مما يجعل المال حراماً أن يكون الحصول عليه بالإكراه سواء كان إكراهاً مادياً أو معنوياً كتهديد الزوج زوجته بالطلاق إن لم تعطه مالها؛ قال الشيخ ابن عثيمين: «الأزواج الذين يأخذون الرواتب من زوجاتهم قهراً هؤلاء ظلمة، وهذا لا يحل له منه شيء أبداً، وكل ما أخذه منها فهو حرام إلا بطيب نفس حقيقي منها». شرح بلوغ المرام (254/5). وقال: «إذا كان هناك شرط عند عقد النكاح أن تبقي على العمل لا يحل له أن يأخذ منك قرشاً واحداً، ولا أن يمنعك من العمل لقول الله (يا أيها الذين آمنوا أوفوا بالعقود)، (وأوفوا بالعهد إن العهد كان مسؤولاً). كانت أزواج الرجال في عهد النبي يتصرفن كما شئن دون الرجوع إلى الأزواج، وذلك أن النبي حين خطب بالنساء وأمرهن يتصدقن جعلت المرأة تأخذ من خواتمها وأقراطها وتلقيه إلى النبي ولم يقل لهن هل استأذنتن أزواجكن؟ والزوج ليس له الحق في مال الزوجة إطلاقاً لا راتبها ولا حليها ولا غير ذلك، هي حرة فيه، وإذا قدرنا أن الزوج ضغط عليك وهدّدك بالطلاق إن لم تفعلي، أي إن لم تعطه شيئاً لم يكن اشترطه عند العقد، فإنه آثم وما يأخذه سحت محرم عليه». نور على الدرب/361. والشيخ ابن باز قال: «مرتبها لها؛ إلا إذا سمحت لك بالراتب كله أو ببعضه سماحاً واضحاً، لا شبهة فيه؛ فلا بأس عليك؛ أما إن كنت توعدها بالطلاق، أو بالهجر، أو بالأذى إن لم تعطك فهذا لا يجوز لك لأنها ما طابت نفسها بذلك، ولكن خوفاً منك، أو من طلاقك سلمت لك المال» نور على الدرب. وقال برد على سؤال: هل للرجل الحق بالتصرف بمال زوجته كالذهب بغير رغبتها؟ «ليس له التصرف في مالها إلا بإذنها». فشرعاً مال وممتلكات الزوجة بما في ذلك إرثها وذهبها ومهرها وراتبها وعقاراتها يحق لها التصرف بها كما تشاء بدون استئذان من زوجها، ولا يحق لزوجها أن يأخذ منه شيئاً لا بالإكراه المادي ولا المعنوي ولا بالخفية عنها حيث يعتبر شرعاً سرقة، ولا يجب عليها الإنفاق من مالها على الأسرة، وإن كانت أغنى من زوجها، وشرعاً وبالقانون السعودي يجب على الزوج الإنفاق على زوجته بما في ذلك «الإنفاق على علاجها»، (وَآتَيْتُمْ إِحْدَاهُنَّ قِنطَارًا فَلاَ تَأْخُذُواْ مِنْهُ شَيْئًا أَتَأْخُذُونَهُ بُهْتَاناً وَإِثْماً مُّبِيناً). (وَلاَ يَحِلُّ لَكُمْ أَن تَأْخُذُواْ مِمَّا آتَيْتُمُوهُنَّ شَيْئًا). (لاَ يَحِلُّ لَكُمْ أَن تَرِثُواْ النِّسَاء كَرْهًا وَلاَ تَعْضُلُوهُنَّ لِتَذْهَبُواْ بِبَعْضِ مَا آتَيْتُمُوهُنَّ). وبالصحيح «ألا لا تظلموا، ألا لا يحل مال أمرئ إلا بطيب نفس منه» أحمد. وإن ضغط الزوج على زوجته لكي تعطيه مالها أو يضطرها لطلب الخلع، ففعله محرم والخلع باطل، ويجب رد مالها لها؛ قال ابن قدامة بالمغني (8/179) «فأما إن عضل زوجته، وضارها بالضرب والتضييق عليها، أو منعها حقوقها؛ من النفقة، والقسم ونحو ذلك، لتفتدي نفسها منه/الخلع، ففعلت، فالخلع باطل، والعوض مردود؛ روي ذلك عن ابن عباس وعطاء ومجاهد والشعبي والنخعي والقاسم بن محمد وعروة وعمرو بن شعيب وحميد بن عبدالرحمن والزهري وبه قال مالك والثوري وقتادة والشافعي وإسحاق».
