمة.
رخصة غير السعوديين
بينت الهيئة أنه يستفيد من الرخصة الأفراد السعوديون داخل المملكة وخارجها، ويمكن للخليجيين استخراج سجلات تجارية وترخيص الدعاية والإعلان، فيما يتوجّب على الأجانب غير الخليجيين استخراج ترخيص أفراد عن طريق التعاقد مع وكالة دعاية وإعلان محلية مرخصة، أو عبر حصولهم على رخصة استثمار وفق الأنظمة واللوائح. كما يسمح بتسجيل حسابات ذات الأسماء المستعارة ويحق لوكالات الدعاية والإعلان الخارجية التعامل مع فرد مرخص حسب الأنظمة واللوائح؛ حيث يتوجب عليه استخراج ترخيص قبل أي علاقة تعاقدية.
ويتعين للإعلان عن منتجات أو خدمات متخصصة مثل «الأدوية، والعلاجات، وغيرها»، الالتزام بما نصت عليه المادة الخامسة من نظام الإعلام المرئي والمسموع وضوابط المحتوى الإعلامي.
وسبق أن رصدت الهيئة العامة للإعلام المرئي والمسموع، مخالفة عدد من المعلنين غير السعوديين «مقيمين وزائرين» في منصات التواصل الاجتماعي، وبعد التحقق من بياناتهم تبين وجود تجاوزات نظامية ومن ذلك «عدم حصولهم على سجلات تجارية أو تراخيص نظامية ولا يعملون تحت أي كيان تجاري أو رخصة استثمار أجنبي».
5 ملايين غرامة التستر
أكد المحامي عبد العزيز بن دبشي لـ«عكاظ» أن الاستعانة بمعلنين من خارج المملكة أو مقيمين أو زائرين دون الحصول على ترخيص نظامي، مخالفة صريحة لأنظمة الإعلام والتجارة، وتتم متابعتها من قبل هيئات تنظيمية مثل هيئة تنظيم الإعلام، وتصل العقوبات إلى غرامات أو السجن في حالة التستر، ويجب على المنشآت التعاقد مع معلنين حاصلين على ترخيص «موثوق» أو يعملون تحت كيانات تجارية نظامية في المملكة لضمان الالتزام بالأنظمة.
وأوضح، أن الغرامات تبدأ من 100 ريال وتصل إلى 500 ألف ريال في بعض الحالات، وفي حالات التستر قد تصل إلى خمسة ملايين ريال، وفي حال ثبوت جريمة التستر، يمكن أن تصل عقوبة السجن إلى خمس سنوات، كما تشمل إيقاف النشاط وإيقاف المعلن ومنعه من الإعلان.
وأكد بن دبشي على ضرورة التعاقد مع كيانات نظامية، وأن يكون التعاقد مع المعلنين الذين يعملون تحت كيانات تجارية في المملكة ولهم تراخيص نظامية تخولهم بممارسة الإعلان.
وشدد على أن المعلنين الأجانب يتطلب حصولهم على التصريح اللازم، ولا يجوز لهم ممارسة العمل دون الحصول على ترخيص، ومن يخالف ذلك يعرض نفسه للمساءلة؛ سواء كان فرداً أو منشأة تجارية.

دعا اتحاد الغرف السعودية لضرورة التأكيد على مشتركي الغرف من التجار، ومن في حكمهم، إلى عدم التعامل مع الأفراد غير المرخص لهم بالإعلان، فيما حذرت وزارة التجارة، القطاع الخاص، من التعامل مع المعلنين غير السعوديين المتجاوزين استناداً إلى الأنظمة واللوائح ذات العلاقة؛ بما فيها نظام العمل وقواعد التعامل مع الوافدين من مخالفي الأنظمة، التي تمنع العامل من العمل لحسابه الخاص، وتمكن وزارة الداخلية من ضبط وإيقاف وترحيل وإيقاع العقوبات على المخالفين، وكذلك نظام مكافحة التستر؛ الذي يعد ممارسة غير السعودي لنشاط اقتصادي لحسابه الخاص في المملكة وغير مرخص له بممارسته «جريمةً» يعاقب مرتكبها بعقوبات تصل إلى السجن خمسة أعوام والغرامة خمسة ملايين ريال.

