وأنهت الغرفة الجزائية الأولى لدى مجلس قضاء الجزائر الفصل الأخير من هذه القضية الشائكة، ملوّحة بالسيف الصارم لقانون العقوبات ضد المتهمين الرئيسيين. وقضت المحكمة بالسجن النافذ 5 سنوات بحق المتهم «خ. ع» (مؤثر بارز ومدير وكالة الاتصال المكلفة بتنظيم الفعالية) وشريكه «أ. س»، مع فرض غرامة مالية قدرها 500 ألف دينار على كل منهما.
ولم تتوقف الأحكام القضائية عند حدود الحبس، بل ألزمتهما بدفع تعويض مالي لصالح الخزينة العمومية قدره 20 مليون دينار جزائري، كجبر للضرر المعنوي الذي لحق برمز السيادة الوطنية وتاريخ شهدائها.
وجاءت هذه القرارات الحاسمة استناداً للمادة 160 مكرر من قانون العقوبات الجزائري، والتي تفرض السجن الحتمي لمدد تصل إلى 10 سنوات على كل من يتعمد إهانة أو تدنيس الراية الوطنية بأي وسيلة علنية. وأكد القضاء الجزائري في مسببات حكمه أن احترام العلم واجب مطلق لا يسقط تحت أي مبرر.

The judicial rulings did not stop at imprisonment; they also required them to pay a financial compensation to the public treasury amounting to 20 million Algerian dinars, as reparation for the moral damage inflicted on the symbol of national sovereignty and the history of its martyrs.
These decisive decisions came based on Article 160 bis of the Algerian Penal Code, which imposes mandatory imprisonment for periods of up to 10 years on anyone who deliberately insults or desecrates the national flag by any public means. The Algerian judiciary confirmed in the reasoning of its ruling that respect for the flag is an absolute duty that cannot be waived under any justification.
