طرحت وزارة البيئة مقترحاً لتعديل المادتين 24 و25 من نظام الزراعة، يتضمن غرامة لا تزيد على 15 مليون ريال للمخالفين.
ونص المقترح على تعديل المادة 24، ليصبح نصها «يتولى مفتشون - يصدر بتحديدهم قرار من الوزير - مجتمعين أو منفردين ضبط مخالفات أحكام النظام واللائحة، والتحقيق فيها، وإثباتها، وتحدد اللائحة آليات عملهم».
وعلى المسؤولين والعاملين في الأماكن المراد تفتيشها؛ تمكين المفتشين من أداء عملهم وعدم إعاقتهم، وتقديم جميع التسهيلات والمعلومات والوثائق والعينات المطلوبة، وعلى المفتشين إبراز بطاقاتهم الوظيفية عند مباشرة اختصاصاتهم، مع مراعاة الحقوق والضمانات المقررة في الأنظمة، كما يحق للمفتشين إيقاف أي حاوية أو وسيلة نقل مخالفة، أو يشتبه بمخالفتها للنظام.
وتضمنت التعديلات، منح المفتشين حق دخول المنشآت الزراعية والبيطرية والاطلاع على السجلات والمعلومات، والحصول على صور من الوثائق، وسحب عينات من المواد والأصناف التي لدى المنشأة المشتبه في ارتكابها مخالفة، إذا لزم الأمر، على أن يحرر محضر ضبط بهذه الواقعة يحتوي على جميع البيانات اللازمة للتثبت من العينات نفسها والمواد والأصناف التي أخذت منها.
ونصت التعديلات على قيام المفتشين في حال ثبوت المخالفة بالتحفظ على ثروات القطاع الزراعي محل المخالفة والتعامل معها والتحفظ الفوري على المركبات والأدوات المستخدمة، أو المشتبه في استخدامها، في ارتكاب المخالفة، وتسليمها إلى الجهة المختصة، على أن يعرض ذلك على المحكمة المختصة خلال مدة لا تزيد على 7 أيام. وطبقاً للمقترح، يحق للمفتشين الإغلاق الفوري لأي منشأة بيطرية لا تحمل ترخيصاً ساري المفعول، والإنذار في المخالفات غير الجسيمة.
ونص المقترح على تعديل المادة 25، ليصبح نصها «يعاقب كل من يخالف أياً من أحكام النظام أو اللائحة بواحدة - أو أكثر - من العقوبات الآتية: غرامة لا تزيد على 15 مليون ريال، إيقاف الترخيص - جزئياً أو كلياً - لمدة لا تتجاوز سنة، إلغاء الترخيص، إغلاق المنشأة لمدة لا تتجاوز شهراً على ألا تكون العقوبات الواردة أعلاه خلال مدة الاعتراض، إلا إذا كانت من الأفعال الواردة في المادة الـ28 من النظام، أو مرتبطة بالغش والتحايل أو يترتب عليها ضرر بالغ على الانسان، أو الحيوان، أو النبات، أو الصحة العامة، أو البيئة أو المرفق العام».
The Ministry of Environment has proposed an amendment to Articles 24 and 25 of the Agriculture System, which includes a fine not exceeding 15 million riyals for violators.
The proposal stipulates amending Article 24 to read: "Inspectors - whose designation is determined by a decision from the minister - shall collectively or individually monitor violations of the provisions of the system and the regulations, investigate them, and document them. The regulations shall specify their working mechanisms."
It is the responsibility of officials and workers in the places to be inspected to enable inspectors to perform their duties without obstruction, and to provide all necessary facilities, information, documents, and required samples. Inspectors must present their official identification when exercising their duties, while respecting the rights and guarantees established in the regulations. Inspectors also have the right to stop any container or means of transport that is in violation or suspected of violating the system.
The amendments included granting inspectors the right to enter agricultural and veterinary facilities, review records and information, obtain copies of documents, and collect samples of materials and items from the facility suspected of committing a violation, if necessary. A report of this incident must be prepared, containing all necessary data to verify the samples themselves and the materials and items from which they were taken.
The amendments state that if a violation is confirmed, inspectors shall seize the agricultural sector resources related to the violation and manage them, and immediately seize vehicles and tools used or suspected of being used in committing the violation, handing them over to the competent authority, with the requirement to present this to the competent court within a period not exceeding 7 days. According to the proposal, inspectors have the right to immediately close any veterinary facility that does not hold a valid license and to issue warnings for non-serious violations.
The proposal also stipulates amending Article 25 to read: "Anyone who violates any of the provisions of the system or the regulations shall be punished with one or more of the following penalties: a fine not exceeding 15 million riyals, suspension of the license - partially or fully - for a period not exceeding one year, revocation of the license, closure of the facility for a period not exceeding one month, provided that the penalties mentioned above do not apply during the objection period, unless they are actions specified in Article 28 of the system, or related to fraud and deception, or result in severe harm to humans, animals, plants, public health, the environment, or public facilities."
