حققت نجمة الغناء الأمريكية العالمية بيونسيه انتصارًا قضائيًا في تركيا، بعدما حسمت المحكمة العليا لصالحها سلسلة من الدعاوى التي رفعتها ضد شركات وأفراد حاولوا تسجيل اسمها كعلامة تجارية من دون الحصول على موافقتها.
وأظهرت وثائق قضائية أن بيونسيه لجأت إلى القضاء التركي للاعتراض على محاولات تسجيل اسمها تجاريًا من جانب أطراف أخرى، في قضايا استمرت أمام درجات التقاضي المختلفة قبل وصولها إلى المحكمة العليا.
ووفقًا للبيانات المسجلة في شبكة القضاء الإلكتروني التركية، حُسمت القضايا الأربع المرتبطة بالاسم لصالح الفنانة الأمريكية، إذ أصدرت الدائرة المدنية الحادية عشرة بالمحكمة العليا قرارات أكدت عدم قانونية تسجيل اسم (بيونسيه) كعلامة تجارية من جانب أطراف خارجية في ثلاث قضايا منفصلة.
وجاءت الأحكام، وفقًا لنصوص القرارات الصادرة عن وزارة العدل التركية، لتؤكد أحقية النجمة الأمريكية في الحماية القانونية لاسمها، في ظل الشهرة الواسعة التي اكتسبها على المستوى العالمي.
أما القضية الرابعة، فقد انتهت بصورة مختلفة، بعدما تراجع الطرف المدعى عليه عن طلب تسجيل العلامة التجارية، ما أدى إلى إغلاق الملف قبل صدور حكم نهائي بشأنه.
«بيونسيه».. اسم أول أم علامة مرتبطة بالنجمة؟
وخلال نظر إحدى القضايا، دفع الطرف المدعى عليه بأن كلمة (بيونسيه) ليست سوى الاسم الأول للفنانة، ولا يمكن اعتبارها بالضرورة إشارة حصرية إليها، محذرًا من أن منع استخدام الأسماء الأولى للشخصيات المعروفة في المجال التجاري قد يخلق سابقة قانونية تقيد استخدام تلك الأسماء.
إلا أن هذا الدفع لم يقنع المحكمة العليا، التي أخذت في الاعتبار الشهرة الاستثنائية التي ارتبط بها اسم بيونسيه عالميًا، وما يمكن أن يترتب على استخدامه تجاريًا من دون موافقتها من استغلال للقيمة التجارية المرتبطة باسمها وشخصيتها الفنية.
وبذلك، رسّخت الأحكام حماية الاسم من محاولات تسجيله كعلامة تجارية من جانب أطراف لا تربطهم علاقة قانونية بالفنانة، في إطار قواعد حماية الملكية الفكرية والعلامات التجارية.
حماية «الاسم المشهور» في عالم العلامات التجارية
وتكتسب القضية أهمية تتجاوز اسم بيونسيه نفسها، إذ تعكس واحدة من أبرز الإشكاليات التي تواجه المشاهير والعلامات المرتبطة بشخصيات عامة، وهي الحدود الفاصلة بين الاسم الشخصي من جهة، والقيمة التجارية التي يكتسبها الاسم نتيجة الشهرة من جهة أخرى.

وفي الحالة التركية، انتهت ثلاثة من النزاعات الأربعة بحسم المحكمة العليا لمصلحة بيونسيه، بينما أُغلق الملف الرابع بعد تراجع الطرف الآخر عن طلب تسجيل الاسم، لتنتهي بذلك محاولات تسجيل (بيونسيه) كعلامة تجارية من جانب أطراف خارجية دون موافقتها.
The global American singing star Beyoncé has achieved a legal victory in Turkey, after the Supreme Court ruled in her favor regarding a series of lawsuits she filed against companies and individuals who attempted to register her name as a trademark without her consent.
Documents revealed that Beyoncé turned to the Turkish judiciary to contest attempts to commercially register her name by other parties, in cases that went through various levels of litigation before reaching the Supreme Court.
According to data recorded in the Turkish electronic judiciary network, the four cases related to the name were resolved in favor of the American artist, as the eleventh civil chamber of the Supreme Court issued decisions confirming the illegality of registering the name (Beyoncé) as a trademark by external parties in three separate cases.
The rulings, according to the texts of the decisions issued by the Turkish Ministry of Justice, affirmed the American star's right to legal protection for her name, in light of the widespread fame it has gained globally.
As for the fourth case, it ended differently, after the defendant withdrew their request to register the trademark, leading to the closure of the file before a final ruling was issued on it.
“Beyoncé”... Is it a first name or a brand associated with the star?
During the consideration of one of the cases, the defendant argued that the word (Beyoncé) is merely the first name of the artist and cannot necessarily be considered an exclusive reference to her, warning that preventing the use of first names of known personalities in the commercial field could create a legal precedent that restricts the use of those names.
However, this argument did not convince the Supreme Court, which took into account the exceptional fame associated with the name Beyoncé globally, and the potential exploitation of the commercial value linked to her name and artistic persona if used commercially without her consent.
Thus, the rulings established protection for the name against attempts to register it as a trademark by parties with no legal relationship to the artist, within the framework of intellectual property and trademark protection rules.
Protection of the “famous name” in the world of trademarks
The case holds significance beyond Beyoncé's name itself, as it reflects one of the most prominent issues facing celebrities and brands associated with public figures, which is the dividing line between the personal name on one hand, and the commercial value that the name acquires as a result of fame on the other.
