The provisions for adjusting government contract prices allow contractors, companies, and institutions contracting with government entities to request a modification of contract values when certain costs rise after the submission of the bid, provided that these entities meet the regulatory conditions and can substantiate the increase. The mechanism also works in the opposite direction by reducing the contractor's dues if prices or fees decrease.
The cases that permit re-pricing include adjustments to customs tariffs, fees, or taxes, in addition to changes in the prices of materials or services or items related to the contract, whether rising or falling, after the date of bid submission. Contracts with a fixed profit margin are excluded from this.
The provisions set a key threshold for adjusting prices related to materials and services, requiring that the change results in an increase in the total contract cost by more than 3%. As for increases resulting from adjustments to customs tariffs, fees, or taxes, they are compensated for by the same amount of change without being bound by the percentage, provided that the contractor proves that they actually bore that increase.
Conversely, if fees, taxes, or item prices decrease, the amount of the difference is deducted from the contractor's dues, unless it is proven that they previously paid it according to the higher categories before the reduction, making the adjustment mechanism a tool to protect both parties, not just a means of compensating the contractor.
The provisions stipulate that the increase should not result from the contractor's delay in execution unless they prove that the delay occurred due to reasons beyond their control, and that the decision to adjust fees or taxes or the change in prices was not issued after the expiration of the specified period for contract execution.
To regulate re-pricing, the provisions established an order of references that the government entity relies on, starting with the official reference prices in Saudi Arabia, then the average annual price issued by the General Authority for Statistics, followed by estimated costs for unified purchasing, market prices, then prices of similar government contracts, and finally specialized international platforms.
The adjustment is calculated based on the difference between the item price at the time of bidding and its actual price at the time of execution, with the government entity required to document the reasons for transitioning from one price reference to another when it is not possible to rely on the higher-ranked source.
The provisions also set a timeline for claims; the contractor must submit their request supported by documents before the final receipt, and the consultant is granted 15 working days to study it. The claim is then reviewed by the government entity and the specialized committee within 30 working days before being raised to the committee stipulated in Article 86 to issue a decision within 45 days of the completion of the request.
