The Economic and Financial Penal Court in Sidi Amhar, Algiers, has set October 6 as the date for the trial of former Minister of Water Resources Azraq Baraqy and former officials from the National Agency for Dams, in a case related to a project to enhance the "Mjaz Al-Baqar" dam in Qalmah Province, with a value exceeding 580 billion centimes.
The court decided to postpone the session at the request of the defense team and to summon absent parties from the case, after several detained and non-detained defendants attended the courtroom, according to the Algerian newspaper "Echorouk."
The case includes, in addition to former minister Azraq Baraqy, the former director general of the National Agency for Dams and Transfers and his successor, along with other defendants, in connection with events related to the awarding and implementation of the project to enhance the "Mjaz Al-Baqar" dam designated for agricultural irrigation in the municipality of Ain Makhlouf in eastern Algeria.
According to the results of investigations reported by Algerian media, the project's initial value was about 130 billion centimes, or 1.3 billion Algerian dinars, before it later rose to more than 580 billion centimes, or about 5.8 billion dinars, due to the signing of three amendments related to the original contract.
Investigations, according to the same sources, indicate that the amendments led to a change in the nature of the project from "enhancing the dam" to "increasing its height," with the value of the second amendment exceeding 230 billion centimes, and the third amendment exceeding 75 billion centimes, in addition to other amounts that raised the total cost of the project to more than 580 billion centimes.
The "Mjaz Al-Baqar" project is considered one of the water infrastructure projects related to providing water for agricultural irrigation in Qalmah Province, which gives the case a dimension that goes beyond the financial aspect, as it is linked to a water project aimed at serving agricultural activity in the region.
The file had undergone judicial and security investigations before being referred to the Economic and Financial Penal Court, where the investigations concluded, according to "Echorouk," that there were suspicions regarding the method of awarding the contract and the increases that occurred in its value through the subsequently concluded amendments.
The defendants face charges related to abuse of power, misuse of office, embezzlement of public funds, and granting unjustified privileges in connection with a contract with the state or one of its institutions, which are charges linked to Articles 26, 29, 32, 33, and 48 of the Law on the Prevention and Fight Against Corruption, according to Algerian sources.
The case also includes the owner of the company benefiting from the project, who also faces charges related to incitement to abuse of power, benefiting from unjustified privileges, participating in the embezzlement of public funds, and money laundering, according to the published investigations.
The investigating judge had previously ordered the temporary detention of several defendants, including Baraqy and two officials from the National Agency for Dams, while other defendants were placed under judicial supervision. The measures also included orders to seize and freeze revenues, properties, and bank accounts related to the case, along with investigations into potential properties and balances abroad.
The case dates back to previous years, while Baraqy had already faced a final prison sentence in another corruption case, according to "Echorouk" in its previous coverage of the file. The charges in the current case do not imply the establishment of criminal responsibility, as the final word remains with the judiciary after the completion of the trial and the issuance of rulings according to legal procedures.