What makes money forbidden is obtaining it through coercion, whether it is physical or moral coercion, such as a husband threatening his wife with divorce if she does not give him her money. Sheikh Ibn Uthaymeen said: “Husbands who take salaries from their wives by force are oppressors, and it is never permissible for them to take anything from her. Everything he takes from her is forbidden unless she gives it willingly.” Sharh Bulugh al-Maram (254/5). He also said: “If there is a condition at the time of the marriage contract that she continues to work, it is not permissible for him to take a single penny from you, nor to prevent you from working, for Allah says (O you who have believed, fulfill [all] contracts), (And fulfill [every] commitment. Indeed, the commitment is ever [that about which one will be] questioned). The wives of men during the time of the Prophet acted as they wished without referring to their husbands. This is because when the Prophet addressed the women and commanded them to give charity, a woman would take from her rings and earrings and give them to the Prophet, and he did not ask them, “Did you get permission from your husbands?” The husband has no right to the wife’s money at all, neither her salary nor her jewelry nor anything else; she is free in it. If we assume that the husband pressured you and threatened you with divorce if you did not give him something that he did not stipulate at the time of the contract, then he is sinful, and what he takes is forbidden for him.” Noor Ala Al-Darb/361. Sheikh Ibn Baz said: “Her salary is for her; unless she clearly permits you to take all or part of it, without any ambiguity; then there is no harm on you. However, if you threaten her with divorce, or abandonment, or harm if she does not give you, this is not permissible for you because she did not willingly give it, but out of fear of you or your divorce, she surrendered the money to you.” Noor Ala Al-Darb. In response to a question: Does a man have the right to dispose of his wife’s money, such as gold, without her desire? “He has no right to dispose of her money except with her permission.” Legally, the wife’s money and property, including her inheritance, gold, dowry, salary, and real estate, she has the right to dispose of as she wishes without seeking permission from her husband, and her husband has no right to take anything from it, neither through physical nor moral coercion nor secretly from her, as it is considered theft legally. She is not obligated to spend her money on the family, even if she is wealthier than her husband. Legally and according to Saudi law, the husband is required to spend on his wife, including “spending on her treatment,” (And if you give one of them a qintar [a large amount] of gold, do not take from it anything. Would you take it in injustice and manifest sin?). (And it is not lawful for you to take any of what you have given them). (It is not lawful for you to inherit women by compulsion, nor to make them miserable so that you may take part of what you gave them). And it is correct to say, “Beware, do not oppress, and it is not lawful for anyone to take the property of another except with their good will.” Ahmad. If the husband pressures his wife to give him her money or forces her to seek a divorce, his action is forbidden and the divorce is invalid, and her money must be returned to her; Ibn Qudamah said in Al-Mughni (8/179): “If a husband oppresses his wife, harms her with beating and constriction, or denies her rights such as maintenance and division, in order for her to free herself from him (the divorce), and she does so, then the divorce is invalid, and the compensation is to be returned; this has been narrated from Ibn Abbas, Ata, Mujahid, Al-Shabi, Al-Nakha'i, Al-Qasim ibn Muhammad, Urwah, Amr ibn Shu'aib, Hamid ibn Abdul Rahman, and Al-Zuhri, and this is the view of Malik, Al-Thawri, Qatada, Al-Shafi'i, and Ishaq.
