لم يدرك رجل أن لجوءه لاجتزاء رسالة نصية من سياقها سيكون السبب المباشر في خسارته قضية رفيعة المستوى أمام القضاء. وكان نزاع مالي شائك قد اندلع بين زميلين سابقين في العمل حول مبلغ 87 ألف درهم إماراتي، انتهى إلى نقطة حسم قاطعة داخل محكمة العين للدعاوى المدنية والتجارية والإدارية، بعدما كشفت المحادثات الكاملة تفاصيل مغايرة تماماً لما ادعاه الرجل.
بدأ الفصل الأول من القضية عندما أقام رجل دعوى قضائية ضد زميلته السابقة، طالباً إلزامها بدفع 87 ألف درهم، إضافة إلى فائدة قانونية بنسبة 5% وتعويض قدره 2000 درهم مع المصروفات وأتعاب المحاماة.
وادعى الرجل أنه حول للمدعى عليها هذا المبلغ على مدار أربعة أشهر لمساعدتها في رعاية أبنائها بناءً على طلبها، متوقعاً استرداد الأموال كدين، إلا أنها امتنعت عن الرد رغم مطالباته المستمرة لها. وفي المقابل، قدمت المدعى عليها مذكرة جوابية أنكرت فيها واقعة القرض جملة وتفصيلاً، مؤكدة أن التحويلات كانت عطاءً تلقائياً على سبيل «الهبة والمساعدة»، وأبدت استعدادها التام لحلف اليمين الحاسمة لإثبات براءة ذمتها.
لكن المحطة المفصلية في المحاكمة جاءت عند فحص القضاء لمستندات الإثبات، إذ استند المدعي إلى صورة محادثة عبر تطبيق «واتساب» تُظهر قول المدعى عليها إنها لا تملك المبلغ كاملاً وسوف تحول له ألفاً أو ألفين شهرياً، معتبراً ذلك إقراراً صريحاً بالدين.
لكن المفاجأة الدامغة ظهرت عندما قدمت المدعى عليها السجل الكامل للمحادثة ذاتها، إذ تبين أن المدعي اقتطع الجزء السابق مباشرة من الحوار، والذي كانت توضح فيه بوضوح أن المبالغ كانت مساعدة برضاه، وأنها فوجئت بمطالبته المفاجئة بردها.
وأوضحت المحكمة في حيثيات حكمها قواعد إثبات صارمة، مشيرة إلى أن عبء الإثبات يقع بالكامل على عاتق المدعي لأن الأصل هو «براءة الذمة». وأكدت الهيئة القضائية أن الإقرار يجب أن يؤخذ بمضمونه وسياقه الكامل، ولا يجوز قَص عبارة منه لتغيير مدلولها. ورأت المحكمة أن إبداء المرونة لتحويل مبلغ شهري لا يُعد إقراراً قاطعاً بوجود دين واجب الأداء، خصوصاً عندما يُقرأ في سياق حديثها عن أصل المساعدة.
ولحسم النزاع بشكل نهائي، وجهت المحكمة اليمين الحاسمة للمدعى عليها، والتي حلفتها أصولاً أمام القضاء لتؤكد أن المبالغ لم تكن ديناً بل هبة. وبناءً عليه، أصدرت محكمة العين حكمها الفاصل برفض الدعوى بالكامل، وإلزام المدعي بكافة الرسوم والمصروفات القضائية.
A man did not realize that his resorting to taking a text message out of context would be the direct reason for losing a high-profile case in court. A complicated financial dispute had erupted between two former colleagues over an amount of 87,000 UAE dirhams, which ended in a decisive ruling within the Al Ain Court of Civil, Commercial, and Administrative Cases, after the full conversations revealed details completely contrary to what the man had claimed.
The first chapter of the case began when a man filed a lawsuit against his former colleague, requesting that she be obliged to pay 87,000 dirhams, in addition to a legal interest of 5% and compensation of 2,000 dirhams along with costs and attorney fees.
The man claimed that he had transferred this amount to the defendant over four months to help her take care of her children at her request, expecting to recover the money as a debt, but she refrained from responding despite his continuous demands. In contrast, the defendant submitted a reply memorandum in which she denied the loan incident entirely, asserting that the transfers were a voluntary gift for the sake of "donation and assistance," and expressed her full willingness to swear an oath to prove her innocence.
However, the pivotal moment in the trial came when the court examined the evidentiary documents, as the plaintiff relied on a screenshot of a conversation via the "WhatsApp" application showing the defendant saying that she did not have the full amount and would transfer him a thousand or two thousand monthly, considering this a clear acknowledgment of the debt.
But the shocking surprise emerged when the defendant presented the complete record of the same conversation, revealing that the plaintiff had cut the previous part of the dialogue, in which she clearly explained that the amounts were assistance with her consent, and that she was surprised by his sudden demand for repayment.
The court clarified in the reasoning of its ruling strict evidentiary rules, indicating that the burden of proof lies entirely on the plaintiff because the presumption is "innocence." The judicial panel confirmed that acknowledgment must be taken in its full content and context, and it is not permissible to cut a phrase from it to change its meaning. The court found that showing flexibility to transfer a monthly amount does not constitute a conclusive acknowledgment of an existing debt, especially when read in the context of her discussion about the nature of the assistance.
To resolve the dispute definitively, the court directed the decisive oath to the defendant, which she swore properly before the court to confirm that the amounts were not a debt but a gift. Accordingly, the Al Ain Court issued its final ruling rejecting the lawsuit in its entirety, and obliging the plaintiff to bear all court fees and expenses.
