أصدر الرئيس الفلسطيني محمود عباس إعلاناً دستورياً يقضي بتولي نائب رئيس اللجنة التنفيذية لمنظمة التحرير الفلسطينية نائب رئيس دولة فلسطين مهمات رئاسة السلطة الوطنية مؤقتاً في حال شغور المنصب.
وأفاد الإعلان الدستوري، الذي أوردته وكالة الأنباء الفلسطينية (وفا) اليوم (الأحد)، بأن تولي نائب الرئيس لهذا المنصب لا تزيد مدته على 90 يوماً، تجرى خلالها انتخابات حرة ومباشرة لانتخاب رئيس جديد، وفقاً لقانون الانتخابات الفلسطيني. ولفت الإعلان إلى أنه في حال تعذر إجراء الانتخابات خلال تلك المدة لقوة قاهرة، تمدد بقرار من المجلس المركزي الفلسطيني لفترة أخرى، ولمرة واحدة فقط. وبموجب الإعلان الجديد، ألغى الرئيس الفلسطيني «الإعلان الدستوري رقم 1 لسنة 2024»، الذي كان ينص على أنه «إذا شغر مركز رئيس السلطة الوطنية في حالة عدم وجود المجلس التشريعي، يتولى رئيس المجلس الوطني الفلسطيني مهام رئاسة السلطة مؤقتاً، لمدة لا تزيد على 90 يوماً»، مع إمكانية التمديد «لمرة واحدة فقط».
وقال الرئيس الفلسطيني محمود عباس إن الإعلان الدستوري الجديد يأتي تأكيداً على مبدأ الفصل بين السلطات والتداول السلمي للسلطة عبر الانتخابات الحرة والنزيهة. ويرأس عباس منظمة التحرير والسلطة الفلسطينية منذ وفاة الرئيس السابق ياسر عرفات في عام 2004. وفي نهاية أبريل الماضي أقرت اللجنة التنفيذية لمنظمة التحرير الفلسطينية اقتراح الرئيس محمود عباس بتعيين أمين سر المنظمة حسين الشيخ نائباً لرئيس اللجنة التنفيذية للمنظمة، وهو منصب يجعله أيضاً نائباً لرئيس دولة فلسطين. وقدم أبو مازن ترشيحه للشيخ خلال اجتماع اللجنة التنفيذية، وفقاً لـ«قرار المجلس المركزي الفلسطيني بتاريخ 24 أبريل في دورته الـ32، الذي قرر استحداث منصب نائب رئيس اللجنة التنفيذية لمنظمة التحرير الفلسطينية رئيس دولة فلسطين وتعيينه، وبناءً على الصلاحيات المخولة له، فقد رشح حسين شحادة محمد الشيخ لهذا المنصب».
Palestinian President Mahmoud Abbas issued a constitutional declaration stipulating that the Deputy Chairman of the Executive Committee of the Palestine Liberation Organization, who is also the Vice President of the State of Palestine, will temporarily assume the duties of the presidency of the National Authority in the event of a vacancy in the position.
The constitutional declaration, reported by the Palestinian News Agency (Wafa) today (Sunday), stated that the Deputy President's tenure in this position shall not exceed 90 days, during which free and direct elections will be held to elect a new president, in accordance with Palestinian electoral law. The declaration noted that if it is impossible to conduct the elections within that period due to force majeure, the period may be extended by a decision from the Palestinian Central Council for one additional time only. Under the new declaration, the Palestinian president canceled "Constitutional Declaration No. 1 of 2024," which stipulated that "if the position of the President of the National Authority becomes vacant in the absence of the Legislative Council, the Chairman of the Palestinian National Council shall temporarily assume the duties of the presidency for a period not exceeding 90 days," with the possibility of extension "only once."
Palestinian President Mahmoud Abbas stated that the new constitutional declaration reaffirms the principle of separation of powers and the peaceful transfer of authority through free and fair elections. Abbas has chaired the PLO and the Palestinian Authority since the death of former President Yasser Arafat in 2004. At the end of April, the Executive Committee of the Palestine Liberation Organization approved President Mahmoud Abbas's proposal to appoint the Secretary-General of the organization, Hussein al-Sheikh, as the Deputy Chairman of the Executive Committee of the organization, a position that also makes him the Deputy President of the State of Palestine. Abu Mazen presented his nomination for al-Sheikh during the Executive Committee meeting, in accordance with "the decision of the Palestinian Central Council on April 24 during its 32nd session, which decided to create the position of Deputy Chairman of the Executive Committee of the Palestine Liberation Organization, President of the State of Palestine, and appoint him. Based on the powers granted to him, he nominated Hussein Shahada Muhammad al-Sheikh for this position."
