قررت الدائرة الثالثة بمحكمة القضاء الإداري في مصر، اليوم الخميس، تأجيل نظر الدعوى القضائية المقامة من الفنانة اللبنانية هيفاء وهبي ضد نقابة المهن الموسيقية ونقيبها مصطفى كامل، إلى جلسة 11 سبتمبر القادم.
وتأتي هذه الخطوة بعدما أوصى تقرير هيئة مفوضي الدولة بإلغاء القرار الصادر عن النقابة بمنع هيفاء وهبي من الغناء، معتبرًا أن الإجراء يخالف المبادئ الدستورية المتعلقة بحرية الإبداع.
وكانت نقابة المهن الموسيقية أصدرت، في 16 مارس الماضي، قرارًا بسحب التصاريح الفنية الخاصة بالفنانة هيفاء وهبي، ومنعها من إقامة الحفلات داخل مصر. واعتبر مقيمو الدعوى أن هذا القرار يُعد مساسًا بحرية التعبير والإبداع الفني التي ينص عليها الدستور المصري في مادتيه 65 و67، اللتين تحظران فرض أي رقابة على الأعمال الفنية إلا بناءً على قانون وبقرار قضائي.
وفي تقريرها المقدم للمحكمة، أوصت هيئة مفوضي الدولة بإلغاء القرار المطعون عليه، مؤكدة أنه صدر دون سند قانوني أو حكم قضائي، ما يجعله متعارضًا مع نصوص الدستور التي تضمن حرية التعبير والإبداع. كما شددت الهيئة على أن النقابة لا تمتلك صلاحية اتخاذ قرار بمنع فنان من ممارسة نشاطه الفني إلا في إطار قانوني واضح ومحدد.
The Third Circuit of the Administrative Judiciary Court in Egypt decided today, Thursday, to postpone the hearing of the lawsuit filed by Lebanese artist Haifa Wehbe against the Musicians' Syndicate and its head, Mustafa Kamel, to a session on September 11.
This step comes after the report from the State Commissioners Authority recommended canceling the decision issued by the syndicate to prevent Haifa Wehbe from singing, considering that the action contradicts constitutional principles related to freedom of creativity.
The Musicians' Syndicate issued, on March 16, a decision to revoke the artistic licenses of artist Haifa Wehbe and prevent her from holding concerts within Egypt. The plaintiffs argued that this decision constitutes an infringement on freedom of expression and artistic creativity, as stipulated in Articles 65 and 67 of the Egyptian Constitution, which prohibit imposing any censorship on artistic works except by law and through a judicial decision.
In its report submitted to the court, the State Commissioners Authority recommended canceling the contested decision, confirming that it was issued without legal basis or judicial ruling, making it inconsistent with the constitutional texts that guarantee freedom of expression and creativity. The authority also emphasized that the syndicate does not have the authority to decide to prevent an artist from practicing their artistic activity except within a clear and specific legal framework.
