رصدت هيئة الغذاء والدواء قيام بعض المنشآت بتداول أو إعادة بيع أجهزة ومستلزمات طبية مستخدمة من خلال المزادات التابعة للمنشآت الصحية أو أي من المزادات الأخرى دون الالتزام بالضوابط والشروط المنظمة لإعادة بيع الأجهزة الطبية المستخدمة أو إعارتها أو التبرع بها.
وحذرت من هذه الممارسات التي تتضمن مخاطر قد تؤثر على سلامة وكفاءة الأجهزة والمستلزمات الطبية، مشددة على أهمية التزام جميع المنشآت بما نصت عليه أحكام القانون، وأنه سيتم اتخاذ الإجراءات النظامية حيال أي ممارسات مخالفة. وأشارت الهيئة إلى دورها الرقابي على الأجهزة والمستلزمات الطبية للتحقق من سلامتها وكفاءتها، ومدى مطابقتها لمتطلبات واشتراطات الهيئة واللوائح الفنية المعتمدة.
وبينت الهيئة أن المادة 20 من نظام الأجهزة والمستلزمات الطبية نصت على أنه لا يجوز إتلاف الأجهزة أو المستلزمات الطبية المستخدمة، ولا إعادة معالجتها، ولا تجديدها، ولا إعادة بيعها، ولا إعارتها، ولا التبرع بها؛ إلا وفقًا للشروط التي تحددها اللائحة.
كما شددت اللائحة التنفيذية لنظام الأجهزة والمستلزمات الطبية أن من شروط إعادة بيع الأجهزة الطبية المستخدمة أو إعارتها أو التبرع بها أن يكون الجهاز الطبي والمراد إعادة بيعه أو إعارته أو التبرع به حاصلاً على إذن بالتسويق، ويمنع إعادة البيع أو الإعارة أو التبرع بالأجهزة الطبية التي يمكن أن تكون مصدراً لنقل العدوى، مع إخطار الهيئة عند القيام بإجراء إعادة البيع أو الإعارة أو التبرع للأجهزة الطبية وفقاً لمتطلبات رقابة ما بعد التسويق للأجهزة والمستلزمات الطبية، وإخطار المصنع أو ممثله المعتمد بعملية إعادة البيع أو الإعارة أو التبرع بالجهاز الطبي، مع تزويد الطرف المستلم للجهاز الطبي المعاد بيعه أو المعار أو المتبرع به بجميع الوثائق الفنية التي تثبت استيفاء الجهاز لمتطلبات الهيئة بما في ذلك تقارير الصيانة الدورية وكفاءة الأداء.
The Food and Drug Authority has observed that some establishments are trading or reselling used medical devices and supplies through auctions affiliated with health establishments or any other auctions without adhering to the regulations and conditions governing the resale, loan, or donation of used medical devices.
It warned against these practices, which pose risks that may affect the safety and efficiency of medical devices and supplies, emphasizing the importance of all establishments complying with the provisions of the law, and that legal actions will be taken against any violations. The authority pointed out its supervisory role over medical devices and supplies to ensure their safety and efficiency, and their compliance with the authority's requirements and the approved technical regulations.
The authority clarified that Article 20 of the Medical Devices and Supplies Regulation states that used medical devices or supplies may not be destroyed, reprocessed, renewed, resold, loaned, or donated; except in accordance with the conditions specified by the regulation.
Moreover, the executive regulation of the Medical Devices and Supplies System emphasized that one of the conditions for reselling, loaning, or donating used medical devices is that the medical device intended for resale, loan, or donation must have marketing authorization. The resale, loan, or donation of medical devices that may be a source of infection transmission is prohibited, and the authority must be notified when reselling, loaning, or donating medical devices in accordance with post-marketing surveillance requirements for medical devices and supplies, and the manufacturer or its authorized representative must be informed about the resale, loan, or donation of the medical device, along with providing the recipient of the resold, loaned, or donated medical device with all technical documents proving that the device meets the authority's requirements, including periodic maintenance reports and performance efficiency.
