دعت وزارة التجارة الراغبين في نقل ملكية السجلات التجارية إلى التحقق من عدد من الجوانب النظامية قبل إتمام عملية النقل، بما يسهم في حفظ الحقوق، والحد من الالتزامات المستقبلية غير المتوقعة.
وأوضحت الوزارة أهمية التأكد من عدم وجود مطالبات أو التزامات مالية أو مخالفات أو غرامات أو رسوم مستحقة أو دعاوى قضائية قائمة على السجل التجاري للمنشأة، إضافة إلى التحقق من نظامية التراخيص والاشتراكات والعقود ذات الصلة بالنشاط التجاري.
وأكدت الوزارة أن نقل ملكية السجل التجاري للمؤسسة يتم عبر التوثيق النظامي، وبشكل إلكتروني عبر الرمز المرسل إلى الجوال، ويلزم المالك الجديد للسجل التجاري باستكمال الإجراءات لدى الجهات ذات العلاقة، ومنها: وزارة الموارد البشرية والتنمية الاجتماعية، وزارة البلديات والإسكان، هيئة الزكاة والضريبة والجمارك، المؤسسة العامة للتأمينات الاجتماعية، الغرف التجارية، والبنوك، وفق المتطلبات والإجراءات المعمول بها لدى كل جهة.
The Ministry of Commerce has called on those wishing to transfer the ownership of commercial records to verify several regulatory aspects before completing the transfer process, which contributes to preserving rights and limiting unexpected future liabilities.
The ministry clarified the importance of ensuring that there are no claims, financial obligations, violations, fines, or outstanding fees, or ongoing legal cases related to the commercial record of the establishment, in addition to verifying the legality of licenses, subscriptions, and contracts related to the commercial activity.
The ministry confirmed that the transfer of ownership of the commercial record for the institution is done through official documentation, electronically via the code sent to the mobile phone, and the new owner of the commercial record is required to complete the procedures with the relevant authorities, including: the Ministry of Human Resources and Social Development, the Ministry of Municipal and Rural Affairs and Housing, the Zakat, Tax and Customs Authority, the General Organization for Social Insurance, the Chambers of Commerce, and banks, in accordance with the requirements and procedures in place at each entity.
