طرحت وزارة الموارد مشروعاً لتحديث جدول المخالفات والعقوبات الخاصة بنظام العمل ولائحته التنفيذية، أبرزها تغليظ العقوبات على ممارسة أنشطة الاستقدام أو التوظيف دون ترخيص، لتصل إلى 250,000 ريال، وتعليق الترخيص لمدة تصل إلى 6 أشهر.
وشمل الجدول الجديد للمخالفات والعقوبات تصنيفاً واضحاً بين المخالفات الجسيمة التي تمس حقوق العمال أو تمثل خطورة مباشرة على بيئة العمل، وغير الجسيمة، مع تحديد الغرامات وفقاً لفئات المنشآت الثلاث، وهي الفئة «ج»: 20 عاملاً فأقل، والفئة «ب»: من 21 إلى 49 عاملاً، والفئة «أ»: 50 عاملاً فأكثر.
ونص المشروع على تعزيز بيئة العمل وضمان الالتزام بأعلى معايير السلامة والصحة المهنية، وأقرت عقوبات مالية صارمة تبدأ من 1,500 ريال للفئة «ج» وتصل إلى 5,000 ريال للفئة «أ» بحق أصحاب العمل الذين يتجاهلون قواعد الحماية أو يهملون اتخاذ الاحتياطات اللازمة للحفاظ على سلامة العاملين، مع تحميلهم المسؤولية الكاملة عن أي حوادث. وحثت التعديلات على توفير إرشادات السلامة والصحة بلغات يفهمها العمال، على أن تكون العربية والإنجليزية موجودة، وفي حال الإخلال تفرض غرامة تراوح بين 300 و1,000 ريال، ومعاقبة العمال المخالفين للتعليمات الوقائية بـ300 ريال تتعدد بتعدد المخالفين، وفرضت غرامات تصل إلى 1,000 ريال على المنشآت الكبيرة في حال الإخلال بمتطلبات الوقاية من الحرائق، إضافة إلى 1,000 ريال عن كل عامل يتم تشغيله تحت أشعة الشمس أو في ظروف مناخية سيئة دون احتياطات.
وأوجب نظام العمل، توفير خزانة إسعافات أولية، والمخالف يعاقب بغرامة قد تصل إلى 1,000 ريال، كما نصت على ضرورة توفير التأمين الطبي للعامل وأسرته، وتصل الغرامة في المنشآت الكبرى إلى 1,000 ريال عن كل عامل محروم من هذا الحق، وفرضت غرامات مشددة على من يشغل الأطفال دون سن الـ15، تراوح بين 1,000 ريال للفئة «ج» و2,000 ريال للفئة «أ» عن كل حالة، ومعاقبة المنشآت غير الملتزمة بأحكام تشغيل الأحداث المنصوص عليها في نظام العمل بغرامات تصل إلى 1,500 ريال.
وفي شأن المرأة العاملة، نص جدول المخالفات والعقوبات على غرامة 1,000 ريال على المنشآت التي لا تلتزم بإجازة الوضع، والزام المنشآت التي تضم 50 عاملة فأكثر بتوفير مكان لرعاية الأطفال أو دار حضانة في حال بلغ عدد الأطفال دون سن الـ16، 10 أطفال فأكثر، مع غرامة قدرها 3,000 ريال على المخالفين.
وشددت التحديثات على التزام المنشآت بزي واضح للعاملين يتناسب مع طبيعة العمل، ويؤمن مظهراً مهنياً لائقاً، مع فرض غرامة تراوح بين 300 و1,000 ريال على غير الملتزمين.
ومن التحديثات المقترحة لنظام العمل ولائحته التنفيذية ما يتعلق بالعمل الليلي، وفرضت عقوبات على عدم الالتزام بضوابطه، تصل إلى 300 ريال عن كل عامل مخالف، وشددت العقوبة على تشغيل الفئات المستثناة ليلاً لتصل إلى 500 ريال عن كل حالة.
التأخير في الأجور وحجزها
لم تغفل الوزارة تحديث مخالفاتها فيما يتعلق بتوظيف غير السعوديين، وفرضت غرامة 10,000 ريال عن كل عامل يتم تشغيله دون رخصة عمل، أو ترك العامل يعمل لدى الغير أو لحسابه الخاص. كما شددت على معاقبة المنشآت التي تشغل عمالة غير سعودية في مهن مقصورة على السعوديين، وتصل الغرامة إلى 8,000 ريال عن كل عامل في الفئة «أ»، وغلظت العقوبات على مخالفة نسب التوطين المقررة، إذ تصل الغرامة إلى 6,000 ريال عن كل عامل غير سعودي يتجاوز النسبة المحددة في المنشآت الكبيرة.
ولضمان الحقوق المالية للعاملين، تم فرض غرامة تصل إلى 3,000 ريال عن كل عامل في حال تأخر صاحب العمل في دفع الأجور أو حجزها دون مبرر نظامي، كما ألزمت المنشآت برفع ملفات حماية الأجور بشكل شهري، لتجنب غرامة تصل إلى 2,000 ريال عند الإخلال بهذا الالتزام.
