أحالت الهيئة العامة للغذاء والدواء منشأة مخالفة إلى النيابة العامة، وذلك لقيامها بتداول منتجات تجميلية والتلاعب بتواريخ صلاحيتها بموقع سكني، في مخالفة صريحة لنظام منتجات التجميل ولائحته التنفيذية.
وأوضحت «الغذاء والدواء» أنها ضبطت نحو 1.5 مليون عبوة من المنتجات التجميلية المخالفة في الموقع، وبناءً عليه تم إغلاق المنشأة وإحالتها للنيابة العامة، وذلك نظرًا لكون مثل هذا النوع من المخالفات يُمثل تهديدًا مباشرًا لصحة وسلامة المستهلك، وتنص المادة الحادية والثلاثون من نظام منتجات التجميل ولائحته التنفيذية على أنه «يُعد مخالفًا لأحكام هذا النظام كل من ارتكب أو شَرع في ارتكاب فعل أو أكثر من الأفعال الآتية: خَدَعَ أو غش في المنتج التجميلي، تداولَ منتجًا تجميليًا مغشوشًا أو فاسدًا أو منتهي الصلاحية أو مخالفًا لبياناته المدرجة، ويعاقب مرتكب مثل هذه المخالفات بالسجن لمدة لا تزيد على (5) سنوات، أو بغرامة مالية لا تزيد على (5,000,000) ريال، أو بهما معًا».
وشدّدت الهيئة على أهمية التقيد التام بالأنظمة واللوائح التنظيمية المعتمدة لزيادة معدلات السلامة والجودة في منتجات التجميل المتداولة في الأسواق السعودية، مؤكدةً في الوقت ذاته على استمرار جهودها في مكافحة كافّة أنواع الغش والتلاعب الذي يطال المنتجات الخاضعة لرقابتها، وإيقاع العقوبات الرادعة بحق مرتكبيها.
The General Authority for Food and Drug Administration has referred a violating establishment to the Public Prosecution for trading in cosmetic products and tampering with their expiration dates at a residential location, in clear violation of the Cosmetics Products System and its executive regulations.
The "Food and Drug" authority clarified that it seized approximately 1.5 million units of the violating cosmetic products at the site, and accordingly, the establishment was closed and referred to the Public Prosecution, as such violations pose a direct threat to consumer health and safety. Article thirty-one of the Cosmetics Products System and its executive regulations states that "anyone who commits or attempts to commit one or more of the following acts is considered in violation of the provisions of this system: deceiving or cheating in the cosmetic product, trading in a counterfeit, spoiled, expired, or non-compliant cosmetic product, and the perpetrator of such violations shall be punished with imprisonment for a period not exceeding (5) years, or a financial fine not exceeding (5,000,000) riyals, or both."
The authority emphasized the importance of full compliance with the approved regulations and organizational guidelines to increase safety and quality rates in cosmetic products traded in the Saudi markets, while also confirming its continued efforts to combat all forms of fraud and manipulation affecting the products under its supervision, and to impose deterrent penalties on the perpetrators.
