اعتمدت وزارة البلديات والإسكان، الاشتراطات البلدية لتقديم منتجات التبغ، بهدف تنظيم أنشطة تقديم هذه المنتجات وضمان الالتزام بمعايير السلامة والجودة، والحد من أضرار التدخين القسري على غير المدخنين.
وأوضحت الوزارة، في بيان لها، أن الاشتراطات تضمنت 4 محاور رئيسية تشمل متطلبات الترخيص، والمتطلبات المكانية، والمتطلبات الفنية، والمتطلبات التشغيلية، وتُطبّق على المحلات المرخص لها بتقديم منتجات التبغ المطابقة للمواصفات القياسية السعودية.
وبيّنت، أن متطلبات الترخيص نصّت على أن تكون إجراءات إصدار وتجديد وتعديل وإيقاف وإلغاء التراخيص وفقاً لنظام إجراءات التراخيص البلدية ولائحته التنفيذية، مع اشتراط وجود ترخيص تجاري سارٍ للنشاط الرئيسي.
7 عناصر للمتطلبات المكانية
وأضافت، أن المتطلبات المكانية شملت 7 عناصر رئيسية تتعلق بالنطاق العمراني داخل المدن وخارجها، والمناطق المحظورة، والمسافات المقررة بين مواقع النشاط والمساجد والمرافق التعليمية، إضافة إلى متطلبات المواقف والارتفاعات المسموح بها ونسب التشجير والتغطية، فضلاً عن اشتراطات خاصة بكل أمانة تتعلق بالحد الأدنى لعرض الشوارع المسموح بممارسة النشاط عليها.
وشددت الاشتراطات على منع استخدام الشعارات أو الصور الدعائية المرتبطة بمنتجات التبغ على اللوحات الخارجية والاكتفاء ببيانات النشاط الرئيسي، كما تضمنت المتطلبات الفنية معايير التهوية، ومواقع تخزين مستلزمات التبغ، وصالات التقديم، وأماكن تجهيز التبغ وموقد الفحم، إضافة إلى اشتراطات الأمن والسلامة.
وأكدت الوزارة، ضرورة حصر الموردين المعتمدين لتوريد منتجات التبغ وملحقاتها ضمن آلية موثقة يمكن الرجوع إليها أثناء أعمال التفتيش، مع منع بيع أو تقديم هذه المنتجات لمن تقل أعمارهم عن 18 عاماً، أو وفق ما يحدده نظام مكافحة التدخين.
The Ministry of Municipalities and Housing has adopted municipal requirements for the provision of tobacco products, aimed at regulating the activities related to these products and ensuring compliance with safety and quality standards, as well as reducing the harms of secondhand smoke on non-smokers.
The ministry clarified in a statement that the requirements include four main axes: licensing requirements, spatial requirements, technical requirements, and operational requirements, and they apply to shops licensed to offer tobacco products that comply with Saudi standard specifications.
It indicated that the licensing requirements stipulate that the procedures for issuing, renewing, modifying, suspending, and canceling licenses must be in accordance with the municipal licensing procedures system and its executive regulations, with the condition of having a valid commercial license for the main activity.
7 Elements of Spatial Requirements
It added that the spatial requirements included seven main elements related to the urban scope inside and outside cities, prohibited areas, the prescribed distances between activity locations and mosques and educational facilities, in addition to requirements for parking, allowable heights, and tree coverage ratios, as well as specific requirements for each municipality regarding the minimum width of streets permitted for conducting the activity.
The requirements emphasized the prohibition of using logos or promotional images associated with tobacco products on external signage, allowing only the main activity information. The technical requirements also included ventilation standards, storage locations for tobacco supplies, presentation halls, tobacco preparation areas, and charcoal stoves, in addition to security and safety requirements.
The ministry confirmed the necessity of listing approved suppliers for the provision of tobacco products and their accessories within a documented mechanism that can be referred to during inspection activities, while prohibiting the sale or provision of these products to individuals under the age of 18, or as determined by the anti-smoking system.
