The executive regulation of the enforcement system has set controls to prevent the debtor from traveling, disclose their assets, track them, and seize them, while considering the adequacy of housing and means of transportation for them and their dependents, and organizing the procedures for the voluntary sale of seized assets and appealing executive decisions. The regulation considered the total debt or debts subject to enforcement as minor amounts for the purposes of lifting the travel ban, provided that the value of what has not been fulfilled does not exceed 50,000 riyals.
It stipulated that to issue an order preventing the debtor from traveling outside the Kingdom, there must be an inability to seize assets sufficient to fulfill the right subject to the executive document, or the existence of an obstacle preventing fulfillment from them, while verifying the conditions of the ban and its effect on compelling the debtor to fulfill.
The travel ban automatically expires, and the regulation stated that the travel ban order expires without the need to submit a request, upon the completion of the enforcement request or the expiration of the ban period, unless an order to extend it is issued before its expiration. It also allowed the debtor to submit a request to lift the ban, which must be communicated to the enforcement requester, and it should be decided urgently. The means of verifying that the debtor's profession, trade, or job necessitates travel include a certificate from the employer or the relevant professional body, as well as proof that the ban would result in harm exceeding the usual impact on them.
Disclosure within 5 working days
The regulation required the debtor to disclose their assets within five working days from the date they are notified of the enforcement order, ensuring that the disclosure includes their unregistered assets, those located outside the Kingdom, and what they have with others.
The creditor is obligated to notify the debtor, or their representative, of the request for payment of the right at least five working days before filing the enforcement request in specific cases; including agreement on the necessity of notification, or if the debtor is a private legal entity, or their death or lack of capacity or its reduction before filing the request, or if the right is deferred at the time of creating the document, provided that the notification occurs after the due date.
It exempted from notification the right that represents a recurring obligation if a request for its enforcement has been previously filed.
90 days to deposit the tracking report
The regulation organized the tracking of the debtor's assets, requiring a deadline for depositing the tracking report not exceeding 90 days from the date of the order, with the possibility of extending it for a similar period if necessary. If the service provider does not deposit their report within the specified period, the tracking may be assigned to another based on the request of the enforcement requester.
It allowed the tracking order to include a field inspection to uncover the assets owned by the debtor or used in a way that raises suspicion about their ownership, without including access to closed sites or opening what is locked or sealed.
It obligated anyone who has access to the data and information to maintain its confidentiality and not to use it for purposes other than the specified one or disclose it without a legal reason, while gradually proceeding with the tracking procedures until the purpose is achieved, without prejudice to the interest of enforcement.
Considering the adequacy of housing and transportation
In estimating the adequacy of housing and means of transportation, the regulation required considering the number of dependents of the debtor, their health and social conditions, and the usual level for someone in their situation regarding housing and means of transportation.
If enforcement is carried out on the house or means of transportation for exceeding the adequacy amount, an amount sufficient for the debtor to purchase a substitute that achieves adequacy will be allocated from the sale proceeds.
The court's permission is required to enter the residence if the seizure of the asset necessitates entry, and it required that when evacuating residences, the sanctity of the family is preserved, facilitating the departure of women, children, the elderly, and persons with disabilities, while ensuring that enforcement procedures are not hindered.
60 days for voluntary sale
The regulation allowed enabling the debtor to sell their assets voluntarily whenever it is proven that this serves the interest of enforcement, with the duration of enabling being determined according to the nature of the asset, not exceeding 60 days from the date of the decision.
It set a deadline for the buyer brought by the debtor to deposit the full price not exceeding 30 days from the date of approval of the sale, and the sale is considered void if the price is not deposited within the specified period, and the procedures for compulsory sale are completed according to the cases stipulated in the regulation.
Appeal and lifting procedures
The regulation specified the orders and decisions that can be appealed, including the imposition or lifting of a seizure, estimating the adequacy of housing and means of transportation, the travel ban or its lifting or extension or re-imposition, imprisonment or its extension, the fines specified in the system, and expanding the time frame for tracking.
It required resolving enforcement disputes within a period not exceeding 15 working days from the date they are referred to the court, unless necessity dictates otherwise.
It stated that the enforcement request ends as soon as the right is fulfilled through its procedures, and if the right is fulfilled by other means, the enforcement requester must terminate their request within one working day from the date of fulfillment. The termination of the request results in the immediate lifting of all procedures and executive orders associated with it, without the need for a request.
