طرحت الهيئة العامة للنقل مشروع «اللائحة التنفيذية لنشاط نقل الركاب بالحافلات بين المدن»، وصنفت المخالفات ما بين جسيمة وغير جسيمة، وتنوعت العقوبات على المخالفات ما بين حجز المركبة لفترة قد تصل إلى 60 يوماً، أو إيقافها لفترة 3 أشهر، والغرامة المالية التي تصل إلى أكثر من 38 ألف ريال.
وأوضحت الهيئة أن المشروع يهدف إلى وضع الإطار العام والتصور الشامل لتقديم خدمات نقل الركاب بشكل متطور، وحماية الاستثمار فيه بما يتفق مع أهداف التنمية الاقتصادية والاجتماعية في المملكة، مع مراعاة الجوانب البيئية ومتطلبات الأمن والسلامة.
ووفق المشروع، تُقصر ممارسة النشاط على المنشآت المبرم معها العقد، كما يُحظر ممارسة النشاط من أي شخص دون إبرام العقد أو الاستمرار في ممارسة النشاط بعد انتهاء العقد أو إلغائه، فيما حظر المشروع تواجد الحافلات التابعة لغير مقدمي الخدمة في داخل وخارج محطات انتظار وتوقف الحافلات التابعة لمقدمي الخدمة دون الحصول على موافقة من الهيئة.
وألزم المشروع مقدم الخدمة بالحصول على بطاقة تشغيل لكل حافلة قبل تشغيلها في النشاط، وفق الضوابط والشروط الواردة في العقد. واشترط المشروع على مقدم الخدمة عند إخراج أي حافلة من النشاط إلغاء بطاقة التشغيل للحافلة، في حال كانت سارية، وإزالة الهوية والشعارات الخاصة بمقدم الخدمة عن الحافلة.
واستعرضت هيئة النقل جدول المخالفات والعقوبات في اللائحة التنفيذية لنشاط نقل الركاب بالحافلات بين المدن، التي تضم عدة مخالفات، منها ممارسة النشاط دون إبرام العقد، أو ممارسة النشاط بعد انتهاء العقد، وممارسة النشاط بعد إلغاء العقد.
وجاء في المخالفات قيام الشخص بالأعمال التحضيرية لممارسة النشاط، ومن ذلك: دعوة الركاب، أو النداء عليهم، أو ملاحقتهم، أو اعتراضهم، أو التجمهر أو التجول في أماكن تواجد الركاب لغرض دعوتهم، أو التسويق والإعلان بأنواعه كافة.
وتضمنت المخالفات تواجد المركبات التابعة لغير مقدمي الخدمة في داخل وخارج المرافق التابعة لمقدمي الخدمة دون الحصول على موافقة من الهيئة، وتشغيل الحافلة دون بطاقة تشغيل، إضافة إلى تشغيل الحافلة ببطاقة تشغيل منتهية، أو تشغيل الحافلة ببطاقة تشغيل ملغية، وعدم توفير مقدم الخدمة الحافلات للهيئة متى استدعى الأمر لمجابهة حالات الطوارئ أو الكوارث الطبيعية.
The General Transport Authority has proposed the "Executive Regulation for Passenger Transport Activity by Buses Between Cities," classifying violations as serious and non-serious, with penalties ranging from vehicle impoundment for up to 60 days, or suspension for a period of 3 months, and financial fines that can exceed 38,000 riyals.
The Authority clarified that the project aims to establish a general framework and comprehensive vision for providing advanced passenger transport services, protecting investment in it in line with the economic and social development goals in the Kingdom, while considering environmental aspects and security and safety requirements.
According to the project, the activity is restricted to establishments that have a contract with the Authority, and it is prohibited for any person to engage in the activity without signing a contract or to continue the activity after the contract has expired or been canceled. The project also prohibits the presence of buses belonging to non-service providers inside and outside the waiting and stopping stations of service providers without obtaining approval from the Authority.
The project requires the service provider to obtain an operating card for each bus before operating it in the activity, according to the regulations and conditions stated in the contract. The project stipulates that when the service provider removes any bus from the activity, they must cancel the operating card for the bus, if it is valid, and remove the identity and logos of the service provider from the bus.
The Transport Authority reviewed the table of violations and penalties in the executive regulation for passenger transport activity by buses between cities, which includes several violations, such as engaging in the activity without signing a contract, or continuing the activity after the contract has expired, and engaging in the activity after the contract has been canceled.
The violations include a person conducting preparatory activities for engaging in the activity, such as inviting passengers, calling out to them, pursuing them, obstructing them, gathering or roaming in areas where passengers are located for the purpose of inviting them, or marketing and advertising in all its forms.
The violations also included the presence of vehicles belonging to non-service providers inside and outside the facilities of service providers without obtaining approval from the Authority, operating a bus without an operating card, as well as operating a bus with an expired operating card, or operating a bus with a canceled operating card, and the failure of the service provider to provide buses to the Authority whenever necessary to address emergencies or natural disasters.
