توعدت الهيئة العامة للنقل بحجب تطبيقات المطاعم والمتاجر الإلكترونية التي تقدم خدمات التوصيل عبر آليات توجيه يدوية أو وسائل نقل غير مرخصة، مؤكدة أن المخالفين يواجهون عقوبات نظامية تشمل (حجب التطبيقات، وحجز المركبات، وإبعاد السائقين).
وأكدت الهيئة، في (تعميم عاجل جدا اطلعت «عكاظ» عليه) موجه إلى اتحاد الغرف السعودية، رصد قيام بعض الشركات خصوصا (المتاجر الإلكترونية، متاجر التجزئة، والمطاعم، والسوبر ماركت) تقدم خدمات توصيل المنتجات عبر تطبيقات إلكترونية لتوجيه مركبات نقل أو آليات توجيه يدوية، دون حصول مقدمي الخدمة على التراخيص اللازمة أو الالتزام باللوائح المنظمة لأنشطة النقل والبريد والوساطة في نقل البضائع.
وأوضحت أن الشركات التي تبيع منتجاتها عبر منصاتها الإلكترونية وتقوم بتوصيلها من خلال مركبات مملوكة لها أو عبر طرف ثالث، ملزمة بالحصول على التراخيص النظامية الخاصة بمركبات النقل بحسب طبيعة النشاط، أو التعاقد مع شركات نقل مرخصة، كما ألزمت الشركات التي تبيع منتجات لا تملكها بالحصول على ترخيص «توصيل طلبات»، إضافة إلى التراخيص اللازمة لوسائل النقل المستخدمة.
وأضافت الهيئة أن الشركات التي تمارس نشاط الوساطة الإلكترونية في نقل البضائع دون عرض منتجات أو بيعها مطالبة بالحصول على ترخيص «الوساطة الإلكترونية في نقل البضائع»، واستكمال جميع المتطلبات النظامية ذات العلاقة، داعية المنشآت إلى تصحيح أوضاعها والالتزام بالأنظمة واللوائح المنظمة للقطاع تجنباً للعقوبات والإجراءات النظامية.
وصنفت هيئة النقل المتاجر إلى 3 فئات، الفئة الأولى التي تقوم ببيع منتجات تملكها عبر (منصة إلكترونية) وتقوم بتوصيل منتجاتها من خلال مركباتها تملكها أو متعاقدة مع طرف ثالث للنقل فإن المنصة لا تستلزم الحصول على ترخيص، لكن مركبات نقل شحناتها يجب عليها الحصول على ترخيص ملائم بحسب طبيعة نشاطها (نقل خفيف أو ثقيل) في حال كانت الشركة تملك المركبات، أو عليها التعاقد مع شركات مرخصة من الهيئة العامة للنقل.
أما الفئة الثانية وتشمل الشركات التي تقوم ببيع منتجات لا تملكها عبر «منصة إلكترونية» وتقوم بتصويل المنتجات من خلال مركبات تملكها أو متعاقدة مع طرف ثالث للنقل، فإن على المنصة الإلكترونية الحصول على ترخيص توصيل الطلبات.
وصنف الهيئة الفئة الثالثة للشركات التي تقوم بعملية الوساطة في نقل البضائع من خلال «منصة إلكترونية» تابعة لها دون عرض أي منتجات، وتقوم بالنقل من خلال مركبات تملكها أو متعاقدة مع طرف ثالث للنقل، فإن عليها الحصول على ترخيص «الوساطة الإلكترونية في نقل البضائع».
The General Transport Authority has threatened to block restaurant and e-commerce applications that provide delivery services through manual directing mechanisms or unlicensed transport means, confirming that violators face regulatory penalties including (blocking applications, impounding vehicles, and deporting drivers).
The Authority confirmed, in an (urgent circular that "Okaz" has seen) directed to the Saudi Chambers Federation, that it has monitored some companies, particularly (e-commerce stores, retail stores, restaurants, and supermarkets) providing product delivery services through electronic applications to direct transport vehicles or manual directing mechanisms, without the service providers obtaining the necessary licenses or adhering to the regulations governing transport, postal activities, and the mediation in the transport of goods.
It clarified that companies selling their products through their electronic platforms and delivering them via vehicles owned by them or through a third party are required to obtain the necessary regulatory licenses for transport vehicles according to the nature of the activity, or to contract with licensed transport companies. Additionally, companies selling products they do not own are required to obtain a "Delivery Orders" license, in addition to the necessary licenses for the means of transport used.
The Authority added that companies engaged in electronic mediation in the transport of goods without displaying or selling products are required to obtain a "Electronic Mediation in the Transport of Goods" license and complete all related regulatory requirements, urging establishments to rectify their situations and comply with the regulations and laws governing the sector to avoid penalties and regulatory actions.
The Transport Authority classified stores into three categories. The first category includes those that sell products they own through an (electronic platform) and deliver their products via vehicles they own or contracted with a third party for transport; in this case, the platform does not require a license, but the transport vehicles must obtain an appropriate license according to the nature of their activity (light or heavy transport) if the company owns the vehicles, or they must contract with companies licensed by the General Transport Authority.
The second category includes companies that sell products they do not own through an "electronic platform" and deliver products via vehicles they own or contracted with a third party for transport; in this case, the electronic platform must obtain a delivery orders license.
The Authority classified the third category for companies that engage in mediation in the transport of goods through an "electronic platform" belonging to them without displaying any products, and transport through vehicles they own or contracted with a third party for transport; in this case, they must obtain a "Electronic Mediation in the Transport of Goods" license.