يحظر على الموثق تسمية الحساب بأسماء مناطق أو محافظات أو هجر ونحوها، في خطوة تسعى لتقديم الموثق لنفسه بمصداقية ووضوح للمتلقي، بعيداً عن التضليل، فيما يشمل إلزامية الحصول على الترخيص، المعلنين من خارج المملكة، وفق ضوابط حددتها اللائحة. ومن ذلك، أن يكون لديه سجل تجاري، إضافة إلى ترخيص من مكاتب الدعاية والإعلان الإعلامية المرئية والمسموعة، ومكاتب التسويق ووكالات الدعاية، فيما يشمل ترخيص «موثوق» كافة منصات التواصل الاجتماعي، وتمنع الأنظمة صاحب الحساب الذي صدر له الترخيص، التصرف فيه، وذلك بنقله إلى شخص آخر، ويتعين على طالب الترخيص أن يكون قد أتم سن الـ18 من العمر.

Private media system companies have violated regulations by calling upon advertisers from outside the Kingdom to promote their activities in licensed countries, including representatives from five commercial establishments, after monitoring violations that involved hiring foreign advertisers to promote their activities.
The Media Regulatory Authority confirmed that the violations have been referred to the relevant committees to complete the legal procedures, emphasizing its commitment to applying the regulations with precision and firmness, and not tolerating any practices that violate media controls or the provisions of the audiovisual media system.
The General Authority for Media Regulation stressed its continued monitoring and follow-up operations to ensure an organized and attractive media environment that contributes to enhancing content quality in the Kingdom and protects the rights of licensees, thereby boosting the confidence of investors and the public. The Authority confirmed that obtaining a "Trusted" license requires compliance with the regulations related to individuals providing advertising content through social media platforms, as well as content and advertising regulations and classifications (including age classification) and instructions issued by the Authority. It also requires a commitment to provide any data, information, or reports requested by the Authority, to cease advertising any media content immediately without objection upon request, and to display any advertisement only through an account registered with the Authority and linked to the license granted to the licensee. Non-Saudis must commit to not engaging in the activity until they obtain the necessary licenses and approvals.
License for Non-Saudis
The Authority indicated that the license benefits Saudi individuals both inside and outside the Kingdom, and Gulf nationals can obtain commercial registrations and advertising licenses, while non-Gulf foreigners must obtain an individual license by contracting with a licensed local advertising agency or by obtaining an investment license in accordance with the regulations and rules. It is also permitted to register accounts under pseudonyms, and foreign advertising agencies have the right to deal with a licensed individual according to the regulations and rules; they must obtain a license before any contractual relationship.
To advertise specialized products or services such as "medications, treatments, and others," compliance with Article Five of the audiovisual media system and media content regulations is required.
The General Authority for Audiovisual Media had previously monitored violations by several non-Saudi advertisers (residents and visitors) on social media platforms. After verifying their data, it was found that there were regulatory violations, including "not obtaining commercial registrations or legal licenses and not operating under any commercial entity or foreign investment license."
5 Million Fine for Concealment
Lawyer Abdulaziz bin Dubshi confirmed to "Okaz" that hiring advertisers from outside the Kingdom or residents or visitors without obtaining a legal license is a clear violation of media and trade regulations, and it is monitored by regulatory bodies such as the Media Regulatory Authority. Penalties can reach fines or imprisonment in cases of concealment, and establishments must contract with advertisers who hold a "Trusted" license or operate under legal commercial entities in the Kingdom to ensure compliance with the regulations.
He explained that fines start from 100 riyals and can reach up to 500,000 riyals in some cases, and in cases of concealment, they can reach five million riyals. If a concealment crime is proven, the prison sentence can reach five years, and it also includes the suspension of activity and the advertiser's prohibition from advertising.
Bin Dubshi emphasized the necessity of contracting with legal entities and that the contract should be with advertisers who operate under commercial entities in the Kingdom and have legal licenses that authorize them to practice advertising.
He stressed that foreign advertisers are required to obtain the necessary permit, and they cannot engage in work without obtaining a license. Those who violate this expose themselves to accountability, whether as individuals or commercial establishments.
Advertisements Under Monitoring
The Saudi Chambers Federation called for the necessity of emphasizing to chamber members from traders and those in similar positions not to deal with individuals who are not licensed to advertise. The Anti-Concealment Law considers the practice of a non-Saudi engaging in economic activity for their own account in the Kingdom without a license as a "crime," punishable by penalties that can reach five years in prison and a fine of five million riyals.
