شددت وزارة العدل على تعزيز العدالة الوقائية، من خلال تحويل مزيد من العقود إلى عقود إلكترونية موثقة، ومنحها حجيتها التنفيذية.
وتعد العدالة الوقائية من أهم مراحل تحقيق العدالة، كونها حمائية لا تقتصر على تحقيق العدالة أثناء الفصل في المنازعات، وإنما تهدف إلى تحقيقها قبل نشوء النزاع من خلال عقود موثقة تحفظ حقوق الأطراف وتحميها، بحسب مختصين. كما تمنحها حجيتها التنفيذية، وليتم اقتضاؤها بشكل ناجز من خلال المسارات والخدمات الإلكترونية.
وتشمل قائمة العقود الإلكترونية الموثقة حالياً عقد إيجار السكني التابع لوزارة الشؤون البلدية والقروية والإسكان، وعقد الإنشاء الكامل التابع للهيئة السعودية للمقاولين، وعقد تأجير السيارات التابع للهيئة العامة للنقل، والعقد الموحد لتسجيل الطلاب في المدارس الخاصة التابع لوزارة التعليم.
وتعمل وزارة العدل على عدة إجراءات قبل تحويل العقود إلى إلكترونية موثقة، ومن ذلك حصر أسباب النزاع في المحاكم، ودراسة النزاعات وتحليلها، وتحديد أسباب نشوئها، ووضع المعالجات الإجرائية والتعاقدية المناسبة؛ بما يسهم في إثبات وحفظ الحقوق والالتزامات، وخلق المسارات العدلية والتقنية الناجزة لاقتضاء تلك الحقوق ومنحها حجيتها التنفيذية.
ومن الإجراءات التي تتخذها وزارة العدل التعاون مع الجهات التي لها دور في تعزيز قيم العدالة الوقائية، ودراسة أسباب زيادة عدد الدعاوى وتحليلها والوضع الراهن في مجال الوساطة والتحكيم ودورها في تعزيز العدالة الوقائية.
وكان وزير العدل الدكتور وليد بن محمد الصمعاني قد أطلق المرحلة الثانية من مبادرة العدالة الوقائية، والتي تشمل العمل على تحويل مزيد من العقود إلى إلكترونية وموثقة، وعدداً من المشروعات التي تسهم في تعزيز قيم العدالة والشفافية، وتحقيق العدالة الناجزة، والأمن المجتمعي، والحد من النزاعات القضائية.
The Ministry of Justice emphasized the enhancement of preventive justice by converting more contracts into authenticated electronic contracts and granting them executive validity.
Preventive justice is considered one of the most important stages in achieving justice, as it is protective and does not only aim to achieve justice during the resolution of disputes, but also seeks to accomplish it before a dispute arises through authenticated contracts that preserve and protect the rights of the parties, according to specialists. It also grants them executive validity, allowing for their enforcement efficiently through electronic pathways and services.
The current list of authenticated electronic contracts includes the residential lease contract affiliated with the Ministry of Municipal and Rural Affairs and Housing, the full construction contract affiliated with the Saudi Contractors Authority, the car rental contract affiliated with the Public Transport Authority, and the unified contract for student registration in private schools affiliated with the Ministry of Education.
The Ministry of Justice is working on several procedures before converting contracts into authenticated electronic ones, including identifying the causes of disputes in courts, studying and analyzing disputes, determining their origins, and establishing appropriate procedural and contractual remedies; all of which contribute to proving and preserving rights and obligations, and creating efficient judicial and technical pathways for enforcing those rights and granting them executive validity.
Among the measures taken by the Ministry of Justice is cooperation with entities that play a role in promoting the values of preventive justice, studying the reasons for the increase in the number of lawsuits, analyzing them, and assessing the current situation in the field of mediation and arbitration and their role in enhancing preventive justice.
The Minister of Justice, Dr. Walid bin Mohammed Al-Samaani, launched the second phase of the preventive justice initiative, which includes working on converting more contracts into authenticated electronic ones, along with several projects that contribute to promoting the values of justice and transparency, achieving expedited justice, community security, and reducing judicial disputes.