ومن ضمن التحديث المقترح غرامة تصل إلى 3,000 ريال عن كل عامل عند الامتناع عن صرف المستحقات المالية بعد انتهاء العلاقة التعاقدية، إضافة إلى غرامات مماثلة على المنشآت التي تمتنع عن تسليم شهادة الخدمة أو تقوم باحتجاز الوثائق الرسمية للعاملين.
ما عقوبة عدم توثيق العقود؟
عدم توثيق العقود إلكترونياً وصلت غرامته في التحديث إلى 1,000 ريال عن كل عامل، وعلى تسجيل سعودي دون علاقة عمالية فعلية غرامة 8,000 ريال عن كل حالة.
وألزمت الوزارة المنشآت بالإعلان عن ضوابط الحماية من التعديات السلوكية والتحقيق فيها، وراوحت الغرامات بين 500 و3,000 ريال بحسب حجم المنشأة وعدد المتضررين، كما شملت العقوبات حالات التمييز بين العاملين بسبب الجنس أو السن أو الإعاقة، وتصل الغرامة إلى 3,000 ريال عن كل حالة في المنشآت الكبيرة.
وألزمت التحديثات المنصات الإلكترونية التشاركية بعدد من الضوابط، وفرضت غرامة قدرها 3,000 ريال عن كل عامل في حال تمكين عامل غير سعودي من العمل بشكل مباشر عبر المنصة، مع مضاعفة العقوبة بتعدد الحالات، ومعاقبة المنشآت التي لا تسجل على منصة الوزارة المخصصة بغرامة تصل إلى 5,000 ريال عن كل عامل، وشملت العقوبات أيضاً عدم مشاركة البيانات المطلوبة أو تقديم بيانات غير مكتملة، وتبلغ الغرامة 3,000 ريال.

The Ministry of Human Resources has proposed a project to update the table of violations and penalties related to the labor system and its executive regulations, the most notable of which is the increase in penalties for practicing recruitment or employment activities without a license, reaching up to 250,000 Riyals, and suspending the license for up to 6 months.
The new table of violations and penalties includes a clear classification between serious violations that affect workers' rights or pose a direct danger to the work environment, and non-serious violations, with fines specified according to the three categories of establishments: Category "C": 20 workers or fewer, Category "B": from 21 to 49 workers, and Category "A": 50 workers or more.
The project stipulates enhancing the work environment and ensuring compliance with the highest standards of safety and occupational health, and it has established strict financial penalties starting from 1,500 Riyals for Category "C" and reaching up to 5,000 Riyals for Category "A" against employers who ignore safety rules or neglect to take necessary precautions to maintain the safety of workers, holding them fully responsible for any accidents. The amendments urge the provision of safety and health guidelines in languages understood by workers, with Arabic and English being mandatory, and in case of violation, a fine ranging between 300 and 1,000 Riyals is imposed, along with penalizing workers who violate preventive instructions with 300 Riyals, multiplied by the number of violators. Fines of up to 1,000 Riyals are imposed on large establishments in case of non-compliance with fire prevention requirements, in addition to 1,000 Riyals for each worker employed under direct sunlight or in poor weather conditions without precautions.
The labor system requires the provision of a first aid kit, and violators are subject to a fine of up to 1,000 Riyals. It also stipulates the necessity of providing medical insurance for workers and their families, with fines in large establishments reaching 1,000 Riyals for each worker deprived of this right. Strict fines have been imposed on those employing children under the age of 15, ranging from 1,000 Riyals for Category "C" to 2,000 Riyals for Category "A" for each case, and penalizing establishments that do not comply with the provisions for employing minors as stipulated in the labor system with fines of up to 1,500 Riyals.
Regarding working women, the table of violations and penalties includes a fine of 1,000 Riyals for establishments that do not comply with maternity leave, and requires establishments with 50 or more female workers to provide a childcare area or nursery if the number of children under 16 reaches 10 or more, with a fine of 3,000 Riyals for violators.
The updates emphasize the obligation of establishments to provide a clear uniform for workers that is appropriate for the nature of the work and ensures a decent professional appearance, with fines ranging between 300 and 1,000 Riyals for non-compliance.
Among the proposed updates to the labor system and its executive regulations are those related to night work, imposing penalties for non-compliance with its regulations, reaching 300 Riyals for each violating worker, and intensifying the penalty for employing exempt categories at night to reach 500 Riyals for each case.
Delay in wages and withholding them
The ministry did not overlook updating its violations regarding the employment of non-Saudis, imposing a fine of 10,000 Riyals for each worker employed without a work permit, or allowing the worker to work for others or for their own account. It also emphasized punishing establishments that employ non-Saudi workers in professions restricted to Saudis, with fines reaching 8,000 Riyals for each worker in Category "A", and intensified penalties for violating the prescribed localization ratios, with fines reaching 6,000 Riyals for each non-Saudi worker exceeding the specified ratio in large establishments.
To ensure the financial rights of workers, a fine of up to 3,000 Riyals is imposed for each worker if the employer delays or withholds wages without a legal justification. Establishments are also required to submit wage protection files monthly to avoid a fine of up to 2,000 Riyals for non-compliance with this obligation.
Among the proposed updates is a fine of up to 3,000 Riyals for each worker for refusing to pay financial entitlements after the termination of the contractual relationship, in addition to similar fines for establishments that refuse to issue a service certificate or retain the official documents of workers.
