أصدرت محكمة اتحادية في ولاية ديلاوير الأمريكية، أمس (الخميس)، أمرًا قضائيًا مؤقتًا يمنع شركة «أوبريشن بلوبيرد» الناشئة في مجال التواصل الاجتماعي من استخدام اسم «تويتر» والعلامات التجارية المرتبطة به لمنصتها، في انتصار قضائي لشركة «إكس» المملوكة لإيلون ماسك.
وقال القاضي الاتحادي كولم كونولي إن «إكس» من المرجح أن تثبت أن استخدام «أوبريشن بلوبيرد» اسم «تويتر» قد يسبب ارتباكًا لدى المستخدمين وينتهك حقوق العلامة التجارية، رافضًا حجة الشركة الناشئة بأن «إكس» تخلت عن حقوقها في العلامة عندما أعاد ماسك تسمية المنصة بعد الاستحواذ عليها مقابل 44 مليار دولار عام 2022.
في المقابل، رفض القاضي طلب «إكس» منع الشركة الناشئة من استخدام شعار طائر تويتر، وخلص إلى أن «إكس» تخلت عن حقوقها في كلمة «تويت» وشعار الطائر الأزرق، مستشهدًا بتصريحات سابقة لماسك أعلن فيها التخلي عن رموز تويتر.
وكانت «أوبريشن بلوبيرد»، ومقرها ولاية فرجينيا، قد تقدمت في ديسمبر الماضي بطلب إلى مكتب براءات الاختراع والعلامات التجارية الأمريكي لإلغاء العلامات التجارية الاتحادية الخاصة باسم «تويتر» والمملوكة لشركة «إكس»، بحجة تخلي الشركة عنها.
وقالت الشركة الناشئة إنها تسعى إلى استخدام العلامات التجارية لمنصة منافسة، كما تقدمت بشكل منفصل بطلب لتسجيل علامتها الخاصة باسم «تويتر».
ورفعت «إكس» دعوى قضائية ضد «أوبريشن بلوبيرد» في وقت لاحق من الشهر نفسه، مؤكدة أن علامتها التجارية «تويتر» لا تزال سارية، وأن محاولة الشركة الناشئة استخدام الاسم تمثل انتهاكًا لحقوقها التجارية.
وبموجب قرار الخميس، مُنعت «أوبريشن بلوبيرد» مؤقتًا من استخدام العلامات اللفظية المرتبطة باسم «تويتر» إلى حين البت في القضية، بعدما خلص القاضي إلى أن ادعاءات «إكس» بشأن انتهاك العلامة التجارية مرجح أن تنجح.
A federal court in Delaware, USA, issued a temporary injunction yesterday (Thursday) preventing the startup "Operation Bluebird" in the social media field from using the name "Twitter" and the associated trademarks for its platform, in a legal victory for "X," owned by Elon Musk.
Federal Judge Colm Connolly stated that "X" is likely to prove that Operation Bluebird's use of the name "Twitter" could cause confusion among users and violate trademark rights, rejecting the startup's argument that "X" had abandoned its rights to the mark when Musk renamed the platform after acquiring it for $44 billion in 2022.
In contrast, the judge denied "X's" request to prevent the startup from using the Twitter bird logo, concluding that "X" had abandoned its rights to the word "Tweet" and the blue bird logo, citing previous statements from Musk in which he announced the abandonment of Twitter's symbols.
Operation Bluebird, based in Virginia, had filed a petition in December with the U.S. Patent and Trademark Office to cancel the federal trademarks for the name "Twitter" owned by "X," arguing that the company had abandoned them.
The startup stated that it seeks to use the trademarks for a competing platform and has separately applied to register its own trademark under the name "Twitter."
"X" filed a lawsuit against Operation Bluebird later that same month, asserting that its trademark "Twitter" is still valid and that the startup's attempt to use the name constitutes a violation of its commercial rights.
Under Thursday's ruling, Operation Bluebird is temporarily prohibited from using the verbal marks associated with the name "Twitter" until the case is resolved, after the judge concluded that "X's" claims regarding trademark infringement are likely to succeed.
