أمرت النيابة الإدارية في مصر، اليوم (الثلاثاء)، بإحالة أربعة من العاملين في إحدى مدارس التعليم الأساسي للبنين بمحافظة القليوبية إلى المحاكمة التأديبية، وذلك لتقاعسهم عن اتخاذ الإجراءات القانونية اللازمة تجاه واقعة التعدي الجنسي على طالب من ذوي الإعاقة، والتي وقعت داخل المدرسة أثناء اليوم الدراسي.
وبحسب بيان صادر عن النيابة الإدارية، شملت قائمة المتهمين: المكلف بإدارة المدرسة، واثنين من الأخصائيين الاجتماعيين، وفني وسائل تعليمية كان مكلفاً بالإشراف على البوابة يوم الحادثة.
بدأت القضية عندما رصد مركز الإعلام والرصد بالنيابة الإدارية ما تم تداوله عبر مواقع إلكترونية حول قيام طالب بالصف الثاني الإعدادي بالتعدي جنسياً على زميله من ذوي الإعاقة داخل المدرسة أثناء اليوم الدراسي. وعلى الفور، أُخطرت النيابة الإدارية (القسم الثالث) بالواقعة، وباشرت التحقيق العاجل فيها.
وخلال التحقيقات، استمعت النيابة إلى أقوال مدير المدرسة، وولي أمر الطالب المعتدى عليه، والقائمين على إدارة المدرسة والعملية التعليمية، بالإضافة إلى عدد من الطلاب. وكشفت الأقوال ارتكاب المتهمين عدة مخالفات.
وتضمنت المخالفات تكليف أخصائية اجتماعية غير مختصة بسماع أقوال الطالبين رغم وجود المختص الأصيل، وبدون حضور أولياء أمورهم، وعدم تحرير محاضر رسمية دقيقة عن الواقعة، بالإضافة إلى إعداد تقارير استندت إلى بيانات غير مكتملة دون التحقق الدقيق من الحقائق، والتقاعس عن اتخاذ الإجراءات الفورية الواجبة بعد العلم بالواقعة.
وجاء ذلك مخالفاً لأحكام لائحة التحفيز التربوي والانضباط المدرسي الصادرة بقرار وزير التربية والتعليم، والتي تلزم إدارة المدرسة باتخاذ إجراءات فورية عند وقوع أي اعتداء أو إيذاء بدني أو نفسي أو جنسي بين الطلاب، وإخطار الإدارة التعليمية وولي الأمر، وتطبيق التدابير التربوية والانضباطية المقررة قانوناً.
كما كشفت التحقيقات تقاعس المكلف بأمن البوابة عن تسجيل بيانات ولي أمر الطالب في سجل الأمن عند دخوله المدرسة لمتابعة الواقعة.
وبعد انتهاء التحقيقات، أمرت النيابة الإدارية بإحالة المتهمين الأربعة جميعاً إلى المحاكمة التأديبية العاجلة.
واختتمت النيابة بتوجيه نداء إلى جميع القائمين على العملية التعليمية بضرورة تفعيل لائحة التحفيز التربوي والانضباط المدرسي الصادرة عن وزارة التربية والتعليم والتعليم الفني، مع تفعيل دور المشرفين والمرور اليومي لضمان رقابة وإشراف أفضل داخل المؤسسات التعليمية.
The Administrative Prosecution in Egypt ordered today (Tuesday) the referral of four employees from a basic education school for boys in Qalyubia Governorate to disciplinary trial, due to their failure to take the necessary legal actions regarding the incident of sexual assault on a student with disabilities, which occurred inside the school during the school day.
According to a statement issued by the Administrative Prosecution, the list of defendants included: the person in charge of managing the school, two social specialists, and an educational tools technician who was responsible for supervising the gate on the day of the incident.
The case began when the Media and Monitoring Center of the Administrative Prosecution detected what was being circulated on electronic platforms regarding a second-grade preparatory student sexually assaulting his classmate with disabilities inside the school during the school day. Immediately, the Administrative Prosecution (the third section) was notified of the incident and initiated an urgent investigation.
During the investigations, the prosecution listened to the statements of the school principal, the guardian of the assaulted student, the administrators of the school and the educational process, in addition to several students. The statements revealed that the defendants had committed several violations.
The violations included assigning a non-specialized social specialist to hear the statements of the two students despite the presence of the original specialist, without the attendance of their guardians, and failing to prepare accurate official reports about the incident, in addition to preparing reports based on incomplete data without thorough verification of the facts, and neglecting to take the necessary immediate actions after becoming aware of the incident.
This was in violation of the provisions of the educational motivation and school discipline regulations issued by the Minister of Education, which require the school administration to take immediate actions in the event of any assault or physical, psychological, or sexual harm among students, and to notify the educational administration and the guardian, and to apply the legally prescribed educational and disciplinary measures.
The investigations also revealed the negligence of the person responsible for gate security in recording the guardian's details in the security log upon entering the school to follow up on the incident.
After the investigations were concluded, the Administrative Prosecution ordered the referral of all four defendants to urgent disciplinary trial.
The prosecution concluded by calling on all those involved in the educational process to activate the educational motivation and school discipline regulations issued by the Ministry of Education and Technical Education, while enhancing the role of supervisors and daily monitoring to ensure better oversight and supervision within educational institutions.
