أحالت الهيئة العامة للغذاء والدواء مؤسسة تجارية في مدينة الدمام إلى النيابة العامة، لارتكابها عددا من المخالفات تمثلت في تخزين مستحضرات صيدلانية منتهية الصلاحية بلغت كميتها أكثر من (150000) عبوة، إذ تم ضبطها وتحريزها قبل دخولها إلى الأسواق، إضافة إلى ممارسة نشاط التخزين للمستحضرات الصيدلانية قبل الحصول على ترخيص من الهيئة.
وتُمثل هذه المخالفات انتهاكا صريحا لأحكام نظام المنشآت والمستحضرات الصيدلانية والعشبية المعمول به في المملكة، إذ تنص الفقرة (2) من المادة الـ(34) منه، على «أن من باع، أو صرف، أو حاز مستحضرا صيدلانيا أو عشبيا مغشوشا، أو فاسدا، أو منتهي الصلاحية، أو غير مسجل بقصد الاتجار به، يعاقب بالسجن لمدة لا تزيد على (10) سنوات، أو بغرامة مالية لا تزيد على (10) ملايين ريال، أو بالعقوبتين معا».
وشدّدت الهيئة على أهمية التقيد بالأنظمة واللوائح التنظيمية المتّبعة؛ لتعزيز سلامة وجودة الأدوية والمستحضرات المتداولة في الأسواق السعودية، وأن مثل هذه المخالفات من شأنها أن تشكل خطرا مباشرا على صحة وسلامة المستهلك، وتستدعي اتخاذ الإجراءات القانونية الرادعة، مؤكدة أنها لن تتوانى في ملاحقة المخالفين، ومن يعرّضون أدوية المرضى إلى الخطر.
ودعت «الغذاء والدواء» أفراد المجتمع إلى التعاون في الإبلاغ عن أي مخالفات يتم رصدها في المنشآت الخاضعة لإشرافها، من خلال الاتصال على الرقم الموحد (19999)، حرصا على حماية الصحة العامة، مع تجديد التزامها بمواصلة جهودها الرقابية لمكافحة كافة أنواع المخالفات والتجاوزات التي تطال المنتجات الخاضعة لإشرافها، وتطبيق العقوبات النظامية بحق مرتكبيها.
The General Authority for Food and Drug has referred a commercial establishment in Dammam to the Public Prosecution for committing several violations, which included the storage of expired pharmaceutical products amounting to more than (150,000) units. These products were seized and secured before entering the markets, in addition to engaging in the storage of pharmaceutical products without obtaining a license from the authority.
These violations represent a clear infringement of the provisions of the Pharmaceutical and Herbal Products Establishments System in force in the Kingdom, as paragraph (2) of Article (34) states, "Anyone who sells, dispenses, or possesses a counterfeit, spoiled, expired, or unregistered pharmaceutical or herbal product for the purpose of trading shall be punished by imprisonment for a term not exceeding (10) years, or by a fine not exceeding (10) million riyals, or by both penalties together."
The authority emphasized the importance of adhering to the applicable regulations and organizational rules to enhance the safety and quality of medicines and products circulating in Saudi markets, noting that such violations could pose a direct risk to the health and safety of consumers, necessitating strict legal measures. It affirmed that it will not hesitate to pursue violators and those who endanger patients' medications.
The "Food and Drug" Authority called on members of the community to cooperate in reporting any violations observed in the establishments under its supervision by calling the unified number (19999), in order to protect public health, reiterating its commitment to continue its regulatory efforts to combat all types of violations and transgressions affecting the products under its supervision and to apply the legal penalties against the offenders.
