علمت «عكاظ» أن وزارة التجارة والهيئة العامة للمنافسة عقدتا أخيراً، عدة اجتماعات؛ لمناقشة موضوع تسجيل وكالات تجارية إضافية في قطاع السيارات، عبر قيام هيئة المنافسة بفحص التركيز السوقي الناشئ من تسجيل اتفاقية توزيع إضافية.
وبدأت الهيئة تلقي طلبات تسجيل اتفاقيات التوزيع الإضافية من المنشآت، لدراستها بالتنسيق مع وزارة التجارة، مع إعداد دليل إرشادي للتعامل مع الاتفاقيات الرأسية؛ بهدف تنظيم تلك الاتفاقيات وتعريف المنشآت بالممارسات المخلة بالمنافسة في الاتفاقيات الرأسية.
وكانت هيئة المنافسة قد انتهت من البحث والتقصي مع المنشآت العاملة في قطاع بيع السيارات وخدمات ما بعد البيع وقطع غيار السيارات، وجرى رفع تقرير بالنتائج للجهات العليا، وبدأت الهيئة في فحص حالات التركز الاقتصادي في قطاع بيع السيارات وخدمات ما بعد البيع، وقطع غيار السيارات.
يأتي ذلك بعد أن وجهت الهيئة في وقت سابق تهماً لـ79 منشأة عاملة في قطاع السيارات شملت «الوكلاء والموزعين»؛ بسبب قيام تلك المنشآت بمخالفات شملت «الاتفاق على تحديد الأسعار، وتقاسم الأسواق بحسب المناطق الجغرافية»، مما أدى إلى الحد من المنافسة، والتأثير في رفاهية المستهلك، مع تحريك دعوى جزائية ضد 64 منشأة، ودراسة التسوية المقدمة من 15 منشأة، وذلك خلال العام الماضي 2023.
وشهدت سوق السيارات أخيراً، العديد من المستجدات، بإعلان وزارة التجارة إلزام إحدى وكالات السيارات بإلغاء إجراء «غير نظامي» قامت به، بطلبها كامل مبلغ السيارة عند قيام المستهلك بعملية الحجز للشراء.
وألزمت الوزارة الوكالات بالاكتفاء فقط بطلب جزء من المبلغ «عربون» لتأكيد الحجز، وتم استدعاء الوكالة المخالفة لاستكمال الإجراء النظامي بحقها.

The "Okaz" newspaper learned that the Ministry of Commerce and the General Authority for Competition recently held several meetings to discuss the issue of registering additional commercial agencies in the automotive sector, through the Authority examining the market concentration arising from the registration of an additional distribution agreement.
The Authority has started receiving requests for the registration of additional distribution agreements from businesses, to study them in coordination with the Ministry of Commerce, while preparing a guideline for dealing with vertical agreements; with the aim of regulating these agreements and informing businesses about anti-competitive practices in vertical agreements.
The Authority had completed research and investigation with businesses operating in the car sales sector, after-sales services, and car spare parts, and a report on the findings was submitted to the higher authorities. The Authority has begun examining cases of economic concentration in the car sales sector, after-sales services, and car spare parts.
This comes after the Authority previously charged 79 businesses operating in the automotive sector, including "agents and distributors," due to these businesses committing violations that included "agreeing on price fixing and market sharing based on geographical areas," which led to a reduction in competition and affected consumer welfare, along with initiating criminal proceedings against 64 businesses and reviewing the settlement proposed by 15 businesses during the past year 2023.
Recently, the car market has witnessed many developments, with the Ministry of Commerce announcing the obligation of one car agency to cancel an "irregular" procedure it implemented by requesting the full amount of the car when the consumer made a reservation to purchase.
The Ministry required the agencies to only request part of the amount as a "deposit" to confirm the reservation, and the violating agency was summoned to complete the legal procedure against it.
