شدّدت وزارة البلديات على مواجهة مخالفات تقديم قوائم مالية أو بيانات مشاريع مزورة أو مضللة من المقاولين، وحذّرتهم من عقوبات تبدأ بإيقاف شهادة التصنيف لمدة ستة أشهر، وتتصاعد مع التكرار حتى تصل إلى إلغاء الشهادة والمنع من التقديم لمدة ثلاث سنوات، إضافة إلى الإلغاء الفوري في حالة تزوير شهادة التصنيف.
جاء ذلك ضمن مشروع تحديث جدول تصنيف مخالفات المقاولين وتحديد العقوبات المطروحة حاليّاً عبر منصة «استطلاع»، الذي يهدف إلى تعديل جدول العقوبات الصادر في 29/11/1444. وإلى جانب مخالفات البيانات المزورة، يتضمن الجدول الجديد معاقبة عدم تحديث البيانات القانونية للمنشأة- مثل الاسم التجاري أو السجل أو رأس المال- بإنذار لمدة 30 يوماً، يعقبه إيقاف الشهادة حتى استكمال التحديث، ويعاقب عدم التعاون مع المفتشين أو تعطيل مهامهم بإيقاف طلب التصنيف أو الشهادة حتى إتمام الزيارة التفتيشية، مع استمرار الإيقاف إذا لم تُستكمل الإجراءات.
ويؤدي عدم صحة بيانات الكوادر الإدارية أو الفنية إلى تخفيض درجة التصنيف إلى الدرجة الفعلية، ومع التكرار يضاف إيقاف لمدة سنة، ثم سنتين، وصولاً إلى الإلغاء الكامل عند التكرار الرابع.
وفي حالة عدم الإفصاح عن عقود مقاولي الباطن وقيمتها، تتدرج العقوبات من إيقاف التصنيف لثلاثة أشهر، ثم ستة أشهر، وبعدها سنتين، وصولاً إلى الإلغاء الكامل والمنع لثلاث سنوات، وعدم الإفصاح عن المشاريع المسحوبة خلال آخر ثلاث سنوات يعاقب بتخفيض درجة التصنيف درجة واحدة مع الإيقاف لمدة سنة، ثم سنتين، ثم ثلاث سنوات، وأخيراً الإلغاء النهائي.
ويعاقب تقديم بيانات غير صحيحة لرخصة السكن الجماعي للمنشآت، التي تضم 20 عاملاً فأكثر، بنفس تدرج عقوبات بند المشاريع المسحوبة من التخفيض والإيقاف إلى الإلغاء الكامل.
وتنص اللائحة على أن المخالفات الجسيمة بالمشاريع تُعاقب وفق جسامتها، بدءاً من إيقاف أو تخفيض درجة التصنيف وحتى الإلغاء النهائي للشهادة.

The Ministry of Municipalities emphasized the need to confront violations related to the submission of fraudulent or misleading financial statements or project data by contractors. It warned them of penalties starting with the suspension of the classification certificate for six months, escalating with repeated offenses until it reaches the cancellation of the certificate and a ban on applying for three years, in addition to immediate cancellation in the case of certificate forgery.
This came as part of the project to update the classification table of contractor violations and specify the penalties currently proposed through the "Survey" platform, which aims to amend the penalties table issued on 29/11/1444. Alongside violations of fraudulent data, the new table includes penalties for failing to update the legal data of the establishment—such as the trade name, registration, or capital—with a warning for 30 days, followed by the suspension of the certificate until the update is completed. Non-cooperation with inspectors or obstructing their tasks will result in the suspension of the classification or certificate request until the inspection visit is completed, with the suspension continuing if the procedures are not finalized.
Providing incorrect data about administrative or technical staff will lead to a reduction of the classification degree to the actual degree, and with repeated offenses, a suspension will be added for one year, then two years, reaching complete cancellation upon the fourth repetition.
In cases of failing to disclose subcontractor contracts and their values, penalties range from a three-month suspension of classification, then six months, followed by two years, culminating in complete cancellation and a three-year ban. Not disclosing projects withdrawn in the last three years will result in a one-degree reduction in classification along with a one-year suspension, then two years, then three years, and finally permanent cancellation.
Submitting incorrect data for the collective housing license for establishments with 20 or more workers will incur penalties similar to those for the withdrawn projects, ranging from reduction and suspension to complete cancellation.
The regulation stipulates that serious violations in projects will be punished according to their severity, starting from suspension or reduction of the classification degree up to the complete cancellation of the certificate.
