أصدر وزير العدل الدكتور وليد الصمعاني، قراراً بالموافقة على اللائحة التنفيذية لنظام التنفيذ، الصادر بالمرسوم الملكي رقم (م/237)، ونُشرت في الجريدة الرسمية (أم القرى)، على أن يبدأ العمل بها بالتزامن مع سريان النظام في 29 أكتوبر 2026.
وتشتمل اللائحة على (54) مادة تنظم إجراءات التنفيذ ومددها وضوابطها، بما يعزز كفاءة استيفاء الحقوق، ويحافظ على الضمانات المقررة للدائن والمدين.
كما تحدد اللائحة إجراءات تنفيذ أحكام النفقة والحضانة والزيارة، وشروط تسجيل الكمبيالات والسندات لأمر في المنصات الإلكترونية المعتمدة، والأوامر والقرارات التي يجوز التظلم منها.
وتأتي اللائحة تنفيذاً لأحكام نظام التنفيذ، بما يحقق التوازن بين حقوق الأطراف والتزاماتهم.
The Minister of Justice, Dr. Walid Al-Samaani, issued a decision approving the executive regulations for the Enforcement System, issued by Royal Decree No. (M/237), which were published in the official gazette (Um Al-Qura), with the regulations set to take effect concurrently with the enforcement of the system on October 29, 2026.
The regulations include (54) articles that organize the procedures, timelines, and controls for enforcement, enhancing the efficiency of rights recovery while maintaining the guarantees established for creditors and debtors.
Additionally, the regulations specify the procedures for enforcing rulings on alimony, custody, and visitation, the conditions for registering promissory notes and bills of exchange on approved electronic platforms, and the orders and decisions that can be challenged.
The regulations are issued in implementation of the provisions of the Enforcement System, achieving a balance between the rights and obligations of the parties involved.
