حظرت القواعد الموحدة لملاك العقارات المشتركة بدول مجلس التعاون إجراء أي تعديلات أو تغييرات على الهيكل أو المظهر الخارجي للوحدة أو أي جزء جوهري من العقار المشترك إلا بعد الحصول على موافقة اتحاد أو جمعية الملاك، مع تحميل المخالف مسؤولية إصلاح الأضرار الناتجة عن تلك التعديلات على نفقته الخاصة.
كما نصت القواعد التي اعتمدها مجلس الوزراء أخيراً على تنظيم إدارة الأجزاء المشتركة وصيانة المباني الخاصة بالعقارات ومنح كل دولة الحق في استثناء بعض المناطق أو العقارات، كما أكدت القواعد أن يكون لكل اتحاد أو جمعية ملاك نظام أساسي ينظم إدارة العقار المشترك وآلية الانتفاع به، على أن يعتمد من الجهة المختصة قبل دخوله حيز النفاذ بما لا يتعارض مع التشريعات الوطنية.
وشملت القواعد المعتمدة ترتيبات تنظيم مكونات الوحدات العقارية والأجزاء المشتركة، وحدود ملكية الحصص فيها، وآليات تقسيم الوحدات المملوكة لأكثر من شخص، وتنظيم تأجير الوحدات، وحقوق وواجبات المستأجرين على أن يكون التأمين على العقار المشترك وفق الإجراءات المعمول بها في كل دولة.
وتتولى الجهات المختصة إنشاء سجل خاص للعقارات المشتركة، تُقيد فيه بيانات العقارات وفق الإجراءات المعمول بها، مع إتاحة إصدار الشهادات والمستندات المتعلقة بالوحدات، وتمكين ذوي المصلحة من الاطلاع على السجل وفق الأنظمة المعتمدة.
يشار إلى أن القواعد المعتمدة تهدف إلى تنظيم إدارة العقارات المشتركة في دول التعاون، وتعزيز كفاءة صيانتها، وتحديد حقوق الملاك والمنتفعين والتزاماتهما، بما يتوافق مع التشريعات الوطنية في كل دولة.
The unified regulations for owners of common properties in the Gulf Cooperation Council countries prohibit any modifications or changes to the structure or exterior appearance of the unit or any essential part of the common property without obtaining the approval of the owners' union or association, holding the violator responsible for repairing any damages resulting from those modifications at their own expense.
The regulations recently approved by the Council of Ministers also stipulate the organization of the management of common parts and the maintenance of buildings related to properties, granting each country the right to exempt certain areas or properties. The regulations further emphasize that each owners' union or association must have a charter that governs the management of the common property and the mechanism for its utilization, which must be approved by the competent authority before coming into effect, provided it does not conflict with national legislation.
The approved regulations included arrangements for organizing the components of real estate units and common parts, the limits of ownership shares in them, mechanisms for dividing units owned by more than one person, organizing the leasing of units, and the rights and obligations of tenants, with the insurance on the common property to be in accordance with the procedures in place in each country.
The competent authorities are responsible for creating a special register for common properties, in which the data of the properties is recorded according to the applicable procedures, allowing for the issuance of certificates and documents related to the units, and enabling interested parties to access the register according to the approved regulations.
It is worth noting that the approved regulations aim to organize the management of common properties in the cooperation countries, enhance the efficiency of their maintenance, and define the rights and obligations of owners and beneficiaries, in accordance with national legislation in each country.
