قررت المحكمة الاقتصادية بالقاهرة بحجز الدعوى المقامة ضد مطرب المهرجانات عصام صاصا، في القضية الخاصة باتهامه باستغلال لحن أغنية «على بالي» للفنانة المصرية شيرين عبدالوهاب دون الحصول على موافقة مالكي حقوقه.
انتظار التقرير الفني
وتنظر المحكمة بأن يحسم التقرير الفني ما إذا كان العمل الغنائي الذي قدمه عصام صاصا يتضمن تشابهًا أو استغلالًا للحن الأصلي المحمي بحقوق الملكية الفكرية، تمهيدًا لاستكمال إجراءات التقاضي وإصدار القرار النهائي في الدعوى
بداية النزاع
وتعود بداية الأزمة إلى بلاغ تقدم به المحامي سامح قناوي، وكيلاً عن الملحن وائل محمد، أكد فيه أن موكله تعرض للاعتداء على حقوقه الفكرية بعد إعادة استخدام أحد ألحانه في عمل غنائي جديد دون الحصول على إذن مسبق، مطالبًا باتخاذ الإجراءات القانونية اللازمة.
اتهام باستغلال اللحن
وأشار البلاغ إلى أن اللحن محل النزاع يعود لأغنية «على بالي» التي أدتها الفنانة شيرين عبدالوهاب ضمن ألبوم «لازم أعيش» عام 2005، موضحًا أن الملحن سبق أن منحها حق استغلال العمل وفق الأطر القانونية.
وأضاف مقدم البلاغ أن عصام صاصا استخدم اللحن ذاته في مهرجان «كله فارق.. حالة طوارئ» الذي طرحه عام 2021 عبر منصات التواصل الاجتماعي، معتبرًا أن ذلك يمثل تعديًا على حقوق الملكية الفكرية، إلى جانب تحقيق مكاسب مادية من استغلال المصنف دون موافقة صاحبه.
The Economic Court in Cairo decided to reserve the lawsuit filed against the festival singer Issam Sasa, in the case concerning his alleged exploitation of the melody of the song "Ala Bali" by the Egyptian artist Sherine Abdel Wahab without obtaining the approval of the rights holders.
Awaiting the technical report
The court is considering whether the technical report will determine if the musical work presented by Issam Sasa includes similarities or exploitation of the original melody protected by intellectual property rights, in preparation for completing the litigation procedures and issuing a final decision in the case.
Beginning of the dispute
The crisis began with a complaint filed by lawyer Samah Qanawy, representing the composer Wael Mohamed, in which he confirmed that his client had been subjected to an infringement of his intellectual property rights after one of his melodies was reused in a new musical work without prior permission, demanding that the necessary legal actions be taken.
Accusation of exploiting the melody
The complaint indicated that the melody in dispute belongs to the song "Ala Bali," which was performed by the artist Sherine Abdel Wahab in her album "Lazem Aish" in 2005, clarifying that the composer had previously granted her the right to exploit the work within the legal frameworks.
The complainant added that Issam Sasa used the same melody in the festival "Kollo Farq.. Halat Tawarri" which he released in 2021 via social media platforms, considering that this constitutes an infringement of intellectual property rights, in addition to achieving financial gains from exploiting the work without the owner's consent.
