تقدم المؤلف زين متولي، بدعوى إلى المحكمة الاقتصادية اتهم من خلالها القائمين على مسلسل عشماوي للفنان محمد رمضان بالاستيلاء على قصته دون استئذان رغم تسجيلها رسمياً في صوت القاهرة بعد أن بدأ كتابتها في 2008.
اختلافات بسيطة
وأوضح متولي في تصريحات صحفية بأنه تفاجأ يوليو الماضي بالإعلان عن مسلسل عشماوي بمعالجة درامية شبيهة بالقصة الأصلية التي عمل عليها في 2008، مشيراً إلى أن تفاصيل القصة تتشابه مع بعض الاختلافات البسيطة، من بينها أن قصته يظهر فيها عشماوي أباً لخمس بنات، بينما في المسلسل هو أب لثلاث فقط، موضحاً أن الاسم المقترح للمسلسل في البداية كان خليفة عزرائيل، وهو الاسم المشابه لنصه «صديق عزرائيل».
إجراءات قانونية
وأضاف توجهت في بداية سبتمبر الماضي إلى مقر الشركة التي تتولى إنتاج المسلسل، والتقيت بمدير إنتاج المسلسل علي حسن، لعرض ما حدث معي من اعتداء على حقوقي الفكرية.
وأكد متولي تمسكه بحقوقه الأدبية والمادية في القصة، موضحاً بأنه بدأ في اتخاذ عدد من الإجراءات القانونية بالفعل، إذ تقدم بشكوى إلى اتحاد كتاب مصر بصفته عضواً فيه، وشكوى في نقابة المهن السينمائية، فضلاً عن تحرير محضر بالواقعة في قسم قصر النيل إضافة إلى تقديم دعوى لدى المحكمة الاقتصادية، كما أرسل إنذاراً قضائياً رسمياً إلى الشركة المنتجة للمسلسل، للمطالبة بحقوقه المتعلقة بالقصة والمعالجة الدرامية، مؤكداً تلقيه الدعم من الناقد طارق الشناوي وخالد منتصر ومسعد فودة.
لجنة لفحص السيناريو
من جانبه كشف الكاتب الدكتور خالد منتصر، بأن نقيب المهن السينمائية وعد بالتحقيق في الأمر من خلال تشكيل لجنة مختصة لفحص السيناريو والتحقق من مدى التشابه مع النص المسجل في صوت القاهرة.
وكتب عبر حسابه الشخصي على فيسبوك: «نقيب السينمائيين يعد بتشكيل لجنة لفحص سيناريو عشماوي، والإجابة عن سؤال: من هو مؤلف مسلسل عشماوي؟ وهل هو ملطوش فعلاً من مسلسل سابق قُدم لصوت القاهرة؟ والإجابة سيحددها فحص اللجنة».
جاء ذلك المنشور بعد أن نشر خالد منتصر رسالة الاستغاثة من الكاتب زين متولي بشأن قصة مسلسل عشماوي الذي من المقرر أن يقوم ببطولته الفنان محمد رمضان، معرباً عن رغبته في عرض الأدلة بشكل محايد.
The author Zain Metwally has filed a lawsuit in the Economic Court accusing those behind the series "Ishmawy" starring Mohamed Ramadan of stealing his story without permission, despite it being officially registered with Voice of Cairo after he began writing it in 2008.
Minor Differences
Metwally explained in press statements that he was surprised last July by the announcement of the "Ishmawy" series, which has a dramatic treatment similar to the original story he worked on in 2008. He pointed out that the details of the story are similar with some minor differences, including that in his story, Ishmawy is a father of five daughters, while in the series, he is a father of only three. He clarified that the initially proposed name for the series was "Khalifa Azrael," which is similar to his text "Friend of Azrael."
Legal Actions
He added that he went to the headquarters of the company producing the series at the beginning of September and met with the production manager Ali Hassan to present what happened to him regarding the violation of his intellectual rights.
Metwally affirmed his insistence on his moral and financial rights in the story, explaining that he has already begun taking a number of legal actions. He filed a complaint with the Egyptian Writers' Union as a member, a complaint with the Cinema Professions Syndicate, in addition to filing a report about the incident at Qasr El-Nil Police Station, and submitting a lawsuit to the Economic Court. He also sent an official legal notice to the production company of the series, demanding his rights related to the story and the dramatic treatment, confirming that he received support from critic Tarek El-Shennawy, Khaled Montaser, and Mas'ad Foda.
Committee to Review the Script
For his part, writer Dr. Khaled Montaser revealed that the head of the Cinema Professions Syndicate promised to investigate the matter by forming a specialized committee to review the script and verify the extent of similarity with the text registered with Voice of Cairo.
He wrote on his personal Facebook account: "The head of the filmmakers promises to form a committee to examine the Ishmawy script and answer the question: Who is the author of the Ishmawy series? And is it really plagiarized from a previous series presented to Voice of Cairo? The answer will be determined by the committee's review."
This post came after Khaled Montaser published a distress message from writer Zain Metwally regarding the story of the Ishmawy series, which is set to star artist Mohamed Ramadan, expressing his desire to present the evidence in an impartial manner.
